Synopsis of Previous Council action:
11/17/87 --- Resolution No. 87-404 was approved, ordering the vacation of State
Street, North of Sheridan Road.
02/15/88 --- The quitclaiming of the west side of State Street, now vacated, to
University Square, a Joint Venture, was approved in principal, and
the Real Property Section was authorized to proceed with the
preparation of the necessary documents.

STAFF REPORT
On November 16, 1987, Resolution No. 87-404 was adopted, ordering the vacation of State
Street north of Sheridan Road. University Square, the property owner adjoining vacated
State Street to the east, had underlying fee title to the easterly 40 feet of State
Street. They have submitted plans to develop this area. The westerly 20 feet of State
Street was owned by the City, and is now under our ownership.
It has been determined that this strip of land is of no use to the City. The parkway
area on the west side of State Street has been planted with grass, and is maintained as
a part of the landscaping on the Edison easement. To instal Ilandscaping on the
remaining portion of the 20 feet strip owned by the City would cost in excess of
$13,000, with an annual maintenance cost of $1,760.
University Square would like to acquire this strip of land from the City for use in
their developments. The existing portion that was improved as a part of State Street
will be retained. Maintenance of the grassed area will be assumed by University Square.
On February 17, 1988, approval was granted, in principle, for quit-claiming the westerly
portion of State Street, north of Sheridan Road, to University Square, and the Real
Property Section was authorized to proceed with the preparation of the necessary
documents.
Based on the above, it is recommended that the attached resolution authorizing and
directing the execution of a Quit-Claim Deed to University Square be approved.
JUSTIFICATION FOR PLACEMENT ON SUPPLEMENTAL AGENDA
This document was received by the City Attorney' s Office on 3-2-88
after the Regular Agenda deadline. There will be financial conse-
quences to grantee if deed is not approved as soon as possible.

RESOLUTION NO.
1 A RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING AND DIRECTING
THE EXECUTION OF A QUITCLAIM DEED POR A PARCEL OF LAND LOCATED WITHIN THAT
2 PORTION OF STATE STREET, NOW VACATED, NORTH OF SHERIDAN ROAD, TO UNIVERSITY
SQUARE, A JOINT VENTURE.
3 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
4 BERNARDINO AS FOLLOWS:
5 SECTION ONE: That the City of San Bernardino execute a Quitclaim Deed
6 to University Square, a Joint Venture, for a parcel of land located within a
7 portion of State Street, now vacated, North of Sheridan Road, that is no
8 longer needed by the City of San Bernardino.
9 SECTION TWO : That said Quitclaim Deed referred to herein, a copy of
10 which is attached hereto, marked Exhibit "A", and is hereby referred to and
11 made a part hereof as fully as though set out in length herein, is hereby
12 approved.
13 SECTION THREE: That the Mayor of the City of San Bernardino is hereby
14 authorized and directed to execute said Quitclaim Deed on behalf of the City
15 of San Bernardino.
16 I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the
17 Mayor and Common Council of the City of San Bernardino at a

Range 4 West, San Bernardino Meridian, as if said section lines were extended
across the Rancho Muscupiabe as per map recorded in Book 7 of Maps, page 23,
records of said County, and the Westerly prolongation of the North line of said
Sheridan Road; thence West, along said prolongation, to the West line of said
State Street; thence Northerly and Northeasterly along said West line, to it's
intersection with said East line of Section 18; thence South, along said East
