Description) Vacation filing fees ,Q Finance: ;ouncil Notes: 5-0262 !/2-./c.5-Agenda Item No. L CITY OF SAN BERN-_MINO - REQUEST FAR COUNCIL ACTION STAFF REPORT A request was received by this office from Harry Gerken, one of the adjoining property owners, to vacate the generally Northerly/Southerly alley lying between i Palmyra Drive and Sonora Drive and between Ralston Avenue and 40th Street (it actually ends in Sonora Drive where it curves around to the East) . All of the adjoining property owners and the apartment tenants have requested the vacation of the alley. On 01-23-95, authorization was given to proceed with the proposed vacation, and ' Plan No. 9235 was approved. All of the affected City Departments and public utility companies were notified of the proposed vacation on 02-17-94, with a reply due by 03-09-95. The responses are attached for your information. The petitioners for the vacation are proposing to install a gate at both entrances into the alley. Access will still need to be retained for refuse services and for the Fire Department. Both of these departments will be provided with keys by the petitioner. An easement will be reserved to the City for emer- gency and service vehicles. Access will also need to be retained for parking by the adjoining residences. This will be accomplished by reserving an easement for access to all abutting i properties. G.T.E has also requested a reservation of an easement for existing ` telephone services. All of the mentioned easements will be set forth in the Resolution of Intention and the Resolution Ordering Vacation. All adjacent property owners will be notified of the public hearing by mail, the alley will be posted and the Resolution of Intention will be published 2 times in the Sun, the first time at least 15 days prior to the public hearing. On 03-14-95, a Notice of Exemption was filed with the County Board of Super- visors, and a finding of consistency with the General Plan was made. The second half of the $1000 fee has been paid. ` We recommend that the Resolution of Intention be adopted to set the public hearing for the regularly scheduled Council Meeting of 05-01-95.
