2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF THIRTEEN (13)
3 QUITCLAIM DEEDS TO CERTAIN PROPERTY OWNERS FOR AN EXISTING
4 CITY STORM DRAIN AND SEWER EASEMENTS WITHIN TRACT NO. 17716,
GENERALLY LOCATED EAST OF PINE AVENUE BETWEEN OHIO AVENUE
5 AND BELMONT AVENUE.
6 WHEREAS, Pine Trails Partners, LLC dedicated certain storm drain and sewer
7 easements to the City of San Bernardino on Tract No. 17716 and the City accepted said
8
9 easements per said Tract Map as recorded on October 11, 2012, in Book 336 of Tract Maps at
10 Pages 74-77, records of the County of San Bernardino; and
11 WHEREAS, the City of San Bernardino has determined that said storm drain
12 easement(s) and said sewer easement(s) are no longer needed for their intended purposes; and
13 WHEREAS, FH II, LLC, the developer of said Tract No. 17716, and the owner of one
14 of the properties that said easements are located, has requested that said easements be
15
16 quitclaimed to all existing property owners since the easements are no longer needed for their
17 intended purposes.

NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
19 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

21 SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and
22 directed to execute on behalf of the City thirteen (13) Quitclaim Deeds to the current owners
23 of the thirteen (13) Lots listed in Exhibit "1", attached and incorporated herein, for those
24
25 portions of said storm drain easement(s) and said sewer easement(s) that are no longer needed
26 for their intended purposes within property known as Assessor Parcel Number's 0261-731-12,
27 13, 14, 15, 16, 18, 22, 23, 24, 25, 26, 27, and 29 generally located within Tract No. 17716 east

1 of Pine Avenue, between Ohio Avenue and Belmont Avenue, copies of which are attached
2 hereto collectively as Attachment"1" and incorporated herein.

Storm Drain Easement is to the extent located on the property described in this instrument, but not
otherwise, are hereby terminated by the execution and recording of this Quitclaim Deed.
