Synopsis of Previous Council Action:
September 3, 2014 This item was heard by the Ways and Means Committee, which
recommended it move forward to the full Council.
Background:
CVC22658(m)(1) mandates that when a tow company removes a vehicle from private
property they shall notify the local law enforcement agency of that tow after the vehicle
is removed from the private property and is in transit. The San Bernardino Police
Department takes, on average, 150 Private Property Tow (PPT) calls each month. This
is time consuming on our personnel.
There are many laws described within the California Vehicle Code regarding private
property tows. These laws not only describe what circumstances allow a vehicle to be
towed off private property without the knowledge or permission of the vehicle owner, but
also describe the laws governing the tow companies, such as the distance that these
vehicles can be towed outside of the city from which the vehicle was taken. The police
department is required to investigate any complaints made by individuals against tow
companies regarding private property tows in our jurisdiction.

The police department is required to accept telephone notification of any and all PPTs
made by any tow company when they tow a vehicle from our jurisdiction. This is
handled by Front Desk personnel during normal business hours and by dispatchers
after hours. When taking a PPT report, our personnel are required to run a CLETS
query on the vehicle with the information provided by the tow company. If there are no
holds on the vehicle, Front Desk personnel complete a LERMS entry while dispatchers
complete a CAD entry, which generates a police incident number. This incident number
is then provided to the tow company for their records. If the CLETS query returns with
the vehicle noted as a reported stolen vehicle or having a DOJ stop, police personnel
are dispatched to the location of the vehicle to complete the appropriate paperwork for
the recovery.
After the initial report is completed, the PPT paperwork is transferred to the Records
Department where the vehicle is entered into CLETS as a towed/stored vehicle. This
prevents vehicle owners from reporting their towed vehicle as stolen. If the records
technician doing the CLETS entry finds that the vehicle is listed as stolen, towed/stored,
or impounded, the CLETS entry cannot be completed until a teletype is sent to the
agency with the existing CLETS entry requesting removal of their entry so that we can
complete our CLETS entry. If this occurs, it can delay the entry process immensely.
At times, vehicles have been entered incorrectly due to errors made by police personnel
or by the tow company representative when the initial report is made. These errors can
equate to a large expense either to the City, the vehicle owner, or the tow company. If
the license plate or VIN (vehicle identification number) is entered incorrectly, the wrong
vehicle is entered into CLETS. When the error is made by police personnel, the City of
San Bernardino is likely going to be liable for the tow fees as well as any associated
storage fees related to the PPT.
In an effort to prevent this from occurring, it is recommended that each tow company
that conducts PPTs within our jurisdiction be required to complete a Private Party Tow
form and return it to the police department either by fax or email by the end of the
business day following the tow; see Attachment A for a rough draft of purposed form.
This form will document data such as vehicle information, location, date and time of tow,
and SBPD incident number. This form will be in addition to the telephone report, not
instead of, which is why it will require our police incident number. A telephone report is
still required to comply with state law and to ensure prompt entry of the vehicle into
CLETS. A member of the Traffic Unit will review the completed forms as prepared by
the tow company on a weekly basis to audit and verify that all data entry made on PPTs
is accurate. This entire process will be audited by the Traffic sergeant on a regular
basis to verify accuracy.
It is estimated that the initial PPT report takes approximately 10-15 minutes. The data
entry completed by Records personnel during the second step takes approximately 30
minutes and can take longer as noted above. Verification work performed by Traffic
personnel is estimated to take approximately 10-15 minutes and the sergeants
verification is estimated to take approximately 2-3 minutes. Based on these time
estimations, each private property tow costs the City approximately $36.97 in manpower

expenses (Attachment B).
Several Orange County law enforcement agencies are currently charging tow
companies for their services in this manner. The City of Fullerton's rate is $33 per
vehicle (Attachment C); the City of Costa Mesa's rate is $20 per vehicle (Attachment D);
and the City of Orange has their rate Set at $5 per vehicle (Attachment F),
Having this in place will also help us to monitor the tow companies conducting business
in our city. It will help us to verify that these tow companies are towing vehicles from
private property legally and may prevent predator tows.
An appropriation of $27,000 in additional revenues into account#001-210-0000-4762
would be required if the program were implemented January 1, 2015. It is requested
the Director of Finance be authorized to incorporate the changes into the FY2014-2015.

prohibiting the City from charging this fee as long as the fee is based on the actual costs
for the services provided(taking the phone call, creating an incident and data input). Q

• We will compile a list of tow companies that are doing business in our City. This F_
will be done using reports on PPTs previously called into the police department
along with the assistance of front desk personnel and dispatch, who continue to a

Clerk's office on which tow companies have a valid business license with our a;

• We will verify that each of the tow companies on our compiled list has a valid a
license with the City of San Bernardino to conduct business within the City of San
Bernardino. If a company does not have a valid business license, we will notify M
the city clerk's office so they can ensure that a business license is obtained. N
• We will send written notification to each tow company notifying them of this new c
`y service fee along with a copy of the city resolution giving such authorization. In
addition we will include our address and the telephone number to the SBPD
traffic office so they can contact us with any questions. o
• Information Technology will set up an email account in the name of SBPD traffic a

office so that the tow companies can email an electronic copy of their completed
tow forms giving them the option of email or fax. Several professional staff a
members assigned to traffic will have access to this mailbox so as personnel t:
rotates in and out of the traffic unit, this process will not have to be changed. d
• LERMS is currently set up for PPTs/repossessions sharing an incident field.
Information Technology will separate these under two different codes so that
traffic personnel can easily compile a report documenting the PPT incidents, `n
which they can use to compile bills for each tow company. As back-up, the forms d
completed and returned to the police department can be used for billing purposes. E
These forms will be scanned into a file in the traffic departments shared drive and w
any hard copies will be deleted.
• A member of the professional staff assigned to traffic will prepare invoices for
each tow company on a monthly basis. He/she will then enter the billing
information into New World as accounts and attach all scanned supporting
documentation. This will be done on or before the 151h of the month following
the billing period.
• We will keep a list of tow companies at the front desk so as new companies call in
PPTs, we can send them notification of our fees and prepared tow form and will
include them in our billing.

5 WHEREAS, California Vehicle Code Section 22658(a) authorizes the owner or person in Q.

22 B. The owner of, or other person responsible for, any vehicle impounded by a tow company o
from private property in the City of San Bernardino under the California Vehicle Code shall pay in
23 accordance with the provisions of this section a fee in an amount set by resolution by the Mayor and
Common Council to reimburse the City for the costs of processing and recordation of notices and =
24 reports of the tow and impound of such person's vehicle. Such fee shall be collected by the tow 0
25 company impounding the vehicle at the time of collection of its own towing and/or impound fees and
shall be paid over to the City each month within ten (10) days after the close of the calendar month for
26 which payment is due. Each towing company shall provide to the City, on a monthly basis
concurrently with its monthly payment, a summary report of all such impounds and fees collected in w
27 such form and/or detail as the Chief of Police may specify from time to time, and shall make available
28 to the City upon request any and all records of the information necessary to verify such report upon the
request of the City.
