Recommended Motion:
1. That the Interim Director of Development Services and the City Clerk be authorized to
proceed with the vacation of portions of Piedmont Drive,North of Marshall Boulevard and
Marshall Boulevard between Piedmont Drive and Victoria Avenue.
AND
2. That Plan No. 10122 showing the proposed vacation of portions of Piedmont Drive,North
of Marshall Boulevard and Marshall Boulevard between Piedmont Drive and Victoria
Avenue be approved.

Staff Report
SUBJECT:
Authorization to Proceed and plan approval —proposed vacation of portions of Piedmont Drive,
North of Marshall Boulevard and Marshall Boulevard, West of Victoria Avenue.
BACKGROUND:
On June 28, 2000, this office received a petition to vacate portions of Piedmont Drive, North of
Marshall Boulevard. The petition was received from the San Manuel Band of Mission Indians to
construct a four-building tribal complex. The proposed vacation area was researched, and it was
discovered that a portion of Marshall Boulevard between Piedmont Drive and Victoria Avenue
was not vacated prior to the paving of the casino parking lot. The parking lot is encroaching on
the right of way of Marshall Boulevard. Staff is recommending that this portion of Marshall
Boulevard be included in the vacation process. The portions of these streets to be vacated are
"paper streets" only, and are not improved streets, except for the area of the casino parking lot
located on the South one-half of Marshall Boulevard, East of Piedmont Drive. San Manuel
currently owns the adjoining parcels, which should eliminate any conflicts or opposition to the
proposed vacation. The parcel located on the South side of Marshall Boulevard has accessibility
from Lynwood Drive.
If authorization to proceed is given, all City departments, utilities and affected property owners
will be given mailed notice of the proposal and asked to comment on any conflicts or to reserve
easements.
The petitioner has paid $500, which represents the first half of the vacation processing fee. The
second half will be due after the investigative proceedings and prior to the legal proceedings.
FINANCIAL IMPACT:
None. The petitioner has paid the first half of the processing fee and will pay the second half
when it becomes due.
RECOMMENDATION:
Staff recommends that authorization to proceed with the proposed vacation be given, and that
Plan No. 10122 be approved.
