Financial Impact:
The City has budgeted the Projects as listed on the attached Exhibit I, entitled, "Annual Citywide
Maintenance Services Contract for Roadway Rehabilitation Work on Various San Bernardino
City Streets, Special Provisions No. 13024." All Projects are roadway rehabilitation CIP
Projects. The total FY 2014-15 budget for these Forty Seven(47)Projects is $5,598,800.00,
which includes design engineering, construction, construction management, field engineering
and inspection.
The Contract to be executed with Matich Corporation is for a period not to exceed one year
(twelve months).
Motion: Adopt the Resolution.
Synopsis of Previous Council Action:
06/30/14 The Mayor and Common Council approved Resolution No. 2014-245, adopting the
City's Final Budget Document for Fiscal Year 2014-15.
Backsround:
On June 30, 2014, the Mayor and Common Council approved Resolution No. 2014-245,
adopting the City's Final Budget Document for Fiscal Year 2014-15, which includes the
rehabilitation of up to 47 City roadways. The rehabilitation work on these roadways provides for
and supports the health, welfare and safety of San Bernardino residents, business owners and
visitors by providing roadways that accommodate the safe and efficient movement of goods and
people throughout the City.
The Project work to be done includes clearing and grubbing; removal and replacement of curb
access ramps, curbs, gutters, and cross gutter and spandrels; cold milling; removal and
replacement of deteriorated pavement; pavement overlays; utility adjustments and other items as
required.
The work in this Contract will be segmented into Task Orders based u p on geographic location,

similarity of project components and economies of scale. In order to accomplish the work in an
efficient and timely manner, Task Orders are to be configured such that work operations may be
conducted in a continuous and efficient manner. Each Task Order will identify specific work
items and quantities for those work items, and will be based upon actual field conditions within
the budgeted Project limits. Matich Corporation will be issued a Notice to Proceed for each Task
Order, which will identify the Scope of Work, working days, and expected date of completion
for the work identified in each Task Order.
This Maintenance Services Contract contains 47 separate street pavement rehabilitation Projects.
The majority of these Projects are suitable to being combined into Task Orders without
additional City-prepared plans. Several of the Projects, however, will likely require additional
details, exhibits and engineering analysis before they can be combined into Task Orders. These
more complex Projects will likely be grouped into Task Orders during the latter part of this
Contract period.
It is also possible that one or more of the 47 budgeted Projects may need to be delayed or
deferred due to utility impacts, drainage issues, permitting, or other more complex engineering
issues. These more complex Projects may require additional design engineering and possibly be
contracted separately. This will be determined during detailed field inspections and as the
Projects are assembled into Task Orders.
Local advertising for Project bids included the San Bernardino County Sun Newspaper, F. W.
Dodge Company (Monrovia), High Desert Plan Room, Construction Bid Board, Inc., San Diego
Daily Transcript, Bid America Electronic, AGC Plan Room/The Daily Construction Reporter,
- iSgFt Plan Room, Reed Construction Data, Construction Bid Source (CBSI), Bid Ocean, Inc.,
and the City of San Bernardino Chamber of Commerce. Information and electronic copies of the
construction documents were also posted on the City's website.
A total of three bids were received and are listed below:

After a careful review of the three sealed competitive bids and verification of mathematical
calculations and certifications, staff has determined that Matich Corporation is the apparent low
bidder and has met the minimum requirements of the bid specifications and guidelines. Based on
the above information, Matich Corporation is the lowest responsible bidder and staff
recommends that the contract be awarded to this company.

Owners and tenants along the roadways will be notified about the planned construction work
activities prior to the start of the work for the various Task Orders, including the San Bernardino
City Unified School District Safety Coordinator, individual schools, other agencies impacted by
the work, and SB Direct.
As with all Public Works contracts, staff will work with Matich Corporation to help minimize
construction-related impacts to ensure that the roadway rehabilitation work is conducted as
quickly and efficiently as possible.

16 SECTION 2. As stated in the Contract, Matich Corporation acknowledges that the

18 Documents that compose this Contract represent selected segments of streets throughout the

19 City. The City is entering into a Contract, for roadway rehabilitation work, for a period not to

1 SECTION 3. As stated in the Contract, at the end of the initial term, Matich

within Ten (10) working days after notification by the CITY via the Notice to Proceed, for each Task m

he completed in no more than Thirty (30) working days, per street (i.e., flatwork and pavement work
combined). The CITY seeks a source of materials and labor that will provide accurate and timely delivery and
completion of the assigned work.
Bidder understands that a bid is required for the entire work, that the quantities set forth in the Bid
Schedule are to calculate the total bid amount for comparison purposes only,and that final compensation under 3
the Contract will be based upon the actual quantities of work satisfactorily completed. The Bidder agrees that
the CITY reserves the right to increase or decrease the amount of any quantity shown in the Bid Schedule, to �°
add or subtract Project(s), to delete any item from the Contract and pay the Contractor at the unit bid prices,
and to determine the number of Project(s)and number of Task Order(s)under the terms of this Contract. 3

