2. Closed Session Report
I Jolena Grider, Chief Assistant City Attorney, reported the following actions taken
during closed session:
In the matter of Kendall Plaza, LLC v. City of San Bernardino, the Council voted to give
settlement direction by a vote of 5-0 with Council Members Valdivia and Mulvihill
absent;
In the case of City of Fontana, et al. v. State Board of Equalization, et al., the
Council voted to give settlement direction by a vote of 5-0 with Council Members
Valdivia and Mulvihill absent.

Reading of Resolutions and Ordinances
Deputy City Clerk Montoya read into the record the titles of all the resolutions and ordinances on
the agenda.
Moment of Silence
Mayor Davis announced the passing of Larry Sharp former resident of San Bernardino who was
very actively engaged in the City for many years and the passing of John Wilson, former Deputy
City Attorney from the 1980's.
Invocation/Pledge of Allegiance
The invocation was given by Chaplain Vince Ortega of Victory Outreach Church. The Pledge of
Allegiance was led by Henrietta Sims, a sixth grade student at Captain Leland F. Norton
Elementary School.

Mayor Davis gave an update on the Strategic Planning process. He announced that last
week was the kick off for the Roadshow events. He stated a lot of good input was
received and it would be used for building the strategic plan, and staying connected in
line with the Plan of Adjustment as the City gets ready to put that forward to the
bankruptcy court. Mayor Davis announced the upcoming Roadshow dates and times.

RES. 2015-36 - Resolution of the Mayor and Common Council of the City of San
Bernardino awarding a Contract to DVBE ASAP Inc. for Drainage Improvements for"I"
Street between Home Avenue and Evans Street,per Plan No. 12970 (SD09-002).
Robert Eisenbeisz, City Engineer stated that the timeline for the completion of this
project would not be very long. He stated that this project would provide protection to
about six or eight homes that were affected by the flooding. Mr. Eisenbeisz stated that
the ultimate solution is to extend the storm drain up Mt. Vernon Avenue and capture and
intercept those storm flows further north. He stated that this will be considered an
interim step,but it will provide a better level of protection than what is there now.

Change the Zoning District from Residential Medium High (RMH) and Office Industrial
Park (OIP) to Industrial Light (IL) on 19.65 Acres to Construct a 427,000-Square Foot
Warehouse Facility on the East Side of Waterman Avenue, 1,000 Feet North of Mill
Street. (FIRST READING)
RES. 2015-38 - Resolution of the Mayor and Common Council of the City of San
Bernardino Approving General Plan Amendment 14-08 to Change the Land Use
Designation from Residential and Industrial to Industrial on 19.65 Acres to Construct a
427,000-Square Foot Warehouse Facility Located on the East Side of Waterman Avenue,
1,000 Feet North of Mill Street.
Mayor Davis opened the hearing.
Mark Persico, Director of Community Development, gave a presentation of background
analysis on General Plan Amendment and Zoning Map Amendment.
Pursuant to Resolution No. 2000-279, City Clerk Hanna administered an oath to those
individuals wishing to speak on the matter that they would provide true and honest
testimony.

Mark Persico, Director of Community Development, stated that it is required that the
applicant of the project construct an eight foot high solid masonry wall at the Northeast
boundary of the property where it abuts residential.
Council Member Johnson stated that he would abstain on this matter since his place of
employment was relatively close to the project. He left the Council Chamber and returned
after the vote was taken.
Motion: Close the hearing; and lay over Ordinance for final adoption.

Bernardino Establishing the Position of Mayor's Chief of Staff (U) and Approving the
Job Description. (Continued from February 2, 2015)
Public Comments:
Scott Olson, San Bernardino
Allen Parker, City Manager, stated that based on the comments of Council at the meeting
of February 2, 2015, the local market — San Bernardino County Board of Supervisors —
was considered in setting the salary for the position. Supervisors each have a Chief of
Staff and City officials used the County's existing job description and salary to determine
the market rate for what the City was looking for. Based on that information they also
included a comparison on what the City paid their department heads, thus, that salary
range was comparable to that being used to recruit a Chief of Staff.
Helen Tran, Human Resources Division Manager, stated that she had difficulty trying to
gather salary information that could be compared with the position. She said that San
Bernardino County made the most sense since they had a Chief of Staff position and that
was how they came up with the salary range.
Motion: Adopt the Resolution, as amended, changing the salary range from 4584 to
4560.

