HomeMy WebLinkAbout6659 1 RESOLUTION NO. 2 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO ESTABLISHING THE SAN BERNARDINO CITY SAFETY 3 COMMITTEE AND ADOPTING CERTAIN SAFETY RULES FOR INJURY HEARINGS 4 AND FOR THE OPERATION OF CITY VEHICLES. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 5 CITY OF SAN BERNARDINO AS FOLLOWS: 6 SECTION ONE: There is hereby established a San Bernardino 7 City Safety Committee which shall be known as the Safety Committee 8I SECTION TWO: The Safety Committee shall consist of at 9 least twelve members , including the Chairman, who shall be 10 appointed by the Mayor, subject to the approval of the Common 11 Council. The Chairman shall be a member of the Common Council 12 and the other members of said Safety Committee shall be officers 13 and employees of said City. The Committee hopes that every driver will become a defensive driver. Any further procedure for tae conduct of the accident and/or injury hegirings s-iiall be determined by the Chairman of the City Safety Co:rKqittee* RULES 1. DEFINITIONS - The word "accident4t for all purposes herein, shall ,. mean and include, any traffic accident involving a City employee while using a City-owned vehicle, or any vehicle while he is acting within the scope of his employment. The words t4City employee" for all purposes herein, shall mean and include all persons receiving compensation from the City for services rendered exclusive of elective officials, The City Administrative Officer, and Department Heads. The accident file involving any person in the excluded positions will be forwarded to the Mayor for review and appropiate handling. 2. TYOTIF'ICATION OF POLICE AND DEPARTMENT HEAD - Any employee involved nan�acc end sha=no i y the .—o lice DeparEment immediately. He shall also make a complete report of the accident to his Department Head as soon as possible , and in no case later than twenty-four hour: after the occurrence thereof, unless good cause is shown for the delay. 3. INFORPIATION SECURED AT SCENE OF ACCIDENT - Any employee involved in an accident shall mme a e y after such accident, if possible, secure the names and addresses of all parties involved and all parties witnessing such accident, together with the make and license number of all vehicles involved. The employee shall make no statement regarding any accident to any one not connected with the City or its insurance carrier, and in no event shall the employee enter into any negotiation for the settlement of any damage claim. 1;.. EMPLOYEE A:�_PEARANCE AT HEARING_ - Every employee shall appear at such Mme and place as requested In writing by a five day notice by the Committee for any hearing to he held in connection with any accident, upon receipt of notice from the Committee to so appear. If an employee fails to appear for such hearing and his absence has not been excused by the Secretary of the City Safety Committee and his department head or the department heads authorized representat ve, the Committee nay elect to review his case and make findings based upon the employeels statements contained in the insurance carrier report and the Police report, if any. The employee shall not be able to review such findings at a later. Committee hearing. 5. NOTIFICATION OF DEPARTMENT HEAD - The Department Head shall be no ified and given an opportunity to appear at all hearings held b. the Committee on any accident in which an employee of his department is involved. • RULES 6. EXPLANATION OF ACCIDENT - Each employee appearing before the Committee shaTl be given an opportunity to make a full explanation of the accident. 7. COI�LvJTTEE FINJDINGS - Before concluding any hearing, the Committee shall make specific findings as to: (a) The cause of the accident in terms of the Accident Classifications as hereinafter defined and the facts relating thereto. (b) Responsibility of the employee for the accident, or absence of responsibility thereof; and (c) The penalty to be recommended in the event that the employee is .found responsible for the accident . 8. BASIS OF FINDINGS - The Committee shall make its findings and r.ax=xKxtxk±z)1 recommen ations axed entirely upon the employee ' s negligence or carelessness rather than his liability under the lew. 9. PENALTIES - Penalties shall be recommended in terms of the degree of neglige77ce involved and the safety record of the employee. The Committee may recommend suspension without pay for a specific period of time , reassignment to a. position which does not involve the operation of a motor vehicle, discharge of the employee, or any other appropiate action. 10. SUSPENSION OF PENALTIES - The Committee,upon application of the employee, may recommend suspension of the penalty and placement of the employee on probation. If the employee is found responsible for another accident during his probationary period, t-he original penalty shall automatically apply, in addition to any penalty which may be recommended for the subsequent accident. Probationary periods shall be set at the rate of ninety (90) days for each day off without pay that is recommended up to and including four days off without pay. In the event that the Committee recommends suspension of the penalty attached to five days off without pay, it shall also recommend an appropiate probationary period. Probationary periods will start from the date of -the hearing. 