Synopsis of Previous Council Action:

10/06/08 -Resolution No. 2008-373 was adopted, approving the formation of Assessment
District No. 1058 relative to Tentative Tract Map No. 14112, Foothill Drive and Sterling Avenue
area.
Background:
On October 6, 2008, Resolution No. 2008-373 was adopted, approving the formation of
Landscape Maintenance Assessment District No. 1058, in the Foothill Drive/Sterling Avenue
area. The formation of the District was a condition of approval by the Planning Commission for
Tentative Tract No. 14112, which consisted of 56 residential lots and numerous lettered lots.
Approval of the resolution included approval of the 2009/2010 assessment roll to provide
funding for maintaining the landscaping after development occurred. This maintenance cost was
assessed on the 2009/2010 property tax bill.
The owner, Sterling Heights LLC, has decided not to build the project and requested a reversion
to acreage eliminating the lots created by Tract No. 14112. On August 29, 2011, Parcel Map No.
19283 was recorded, reverting all of the created lots back to their original acreage. The owner
also requested termination of Assessment District No.1058 since it is no longer pertinent to the
reverted lots (see attached letter). The attached resolution terminates Assessment District No.
1058 and releases the lien created with the formation of the district.
The owner paid the first half of the assessment, which will necessitate a refund after termination
of the district, less incidental and administrative costs. The remaining portion of the 2009/2010
assessments will be removed from the County tax rolls.

6 that the public interest, convenience, and necessity required the formation of a Landscape
7 Maintenance Assessment District in the Foothill Drive and Sterling Avenue area; and

14 that all the land included within the boundaries of said District benefited by said maintenance; c

Recorder of San Bernardino County establishing a lien on all parcels located within the

23 boundaries of Assessment District No. 1058 as shown on the Assessment Diagram Map of
24 said District; and
25 WHEREAS, the property within the boundaries of Assessment District No. 1058 has
26 been reverted back to acreage by the recordation of Parcel Map No. 19283, recorded in Book

239 of Parcel Maps, Page(s) 5 —6, in the office of the County Recorder of San Bernardino

4 WHEREAS, the property owner of the lots within the boundaries of Assessment
5 District No. 1058 has requested that the assessment district be terminated.
6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
7 CITY OF SAN BERNARDINO AS FOLLOWS:

8 SECTION 1. That the Mayor and Common Council hereby find and determine that 0

9 the public interest, convenience, and necessity no longer require the existence and continuance E

12 SECTION 2. That the Mayor and Common Council do hereby terminate Assessment a
District No. 1058 and hereby release all liens affected by said Assessment District against the

14 parcels of land lying within the boundaries of said Assessment District, as shown on =

15 Assessment District Diagram No. 1058, recorded on October 15, 2008 in the office of the

County Recorder of San Bernardino County as Document No. 2008-0458991 in Book 84 of Z