Recognized Obligation Payment Schedule (ROPS 15-16A).

9. Public Comments on Items Not on the Agenda
Larry Waterhouse, Interim Fire Chief, introduced himself and thanked the Mayor, City
Council, and, City Manager for offering him the position of Interim Fire Chief in leading
a quality organization of women and men in the City of San Bernardino, as well as
working with a fine Executive Management Team.
Enrique Armenta, Constituent Service Representation for Congressman Pete Aguilar
spoke about service and assistance that their office provides to constituents.
Osvaldo Diaz, San Bernardino, spoke about moving to a room for rent and getting
assistance for his wife when she has medical problems due to her autism; and spoke
about re-establishing himself back into society.
Larry Guidry, San Bernardino, spoke about upcoming park revitalization projects. He
encouraged all City Council members to hold regular constituent town hall meetings and
follow Council Member Nickel's lead.
Melissa McDonald, student from California State University, San Bernardino, gave a
presentation on the Gilbert Street Community Advocacy Project. The presentation was
submitted into the record.
Cecilia Gonzalez, student from California State University, San Bernardino, spoke about
the maintenance at Perris Hill Park. It had been brought to her attention by residents that
Perris Hill Park was getting cleaned once a month. She felt this was not sufficient for the
neighborhood children to play in.

Kyla Burdett, student from California State University, San Bernardino, spoke about
parks needing to be cleaned for families.
Jeanette Hernandez, student from California State University, San Bernardino, spoke
about how the Gilbert Street Community Advocacy Project reduced crime rates in the
area. She also stated that according to the National Youth Network, crime is less likely to
happen when a neighborhood park is kept clean.
Vinay Diaz, student from California State University, San Bernardino, stated that as
students and future social workers their project goal is to maintain clean parks. She
stated that the plan does not involve money, but rather donated resources such as water,
gloves, trash bags, and volunteer time. They are hoping to create ongoing volunteer
organizations to help maintain the parks.
Jere Sandberg, student from California State University, San Bernardino, requested that
the City Council donate any available resources to support the Gilbert Street Community
Advocacy Project. His organization was focusing on Perris Hill Park, but their ultimate
goal was to focus on all of the parks within San Bernardino.
Robert Porter, San Bernardino, read a quote from the "Handbook of the Indians of
California" by A. L. Kroeber. He asked that people take a look at his studies on his "I
Love San Bernardino"Facebook page.
Jay Lindberg, San Bernardino, spoke about a security guard that was killed at a
marijuana clinic. He also spoke on the war on drugs and organized crime.
Scott Olson, San Bernardino, spoke about how Robert Porter and Al Palazzo had come
up with a lot of very positive things for the City. He also spoke about needing residential
housing next to the bus stops and promoting art that depicts the history of our City in a
positive way.
Al Palazzo, Rialto, spoke about how excited he was about the Roadshow meetings at the
school sites engaging the community. He stated that he was on the radio (KCAA 1050
am) every week for the next thirteen weeks. The public may view online.
Deanna Adams, San Bernardino, stated that she was an observer at the Historical
Preservation Commission meeting of December 8, 2014. She was very happy when she
read a proposal for an Ordinance to preserve historical properties, but the joy was short-
lived because Mr. Persico persuaded the members that it was too costly, and that it would
take years of community involvement and education. She apologized and said that Mr.
Persico did not have an interest in preservation. Ms. Adams stated the commissioners
needed a brush up course on historical preservation. Submitted into the record was a
document titled, "Historic Building that Should Be Saved."
10. Items to be Referred to Council Committees
Council Member Nickel stated that he was contacted by California Consulting, LLC.,
-= which was a full service grant management firm that conducts research, oversees the
actual grant management process, and oversees the reporting requirements. Council
Member Nickel said he would like to invite them to give a presentation at a future
Grants Committee meeting.

11. Announcements -- Elected Officials and City Manager
Mayor Davis announced that on March 6, 2015 at 5:00 p.m. there would be a State of the
City address that will be held at the San Bernardino Airport.
12. Adjournment
At 9:20 p.m., the meeting adjourned to 6:00 p.m., Monday, February 23, 2015, in the
EDA Conference Room, 201 N. "E" Street, San Bernardino. The next joint regular
meeting of the Mayor and Common Council and the Mayor and Common Council Acting
as the Successor Agency to the Redevelopment Agency is scheduled for 2:00 p.m.,
Monday, March 2, 2015.
