Financial Impact: Funds for this contract,which will not exceed$75,000, are available in the General Fund, General Government, Professional/Contractual,Non-departmental, FY 2011-12 budget (Account No. 001-090-5502-0000-00053). This Amendment is equal to $30,000 above the original Agreement. Account: 001-090-5502-0000-0053 Budgeted Amount: $1,387,700 Balance as of 10/18/11: $550,256 Balance after approval of this item: $520,256 Please note this balance does not indicate available funding. It does not include non-encumbered reoccuring expenses or expenses incurred,but not yet processed. Motion: That said resolution be adopted. Synopsis of Previous Council Action: On December 6, 2010, Mayor and Common Council approved Amendment No. 1 to the Consultant Services Agreement between Atkinson, Andelson, Loya, Ruud and Romo (Resolution No. 2010-382). On May 17, 2010, Mayor and Common Council approved a Consultant Services Agreement between Atkinson, Andelson, Loya, Ruud and Romo to provide labor negotiator services in the Human Resources Department(Resolution No. 2010-118). On April 22, 2010, Mayor and Common Council approved the hiring of a consultant to represent the City of San Bernardino as Chief Negotiator in labor negotiations with the Police and Fire Safety bargaining units. Background: In April 2010 the Mayor and Common Council approved the hiring of a consultant, Irma Rodriguez Moisa, an employee of Atkinson, Andelson, Loya, Ruud, and Romo (AALR&R), to Updated: 11/3/2011 by Mayra Ochiqui B Packet Pg. 189! 5.M 1354 represent the City as chief negotiator in labor negotiations with the Police and Fire Safety bargaining units. Since that time, Ms. Rodriguez Moisa has completed Police Safety negotiations and assisted in the unilateral implementation by Mayor and Council of the Fire Safety unit. Salary concessions with the Fire Safety unit expired June 30, 2011, and we are, once again, in negotiations with this unit with Ms. Rodriguez Moisa as chief negotiator for the City. N 8 6 WITNESSETH: Z 9 WHEREAS parties hereto entered into a Consultant Services Agreement dated May = 10 m 11 17, 2010, for Chief Negotiator services in labor negotiations with the Police Safety and Fire Q .. Ln 12 Safety bargaining units; and M 13 WHEREAS, parties hereto entered into Amendment No. 1 to the Consultant Services "r- 14 Agreement on December 6, 2010; and > d 15 WHEREAS, CONSULTANT represents that it continues to hold all necessary licenses 0 16 to practice and perform the services herein contemplated; and 0: 17 WHEREAS, Sections 5.1 and 5.14 of the aforesaid Consultant Services Agreement a 18 N allow such Agreement to be amended by a written agreement executed by the parties; and 19 E Q 20 WHEREAS, the parties desire to enter into Amendment No. 2 to the Consultant Q :a 21 Services Agreement; and x w 22 NOW, THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS: E 23 The amendment to the Consultant Services Agreement amends only those terms contained 24 Q 25 herein; such terms not covered by this Amendment shall remain in full force and effect as set 26 forth in said Consultant Services Agreement dated May 17, 2010. 27 1.2 Costs for Services. CONSULTANT will be compensated at the rate of$250.00 28 per hour for all services rendered to the CITY. The amounts expended under this Agreement Packet Pg. 193 5A b 1 for consultant fees shall not exceed $75,000 without further approval of the Mayor and 2 Common Council. This is equal to $45,000 above the approved compensation amount in the 3 consultant services Agreement.