11. CHANCE TAB:INC= MAMEUWW'RS - At times it may be necessary for r .vers in the Pollee and ?ire Departments to perform chance taking -2- RULES maneuvers in traffic occasionally resulting in a motor vehicle accident. The Police and Fire Chiefs are requested to review all. motor vehicle accident cases in their respective departments and attach a memorandum to the carrier report stating whether or not the maneuver being used at the time of the accident was justified or not justified. The report should be sent to the Secretary of the City Safety Committee for a scheduled hearing. If the City Safety Committee agrees with the Police or Fire Chief's report that the maneuver being used at the time of the accident was justified, the cause of the accident will be noted. on the Driver's record and the notation added, "Justified - No Penalty assessed , " 12. 'REPORT OF COMMITTEE FINDINGS - The Committee shall make a report of its findings as set forth in Rules 7 to 11 inclusive. This report shall be directed to the Employee 's department head with. a copy to the employee. Under no conditions shall a Department Head change or revise in any manner the recommendation of the Committee. If the Department Head does not agree with the recommendation of the City Safety Committee he shall request a hearing, in writing, before the Committee to present his reasons for the disagreement. The recommendation reached at this hearing shall be final. 13. RECOMMENDATIONS OF THE COMMITTEE - The Committee may recommend that an employee be transferred to a position which does not involve the operation of a motor vehicle at any time it may find that he has been involved in an excessive number of accidents or habitually persists in unsafe Practices while driving motor vehicles in the conduct of City Business . The basis for such a. finding shall be specified in the letter of recommendation. 14. VISUAL SCREENI vG 'PEST - REQUEST FOR ',"AIVER OF HEAR?NG - Any driver who reports a motor vehicle accident to the department head shall be sent to the office of the Safety Coordinator for a visual screening test. If the driver acknowledges the fact that the accident he was involved in was "preventable" under an accident classification assigned by the Secretary of the City Safety Committee and. no purpose would be served by his appearance before the City Safety Committee (i. -e. he has no particular defense to offer) , he may, while at the office of the Safety Coordinator waive such a hearing by signing a written acknowledgment that he had a Preventable accident IF: a. No injury was caused by the accident. b. No damage in excess of $50.00 was caused by the accident. c. The driver has no prior record of a preventable accident. RULES Drivers signing such acknowledgments will not be called before the City Safety Committee for a hearing, but will receive the minimum penalty recommended by the Committee: One day off without pay, suspended, 90 days probation. 15. SCREENING OF MOTOR VEHICLE ACCIDENTS - The Safety Coordinator will screen all motor vehicle accident reports for Dreventable accidents and notify individual drivers not signing the acknow- ledgment of a preventable accident when to appear for a hearing. Tf the Safety Coordinator is absent from duty, the screening will be done by the Secretary. 16. REPORTS , RECOMMENDATIONS AND FLiDINGS - The report , recommen- dations and findings of the Committee, any oral or written state- ment of the employee, Department Head, member of the Committee or of am witness , and any document or writing presented at the hearing or filed with the Committee, shall be kept and remain private and confidential by the Committee as private and privileged communications made in official confidence in the public interest in order to foster and promote the public healt_, safety and general welfare of city employees and officers and the public , and in order to encourage the free communication of facts and ideas designed to prevent work injuries and accidents . Such papers , documents and information are not public records and shall remain in the sole custody of the Secretary until their destruction is ordered by the Committee and shall not be surrendered to any person, including a member of the Committee. The employee ployee or Department Head shall not disclose the contents of or exhibit or release from his possession such papers , documents or information, or copies thereof, to any person. These rules are for your benefit, guidance, and protection. These Safety Rules, as published, are in no way to be considered as all inclusive . Departmental Safety Mules will expand and supplement these Rules, and are subject to the Procedures and Rules herein cont- ained as if they were in fact published in these Safety Rules. In 9.11 places in these iiul.es where the words "shall" or `must" are used compliance therewith is mandatory. The words "may" or 'should" are used where compliance is desirable but not necessarily mandatory under varying circumstances . Employees are urged to famiaiarize themselves with all Safety Rules prepared and published by the City Safety Committee and their respective departments . Failure to comply may result in disciplinary action. ' Existing 'Governmental Charter, Ordinances, Codes, Statutes, Rules, and Orders shall be considered a part of these Rules and where any conflict exists between the two, those of Governinenta.l status shall prevail. Prior to, or at the beginning, of each meeting the Chairman assigns specific accident and/or injury cases to the individual Committee members, distributing the related documents sufficiently in advance of the time set for the first hearing to enable the Committee members to become familiar with the facts of the cases assigned to them. Upon the entrance of the employee to be heard, the Chairman outlines the purpose of the Committee . The Committee member to whom the particular case has been referred briefly relates the place, date, and time of the accident and/or injury, the vehicle involved if an accident, and any other facts which the Chairman has determined, before the employee appears, are necessary and non-prejudicial to the case. The Committee member then invites the employee to