STAFF REPORT
The Water Department began the upgrades to the City's water system
in 1990 in accordance with the Water System Master Plan. One of
the major components of the master plan was the installation of a
major water transmission facility to move water from the lower end
of the basin to the higher elevations in the water system. The
overall project also requires additional water storage reservoirs
and pumping facilities.
A portion of the capital funding for the transmission facilities
and funds to acquire property for the additional water storage
reservoir sites were included in the bonds issued in 1990 by the
West End Water Conservation and Development Joint Powers Authority.
Water Department staff conducted extensive investigations to find
property at the required elevations and in close proximity to the
transmission lines. There were very few parcels of land available
along the transmission route that were not already developed. A
site was found for the lower reservoir, elevation 12491 .
In April, 1992 , the Mayor and Common Council approved Resolution
No. 92-143 declaring the necessity of the taking, in fee simple
absolute, Assessor's Parcel Number 148-122-01 Ptn. , that portion of
the North twenty-four (24) acres of Lot 2 , Block 83 , of Rancho San
Bernardino, as per plat recorded in Book 7, Page 2 of Maps,
Official Records of the County of San Bernardino, State of
California, consisting of 6. 33 net acres, for the public use of a
water storage reservoir and pumping facility. The resolution of
necessity for the taking of this parcel of land was necessary for
the Water Department to proceed with eminent domain proceedings.
During negotiations with Scott Research Laboratories, Inc. , a
triangular piece of land adjacent to Medical Center Drive was added
to the transaction to keep the property boundaries straight. As
part of negotiations, the Water Department has agreed to Quitclaim
the triangular shaped piece of property to Scott Research
Laboratories, Inc. , consisting of 0. 068 net acres, Assessor's
Parcel Number 148-022-04 Ptn. , as this parcel is excess to our
needs. It lies south of the storm drain easement and will
straighten out property boundary lands.
All issues pertaining to this transaction have been resolved.
Attached are maps which depict the locations of the parcels to be
acquired and quitclaimed.
It is recommended that the Corporation Grant Deed from Scott
Research Laboratories, Inc. be accepted, and that the property be
dedicated for Water Department use, and that the City approve the
Quitclaim Deed to Scott Research Laboratories, Inc. for the
triangular piece of property.

11 Corporation Grant Deed from Scott Research Laboratories, Inc. , as
12 set forth in Exhibit "1" attached hereto and incorporated herein by
13 reference as though fully set forth at length herein.
14 SECTION TWO: That the property acquired herein is dedicated
15 for Water Department use.
16 BE IT FURTHER RESOLVED that a copy of this Resolution be
17 attached to said Grant Deed, and that the same be recorded in the
18 Office of the County Recorder of San Bernardino County.
