Synopsis of Previous Council action:
On May 3 , 1991 , the Mayor and Common Council adopted the Development
Code to implement the General Plan.
Recommended motion:
That the Mayor and Common Council direct Planning Staff to prepare a
Development Code Amendment establishing criteria for a waiver of the
requirment of a second route of access for tentative tracts and parcel
maps when in situations in which such a waiver would not pose a threat
to public health, safety, and welfare in the event of flood, fire or
other emergency, and in situations in which the property subject to
such a subdivision is located outside any Fire hazard area and it is
not feasible for a second route of access to be provided.

STAFF REPORT
SUBJECT AND REQUEST: Initiation of a Development Code
Amendment for waiver of two Different
Standard Routes for Ingress and Egress
for a Tentative Tracts or Parcel Map
under certain circumstances.
Mayor and Common Council Meeting of November 2, 1992
REQUEST:
That Planning Staff be directed to prepare a Development Code
Amendment to allow approval of a tentative tract or parcel map with
only one standard route of ingress and egress, under certain
circumstances, for property located outside of any Fire Hazard
Area.
KEY ISSUES:
The following key issues have been identified which warrant
consideration of such an amendment to the Development Code:
o The existence of properties within the City located
outside of any Fire Hazard Areas which are incapable of
providing a second standard route of access yet, if
subdivided with only one standard route of ingress or
egress, would not pose any threat to the public health,
safety, and welfare of the citizens of San Bernardino in
the event of flood, fire or other emergency. Such
properties are precluded from subdivision since two
standard means of ingress and egress must be provided per
Development Code Section 19. 30.200 (6) .
o Lack of provisions in the Development Code to waive the
requirements for a second standard route of access for a
tentative tract or subdivision, whether or not such a
waiver may be justified.
o Prior to adoption of the Development Code, Municipal Code
Title 18 contained provisions for waiving the requirement
for a second standard route of access for tentative
tracts or parcel maps, provided that such a waiver did
not pose any potential public health, safety or welfare
risks in the event of an emergency.

PLANNING COMMISSION RECOMMENDATION:
On September 22 , 1992, the Planning Commission heard a request for
an Extension of Time on Tentative Tract No. 14781, a request for a
19 lot single-family subdivision on 7. 55 acres located on the east
side of Lynwood Way, between Byron and Amanda Streets in the RS,
Residential Suburban land use designation. Tentative Tract No
14781 was approved by the Mayor and Common council on August 20,
1990 with only one standard route of access using the provisions of
Municipal Code Section 18.40. 160 (C) . The Planning Commission was
unable to approve the time extension request because the one
standard access route is not consistent with the Development Code.
The Planning Commission continued the hearing of the Extension of
Time request for Tentative Tract No. 14781 until January 5, 1993,
to allow Staff time to bring the issue before the Mayor and Council
for consideration of a Development Code Amendment.
COST:
It is estimated that it will cost the City approximately $2, 000 to
process the Development Code Amendment. This cost includes staff
time and Public Noticing costs. It is further estimated that it
will take 4 months for staff to complete the amendment once work is
commenced.
STAFF RECOMMENDATION:
That the Mayor and Common Council direct Planning Staff to prepare
