HomeMy WebLinkAbout2015-029 1 RESOLUTION NO. 2015-29 2 3 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE DESTRUCTION OF CERTAIN OBSOLETE RECORDS BY THE SAN BERNARDINO 4 POLICE DEPARTMENT. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 6 OF SAN BERNARDINO AS FOLLOWS: 7 SECTION 1. That the Mayor and Common Council of the City of San Bernardino s 9 approve the destruction of certain obsolete records by the San Bernardino Police Department. 10 Subject to written consent of the City Attorney, as provided in Sections 34090, 34090.5, and 11 34090.6 of the Government Code, the following city records, documents, instruments, books or 12 papers may be destroyed as of the date of this resolution's approval: 13 14 (a) All Personnel Complaints and Internal Investigations with dispositions dated prior to i5 January 1, 2010; 16 (b) All other Internal Affairs files dated prior to January 1, 2013; 17 (c) Pitchess Motion files dated prior to January 1, 2013; 1s (d) Police canine activity and apprehension reports dated prior to January 1, 2010; 19 20 (e) Employee grievances dated prior to January 1, 2010; 21 (f) Internal promotional tests and evaluations dated prior to January 1, 2013; 22 (g) Use of Force Reports dated prior to January 1, 2013. 23 (h) Pursuit Reports dated prior to January 1, 2013. 24 25 (i) Lawsuits and claims with adjudication dates prior to January 1, 2013. 26 0) Accidental Discharges and Dog shooting files dated prior to January 1, 2013. 27 (k) Public Records Request files dated prior to January 1, 2013. zs (1) Subpoena Duces Tecum files dated prior to January 1, 2013. 1 1 (m)Personnel Applicant files w/processing dates prior to January 1, 2010. 2 (n) Obsolete administrative files dated prior to January 1, 2013. 3 4 5 6 /// 7 8 9 /// 10 11 12 13 /// 14 /// 15 16 17 18 19 20 21 22 /// 23 24 25 26 27 28 2 1 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE DESTRUCTION OF CERTAIN OBSOLETE RECORDS BY THE SAN BERNARDINO 2 POLICE DEPARTMENT. 3 I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the Mayor and 4 5 Common Council of the City of San Bernardino at a joint regular meeting thereof, held on the 6 17th day of February, 2015, by the following vote, to wit: 7 Council Members: AYES NAYS ABSTAIN ABSENT 8 MARQUEZ X 9 BARRIOS X 10 11 VALDIVIA X 12 SHORETT X 13 NICKEL X 14 JOHNSON X 15 16 MULVIHILL X 17 -C f GeorgeA Hanna, rty Clerk 18 19 The foregoing Resolution is hereby approved this day of Febiruam 2015. 20 � • 4 21 R.
