Synopsis of Previous Council Action:
5115100 Approval of Plans, authorization to advertise for bids and authorize the Director of
Finance to amend the FY 1999/2000 Street Construction Budget to: a) Appropriate $99,000 to
242-362-5540-1783 (Flood Damage Repair); and b) Increase Revenue Account No. 242-000-
4630 (Federal Aid) by $87,600 to reflect the corresponding reimbursement received by the
City from the Federal Highway Administration.

Staff Report
Subject:
Resolution awarding contract to Hubbs and Ferrante for Flood Damage Repair at Alabama
Street—Tippecanoe Avenue at the Santa Ana River; and Pepper Avenue at the East side North
of Rialto Avenue Per Plan No. 10035.
Background:
The City received an $87,600 reimbursable Federal Aid Grant from the Federal Highway
Administration (FHWA) for street damage repairs at the above listed locations due to flooding
during the El Nino storm several years ago. This amount represented 88.53 percent of the
total estimated project cost while the City was responsible for the remaining 11.47 percent
local match.
Plans and specifications for this project are complete and it is ready to be awarded. The
project consists of replacing pavement and guardrail at Alabama Street, and curb, gutter and
sidewalk at Tippecanoe Avenue and at Pepper Avenue.
The estimated project costs are as follows:
Construction Estimate $58,010
Contingencies $ 8,700
Design, Inspection and Contract Administration $10,000
Total $76,710
This project was advertised locally and the following companies responded.

Financial Impact:
Funding for this project in the amount of $67,911.36 (88.53 percent) will be reimbursed by

No. 242-362-5504-7183 (Flood Damage Repair).
Recommendation:
That the Mayor and Common Council adopt the Resolution awarding the contract to Hubbs &
Ferrante for Flood Damage Repair at Alabama Street—Tippecanoe Avenue at the Santa Ana
River, and Pepper Avenue at the East side and North of Rialto Avenue, per Plan No. 10035.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
3 BERNARDINO AWARDING A CONTRACT TO HUBBS & FERRANTE FOR FLOOD
4 DAMAGE REPAIR AT ALABAMA STREET—TIPPECANOE AVENUE AT THE
SANTA ANA RIVER, AND PEPPER AVENUE AT THE EAST SIDE NORTH OF
5 RIALTO AVENUE PER PLAN NO. 10035.
6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
7 CITY OF SAN BERNARDINO AS FOLLOWS:
8 SECTION 1. Hubbs & Ferrante is the lowest responsible bidder for Flood Damage
9 Repair at Alabama Street—Tippecanoe Avenue at the Santa Ana River, and Pepper Avenue at
10
the East side North of Rialto Avenue Per Plan No. 10035. A contract is awarded accordingly
11
12 to said bidder in a total amount of $58,010.00, with a contingency amount of $8,700.00, but
13 such award shall be effective only upon being fully executed by both parties. All other bids,
14 therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute said
15 contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk
16
and incorporated herein by reference as fully as though set forth at length.

18 SECTION 2. This contract and any amendment or modifications thereto shall not take
19 effect or become operative until fully signed and executed by the parties and no party shall be
20 obligated hereunder until the time of such full execution. No oral agreements, amendments,
21 modifications or waivers are intended or authorized and shall not be implied from any act or
22
course of conduct of any party.

24 SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
25 within sixty (60) days of the passage of the resolution.