describe the accident and/or injury in detail and offer any supplementary infor- mation which he feels should be presented to the Committee for proper disposition of the case . Upon conclusion of the employee ' s explanation, the Chairman invites all Committee members to ask the employee any questions about the accident and/or injury they may wish. The Chairman then requests the employee to leave the room until the Committee has voted and made its findings. The Chairman shall not vote except in case of a tie vote . Upon findingx (1) the cause of and (2) .responsibility for the accident and/or injury, and before the determination of the penalty, the Secretary is requested to recite the employees record of previous accidents, injuries, hearings, and penalties. Upon the return of the employee to the hearing room the Chairman advises him of the disposition of the rase which will be recommended to the Department Head. Each employee shall have the right to be represented at the hearing by any person of his choice. Any further procedure for the conduct of the accident and/or injury hearings shall be determined by the ChairnianL of the City Safety Committee. RULES WORK INJURIES 1. DEFINITIONS - The word "injury" for all purposes herein, shall mean and include any work injury involving a City employee while acting within the scope of his employment. The words "City employee" for all purposes herein, shall mean and include all persons receiving compensation from the City for services rendered while employed, exclusive of elective officers, the City Administrative Officer, and Department Heads. The injury file Involving any person in the excluded positions will be forwarded to the Mayor for review and appropiate action. 2. NOTIFICATION OF DEPARTMENT HEAD - Any employee involved in a work connected injury shall notify his immediate supervisor as soon as possible . He shall also make a complete report of the injury to his Department Head within twenty four (24) hours after the occurance thereof, unless good cause is shown for the delay. 3. 1-2PLOM,' APPEARANCE AT HEARING - Every employee shall. have the right to be r presented by any person of his choice at any hearing. Every employee shall appear at such time and place as requested by a five (5) day written notice by the Committee for any hearing to be held in connection with any injury upon receipt of notice from the Committee to so appear. If an employee fails to appear for such hearing and his absence has not been excused by the Secretary of the City Safety Committee and his department head, or the department heads authorized representative, the Committee may elect to review his case and make findings based upon the employee' s statements contained in the injury report. The employee shall not be able to review such findings at a later Coram.ittee hearing. 4. NOTIFICATION OF DEPARTMENT Hl-,,AD - The Department Head shall be notified and given an opportunity-to appear at all hearings held by the Committee on any injury to which an employee of his depart- ment in involved. 5. .EXPLANATION OF ThE INJURY - Each employee appearing before the Committee shall be given an opportunity to make a full explanation of the injury. 6. CO,1MITTEE FINDINGS - Before concluding any hearings, the Committee shall make spec f_ e indings as to: (a.) Responsibility of the employee for the i.njury, or absence of responsibility thereof; and (b) The penalty to be recommended in the event that the employee is found responsible for the injury. A hearing is not concluded until all investigation is finished and may be postponed as many times as is necessary to obtain all the facts. RULES WORK INJURIES 7, BASIS OF FI'j%TDINGS - The Committee shall make its findings and recommendations ases entirely upon the employees negligence or carlessness in observing and practicing good safety habits. 8. PENALTIES - Penalties shall be .recommended in terms of the degree of negligence involved and the safety record of the employee. The Committee may recommend suspension without pay for a specific period of time, reassignment to a position which does not involve the operation of a motor vehicle, disenarge of the employee , or any other appropiate action. 9. SUSPENSION OF PENALTIES - The Committee, upon application of the emp. oyee, may reco-mmend suspension of the penalty and placement of the employee on probation. If the employee is found responsible for another injury during his probationary period, the original penalty shall automatically apply, in addition to any penalty which may be recommended for the subsequent injury, Probationary periods shall be set at the rate of ninety (90) days for each day off without pay that is recommended up to and including four days off without pay. In the event that the Committee recommends suspension of the penalty attached to five da-Ts off without pay, it shall also recommend an appropiate probationary period. Probationary periods will start from the date of the hearing. 10. REPORT OF COMMITTEE FINDINGS - The Committee shall make a report of is findings as set forth i_n mules 6 to 9 inclusive . This report shall be directed to the employeets department head with a copy to the employee . Under no circumstances shall a department head change or revise in any manner the recommendation of the Committee . If the department head does not agree with the Committee recommendation he shall request a hearing, in writing, before the Committee to present his reasons for the disagreement. The recommendation and report reached at this hearing shall be final and binding ypon the Committee, 11, WAIVER OF HEARING - Employee ' s will not be requested to attend a hearing ir., in the opinion of the Committee, there is clearly no evidence of negligence, carlessness, or violation of the Safety Rules.
