Motion: Adopt the Resolution.
Background:
Now The California Election Code mandates that the local governing body adopt a resolution
regarding the following:
Ordering election, including incumbents and office to be filled; Requesting the Registrar
of Voter to conduct the election; and regulations whether the candidates or the city will
pay for Candidate Statements. (E.C. 330, 10002, 10403.5, 13307)
The following City offices are up for election in November 2-a 3- Council seats in the
Third, Fifth, Sixth, and Seventh Wards, along with the offices of City Attorney, City
Treasurer, and City Clerk.
The cost of the election has not yet been estimated by the registrar of voters, but based
on previous elections, it should be in the range of$260,000, based on costs of previous
primary elections for the City.
Nomination papers will be issued by the City Clerk's Office; however, the County
Registrar of Voters Office will designate polling places, issue vote-by-mail ballots,
conduct the election, tally votes, and conduct the canvass.
Interested parties may call the City Clerk's Office to schedule an appointment to meet
with the City Clerk to get Nomination Papers and to file the required paperwork. No
Nomination Papers will be accepted without an appointment with the City Clerk. The
Nomination Period is from Wednesday, July 15 to Friday August 7; appointments will be
taken during this period only. Residents may call prior to this time to schedule an

appointment. (Note: Although many departments in City Hall are closed on Fridays, the
City Clerk's office will be open Friday, August 7, 2013, to accept any last-minute filings).
If a candidate in any of the races does not garner a majority of the votes, a runoff
election will take place on February 2, 2016. The estimated cost of a runoff election will
depend on whether it is a city-wide runoff election and/or how many wards are involved
in the runoff election. If a runoff election is required, it will be a stand-alone election and
could be conducted wholly by mail ballots, if that is the choice of the council.

SECTION 2. Primary Election Called. A primary election is called and will be held in

SECTION 3. Request for Consolidation of Elections. Pursuant to Section 10400 of =

17 the Elections Code, the Mayor and Common Council of the City of San Bernardino request that

SECTION 6. Conduct of Election. The primary election called by this resolution shall w

13 Bernardino is hereby requested to issue instructions to the Registrar of Voters to take all steps