Prior to Notice to Proceed, CITY will issue to the selected Contractor Task Order(s) that indicate
locations, extents and details for all work to be performed. For bidding purposes, CITY intends to issue
approximately three (3)to eight(8) Task Orders covering the work under this Contract; however, City retains
the right to alter or amend the number of Task Orders to be assigned to the Contractor under this Contract.
Bids shall be submitted on the bid forms provided in the Bid and Contracting Documents package. All
bid forms shall be completed, signed, and sealed in accordance with these instructions and the instructions
included with the individual bid forms. A bid that fails to include all bid forms will be considered non- _

Subcontractors," in Section 2 of these Special Provisions regarding the requirement that proposed
subcontractors be listed in the bidder's Bid Documents. All subcontractors are to be listed in the
Designation of Sub-Contractors for items of work or portions thereof to be subcontracted in excess a
of one-half of one percent of the total bid or $10,000.00, whichever is greater.

no further consideration. If after execution of the Agreement the CITY discovers the Contractor is

"Specialty Items," the Contractor will be notified that he or she is in violation of the Contract and
will have that portion subcontracted for which is less than fifty percent(50%) of the amount of work

The Special Provisions(Bid and Contract Documents)for this Project shall be amended as follows:

1. Delete SECTION 3,entitled, "3-1 AWARD AND EXECUTION OF CONTRACT,"and replace with the following: o

3-1.01 GENERAL -- The Award of the Contract, if it be awarded, will be to the lowest responsible
bidder whose bid complies with all the requirements prescribed. The award of the Contract will be made by and at m

the sole discretion of the Mayor and Common Council at a regularly scheduled Council meeting. The bidder, to J
whom the Contract Is awarded, shall file with the Engineer all required insurance policies, bid bond, and execute
the Contract within 10 calendar days after receiving notification of the award. Failure to file the stipulated
documents and execute the Contract within the prescribed time shall constitute good and sufficient grounds for a
rescission of the award and payment of 10%of the bid to the CITY as liquidated damages. _
Additionally, the CITY reserves the right to reject any or all bids, to accept any bid or portion thereof, to 3
waive any irregularity and to take the bids under advisement for the period of time stated in the legal Notice Inviting
Sealed Bids as may be required to provide for the best interests of the CITY. The Bid Form, the Special Provisions- �°
Instructions to Bidders, the Special Provisions, the Notice Inviting Sealed Bids and Addenda, together with any
attachments, shall be considered as part of the Contract (the Bid and Contracting Documents) between the CITY and 3
the Contractor to whom the Contract is awarded. In no event will an award be made until all necessary
investigations are made as to the responsibility and qualifications of the Bidder to whom the award is contemplated, v

3-1.03 CONTRACT BONDS -- The Contractor shall be responsible for filing Payment and Faithful Q
Performance Bonds with the Engineer before the Notice to Proceed is executed by the CITY, for each specific Task
Order. In accordance with Section 2-4, "CONTRACT BONDS," of the Standard Specifications, the Contract bonds,
including Payment Bond (Material and Labor Bond) and Performance Bond shall be underwritten by a surety
company having a rating in Best's most recent Insurance Guide of "A" or better. Bonds must be issued by a surety a
who is listed in the latest version of U.S. Department of Treasury Circular 570 and is authorized to issue bonds in the

Performance Bonds equal to 100%of the estimated value of each separate Task Order. Alternatively,Contractor may

Contract as so stated within Contractor's bid, prior to the issuance of the initial Task Order. W
CITY shall release the Contractor from each separate Task Order Payment and Performance Bond, upon v
completion of the work for the respective Task Order, should Contractor so elect to file separate Payment and
Performance Bonds for each Task Order. Should Contractor elect to file with CITY a single set of Payment and c
Performance Bonds, covering the sum total of the work within all of the assigned Task Orders as so identified per c

completion of the pavement milling(s), and completion of the placement of the final Asphalt concrete cap, or as a

CITY shall, using its own forces or via a separate CITY-retained contractor, apply final pavement striping and
pavement markings. Contractor shall be contractually required to maintain temporary striping for fourteen calendar Z
days, or until CITY's signing and striping contractor applies permanent roadway striping and markings, whichever �°

All temporary pavement striping and markings shall conform to the California Manual on Uniform Traffic v
Control Devices (CA MUTCD); emphasis shall be given to matching dimensions of adjoining improvements, subject to
concurrence of the Engineer. c

STRIPING AND PAVEMENT MARKINGS," shall include full compensation for furnishing all labor, tools, equipment,
