HENDERSON SUBJECT: AWARD OF CONTRACT - Executive Director PLATT BUILDING DEMO- LITION AND ASBESTOS DATE: September 3, 1993 ABATEMENT/REMOVAL --------------------------------------------------------------------------------------------------------------------------------------------- Synonsis of Previous Commission/Council/Committee Action (s): On July 6, 1993, the Mayor and Common Council authorized and directed staff to proceed with the demolition of the Platt building located at 491 West Fifth Street, San Bernardino. --------------------------------------------------------------------------------------------------------------------------------------------- Recommended Motion(s): (Mayor and Common Council MOTION A: That the Mayor and Common Council authorize and direct the Executive Director to negotiate and execute a contract with the apparent low bidder -LDL Engineering, Inc. for the demolition and asbestos abatement/removal at the Platt Building in the amount of$181,000, plus 15% (fifteen percent) contingency (total not to exceed $208,150). MOTION B: That the Mayor and Common Council authorize and direct the Executive Director to execute all necessary documents related to the demolition and asbestos abatement/removal of the Platt Building. Prior to the execution of a contract, the bidder will be required to submit all necessary insurance requirements, performance bond and materials and labor bond. As previously identified, LDL Engineering, Inc. had a total bid of $181,000. Staff is also requesting a fifteen percent (15%) contingency in the amount of $27,150, for a total authorized amount of $208,150. Staff recommends adoption of the form motion. !r' KENNE H J. The building is historic and a nomination to the National Register of Historic Places is pending before this office. The nomination has been placed on the agenda of the Historical Resources Commission for their November meeting. It is the evaluation of the State office that the building is eligible for listing. I understand from a brief conversation with Valerie Ross, Director, San Bernardino City Planning Department, that a mitigated negative declaration was noticed in May for a project which involved only the demolition of the historic building. Since that action, there appear to have been changes in the project. The project now involves the state Department of General Services in the construction of a new office building. This new project would appear to merit reconsideration under CEQA to fully consider all feasible alternatives which would reduce or eliminate adverse effect to the environment. As a state agency the General Services Department has obligations to eliminate, or mitigate adverse effects on historic properties, not only under CEQA, but under Public Resources Code 5024.5 and under the Governor's Executive Order (W-26 .92) which directs state agencies to "ensure that state plans and programs contribute to the preservation and enhancement of significant non-state owned heritage resources. " I am also concerned that the demolition contract approval was not noticed on the regular Council agenda, but was added as a supplementary item late last weep. The information available to this office also indicates that the Department of General Services may not be fully aware that the project involves the demolition of an historic building.
