HomeMy WebLinkAbout2015-143 I RESOLUTION NO. 2015-143 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO FINDING AND DETERMINING THAT THE PUBLIC INTEREST 3 AND NECESSITY REQUIRE THE ACQUISITION OF A PERMANENT EASEMENT 4 AND A TEMPORARY CONSTRUCTION EASEMENT OVER A PORTION OF CERTAIN REAL PROPERTY LOCATED SOUTHWESTERLY OF CAJON 5 BOULEVARD AND NORTHERLY OF KENWOOD AVENUE,KNOWN AS ASSESSOR'S PARCEL NUMBER 0349-101-25-0000, UNINCORPORATED SAN BERNARDINO 6 COUNTY, CALIFORNIA, FOR THE WATER DEPARTMENT RELATIVE TO THE KENWOOD WELL FIELD 20" TRANSMISSION MAIN PROJECT, IN SAN 7 BERNARDINO COUNTY, CALIFORNIA. 8 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 9 SAN BERNARDINO AS FOLLOWS: 10 SECTION 1. The Mayor and Common Council held a Public Hearing on July 6, 2015, for 11 the purpose of allowing the property owner a reasonable opportunity to appear and be heard on the 12 following matters: 13 a. Whether the public interest and necessity require the project; 14 b. Whether the project is planned or located in the manner that will be most 15 compatible with the greatest public good and the least private injury; and 16 c. Whether the property sought to be acquired is necessary for the project. 17 SECTION 2. The Mayor and Common Council of the City of San Bernardino, as a result 18 of the above Public Hearing, determined that the public health, safety and welfare requires the 19 acquisition of a permanent easement and a temporary construction easement by the City over a 20 portion of that certain parcel of real property for water supply purposes, a public purpose. The real 21 property is described in Exhibit "I"; the permanent easement and the temporary construction 22 easement are described in Exhibit "A"; and the permanent easement and the temporary 23 construction easement are depicted in the maps in Exhibit `B." All referenced Exhibits are 24 attached and incorporated herein by reference. The acquisition is authorized by Section 19 of 25 Article 1 of the California Constitution; Sections 1, 40, and 240 of the City Charter; Section 26 37350.5 of the California Government Code; and Sections 1240.010 through 1240.050 of the 27 California Code of Civil Procedure. —1— I SECTION 3. On June 1, 2015, a Notice of Hearing was mailed regarding the intent of the 2 Mayor and Common Council to adopt a Resolution of Necessity for acquisition by eminent 3 domain of the real property interests described in Exhibits "A" and "B," which Notice of Hearing 4 is attached hereto as Exhibit "C" and is incorporated herein by this reference. Said Notice of 5 Hearing was mailed to all persons whose names appear on the last equalized County Assessment 6 Roll as having an interest in the property described in Exhibit"1," and to the address appearing on 7 said Roll. The Notice of Hearing advised said persons of their right to be heard on the matters 8 referred to therein on the date and at the time and place stated therein. 9 SECTION 4. The Mayor and Common Council of the City of San Bernardino hereby find 10 and determine and declare that: (a) the public interest and necessity requires the proposed project 11 and the acquisition by the City of San Bernardino of a permanent easement and a temporary 12 construction easement over the property for public water supply purposes and all appurtenant uses; 13 (b) the location of the proposed project is planned or located in the manner that will be most 14 compatible with the greatest public good and the least private injury; (c) the property and the 15 taking of the interest in the property as above described, is necessary for the proposed project; and 16 (d) offers required by Section 7267.2 of the Government Code have been made to the owners of 17 record. 18 SECTION 5. The Mayor and Common Council of the City of San Bernardino do hereby 19 declare that it is the intention of the City to acquire a permanent easement and a temporary 20 construction easement for water supply purposes over this property in its name in accordance with 21 the provisions of the laws of the State of California with reference to condemnation procedures. 22 SECTION 6. The easement is being acquired pursuant to Code of Civil Procedure Section 23 1240.510 for a public use set forth herein which is compatible with the existing public use. The 24 Mayor and Common Council further finds and determines that insofar as said parcel has 25 previously been dedicated to other public uses, the acquisition and use of said easement will not 26 unreasonably interfere with or impair the continuance of the public use as it exists or may 27 reasonably be expected to exist in the future as required by Code of Civil Procedure Section -- 1240.510. —2— 1 SECTION 7. The property is located in the County of San Bernardino, State of 2 California, and is particularly described in Exhibit"1." 3 SECTION 8. Special Legal Counsel Redwine and Sherrill ("Counsel") is hereby 4 authorized and directed to prepare, institute and prosecute, in the name of the City, such 5 proceedings, in the court having proper jurisdiction, as may be necessary for the acquisition of a 6 permanent easement and a temporary construction easement for water supply purposes over a 7 portion of this property. Counsel is also authorized and directed to make a deposit with the court 8 of the sum determined to be just compensation for said property and to request and obtain a 9 necessary court order granting the City the right of immediate possession and occupancy of the 10 property. Counsel is also authorized to take any action necessary or appropriate to acquire any 11 temporary right of access to the property which may be necessary for construction of any planned 12 improvements. 13 SECTION 9.
