HomeMy WebLinkAbout11306 I� 1 RESOLUTION NO. _ 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF FIRST AMENDMENT TO 3 LEASE AGREEMENT RELATING TO THE CIVIC CENTER PARKING FACILITY; AND PROVIDING FOR THE ASSIGNMENT OF 325 PARKING SPACES FOR VANIR 4 TOWER COMPANY. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 6 OF SAN BERNARDINO AS FOLLOWS : 7 SECTION 1. The Mayor of the City of San Bernardino is 8 authorized and directed to execute on behalf of said City First 9 Amendment to Lease Agreement relating to the Civic Center parking 10 facility; and providing for the assignment of 325 parking spaces 11 for Vanir Tower Company, 12 13 a copy of 14 which is attached hereto, marked Exhibit "I" and incorporated 15 herein by reference as fully as though set forth at length. 16 I HEREBY CERTIFY that the foregoing resolution was duly 17 adopted by the Mayor and Common Council of the City of San Ber- 18 nardino at a ;,, meeting thereof, held on the. 19 day of , 197 by the following vote, to wit: 20 J AYES: Councilmen 21 22 NAYS : r 23 ABSENT: 24 25 26 The foregoing resolution is her ' y approved this` 4 �,;dad . 27 of , 197 28 - 29 Mayor the City o San Bernar ino 30 Approved as to form: '? —z 31 �� A '"r F I L E D 32 City At orney � MAR _ `1 1973 (P) ILUCILLE GOFORTH,, City.Clerk �� t- 1 FIRST AMENDMENT TO LEASE AGREEMENT 2 (Civic Center Parking Facility) 3 4 THIS FIRST AMENDMENT TO LEASE AGREEMENT (hereinafter 5 called "Lease") and entered into this4,/ day of 6 1973, by and between the REDEVELOPMENT AGENCY OF THE CI OF SAN 7 BERNARDINO, CALIFORNIA, a public body corporate and politic 8 organized and existing under the laws of the State of California 9 (hereinafter called "Agency") , and the CITY OF SAN BERNARDINO, a 10 municipal corporation organized and existing under the laws of 11 the State of California (hereinafter called "City") and VANIR 12 TOWER COMPANY, a partnership. 13 R E C I T A L S: 15 The Vanir Tower Company intends to construct a multi-story 16 building which should be serviced by at least 325 parking spaces 17 in the leased premises; Agency has agreed to provide at least 325 18 parking spaces with appropriate ingress and egress rights thereto 19 for such building; City is willing to concur with the parking 20 assignments and allocations recommended by Agency for such build- 21 ing; and the parties hereto are willing to agree that at least 325 22 parking spaces in the parking facility shall be made available for 23 the use of such building during the term of this lease; 24 NOW, THEREFORE, the parties hereto agree that certain lease 25 agreement between Agency and City dated September 4, 1972 is 26 hereby amended by adding Subsection (c) to Section 4 of said 27 Lease Agreement to read as follows: 28 " (c) Agency and City agree that the parking assignments I and allocations made under this section for the multi-story 2 building to be constructed by Vanir Tower Company, a partnership, 3 is hereby established at 325 vehicle parking spaces during the 4 term of this lease with appropriate ingress and egress rights 5 thereto. // 6 EXECUTED at San Bernardino, California thisc. /uay of 7 �' 1973. 8 9 ATTEST:.
