HomeMy WebLinkAbout2015-236 I RESOLUTION NO. 2015-236 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY 3 OF SAN BERNARDINO ORDERING THE SUMMARY VACATION OF A PORTION OF INSTITUTION ROAD SOUTHERLY OF CAJON BOULEVARD. 4 5 WHEREAS, California Streets and Highways Code Sections 8330-8334.5 provide 6 for summary vacation of streets and excess right-of-way of a street not required for street 7 purposes without notice and hearing; and 8 9 WHEREAS, the abutting property owner, Vulcan Material Company dba Ca1Mat 10 Company, has requested that the City of San Bernardino summarily vacate excess street 11 right-of-way on Institution Road southerly of Cajon Boulevard (see Exhibit "A" and "B"); 12 13 WHEREAS, the Mayor and Common Council makes the following findings based 14 upon the determinations made by City staff: 15 1. There are no public utilities with the proposed vacation area. 16 17 2. The property to be vacated constitutes excess right-of-way that is not required for 18 present or prospective public use. 19 20 3. For a period of five consecutive years, the portion of right -of-way to be vacated 21 have been impassable to vehicular travel. 22 4. No public money was expended for maintenance on the portion of right-of-way to be 23 24 vacated during the past five years. 25 5. The affected City Departments and pertinent agencies do not object to the proposed 26 vacation. 27 28 1 I NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 2 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 3 SECTION 1. Pursuant to California Streets and Highways Code Division 9, Part 3, 4 Chapter 4, the Mayor and Common Council of the City of San Bernardino hereby orders the 5 summary vacation of a portion of Institution Road southerly of Cajon Boulevard as 6 7 described in the legal description attached hereto and incorporated herein as Exhibit "A" 8 and depicted on the map attached hereto and incorporated herein as Exhibit "B". 9 SECTION 2. From and after the date this Resolution is recorded, this portion of 10 Institution Road which is vacated no longer constitutes a street. 11 12 SECTION 3. It is hereby determined that the vacation of said portion of Institution 13 Road is categorically exempt from the requirements of the California Environmental Quality 14 Act (CEQA), pursuant to Class 1, Section 15301(c). 15 SECTION 4.
