Financial Impact:
There is no financial impact associated with this action. The petitioner has paid the first half
($1,000) of the total processing fee of$2,000.
Motion 1: That the Public Works Director and the City Clerk be authorized to proceed with
the proposed vacation of an east-west alley south of Adell Street, between "I"
Street and the I-215 Freeway; and
Motion 2: That Plan No. 12831 showing the proposed vacation of an east-west alley south of
Adell Street,between"I" Street and the I-215 Freeway,be approved.
Synopsis of Previous Council Action:
None.
BackEround:
On September 8, 2011, an application was received from Bill Faulkner with the concurrence of
the adjacent property owners, requesting the vacation of an east-west alley south of Adell Street,
between "I" Street and the I-215 Freeway. Bill and Dana Faulker own the three parcels on the
north of and directly adjacent to this alley, and Billy and Evelyn Matthews own the three parcels
on the south. The adjacent owners have requested the vacation due to the area constantly being
used for dumping, and both parties would also like to obtain use of the adjacent portion of the
alley for more useable property acreage. This alley was dedicated as public right-of-way on the
Map of Urbita subdivision, and staff has determined that the City does not own any portion in
fee. The City does not otherwise determine the underlying ownership or guarantee title to the
area being vacated, and the owners will need to have a title company determine the ownership.
If authorization to proceed is given, all City departments,utility companies and affected property
owners will be notified to determine if any conflicts exist, including the traffic circulation of the
existing area. Once all research is completed, certain findings will need to be made by the
Public Works Director to determine that area proposed to be vacated is no longer needed for
public right-of-way, which will be brought forward for approval at a later date. At that time, a
resolution setting a date for a public hearing will be presented, which will allow anyone

protesting the vacation to present their concerns or conflicts. A map depicting the general
vicinity and Plan No. 12831 showing the details of the proposed vacation is attached.

I understand that a total non-refundable fee of $ 2,000.00 shall be paid by me as a cost of the
proceedings, one-half of which 1 000.00 is hereby enclosed. The remainder of $1,000.IX)shall be due and
payable after the investigative proceedings are complete and prior to the commencement of the legal t].

proceedings. I further understand that said fees are NOT payment for any real property or
improvements thereon, but for the costs of the vacation proceedings ONLY and that the City of San N
Bernardino does NOT determine underlying ownership of the area to be vacated nor does it guarantee
title to any property involved and I have been advised to consult a title company to determine such

I understand that at the conclusion of the investigative proceedings, the City will notify me of its N
findings including and conflicts with City facilities now located in the area proposed to be vacated, or the
request by any utility company for the reservation of any existing easements and that such conflicts or Q

reservations may affect the intended use of the proposed area,once vacated,and that I may elect to terminate or o

continue the proceedings. If I elect to continue, the remaining unpaid fees shall be paid by me prior to the _0
