Description) Finance: Council Notes: 75-0262 Agenda Item No.� CITY OF SAN BERW IDINO - REQUEST F 'R COUNCIL ACTION STAFF REPORT Pursuant to a petition received by this office in December of 1989, the Director of Public Works/City Engineer and the City Clerk were authorized to proceed with the proposed annexation of the unincorporated area Southeasterly of Devore Road, Southwesterly of Cajon Boulevard. On June 21, 1993, Resolution No. 93-205 was approved, making application to the Local Agency Formation Commission (LAFCO) for the proposed annexation. Section 99 of the Revenue and Taxation Code requires that the distribution of property taxes, relative to the proposed boundary changes, be negotiated and agreed upon by all affected local agencies. The County Board of Supervisors shall negotiate with the City, any exchange of property tax revenues on behalf of all affected agencies, except as provided for in Section 99.1 of the Revenue and Taxation Code. Such negotiations between the City and County took place in 1980, when County staff and a committee of City managers agreed upon a formula for property tax transfers, and Resolution 82-325 was adopted June 7, 1982, requesting the Board of Supervisors to direct the establishment of a policy for the formula. The adoption of the attached resolution fulfills the City's compliance with said Section 99 . V I n i r, \� 1 ` tiL t � •gyp' .��„ La e ( k V^i� �� •c ° .. eta JZ 3 • y��1 4A Z N�VIY 0 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND AMONG THE CITY OF SAN 3 BERNARDINO AND THE COUNTY OF SAN BERNARDINO, RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFCO 2758, FOR THE AREA GENERALLY 4 LOCATED SOUTHEASTERLY OF DEVORE ROAD, SOUTHWESTERLY OF CAJON BOULEVARD. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 6 7 SECTION 1. Recitals. The Mayor and Common Council of the City of San Bernardino hereby find and determine that: 8 9 A. Pursuant to Section 99 of the Revenue and Taxation Code, prior 10 to the issuance of a certificate of filing by the Local Agency Formation 11 Executive Officer, the governing bodies of all local agencies whose service 12 area or service responsibilities will be altered by a proposed 13 jurisdictional change will negotiate and determine by resolution the amount 14 of property tax revenues to be exchanged between and among such local agencies. 15 16 B. Except as provided in Section 99.1 of the Revenue and Taxation 17 Code, in the event that a jurisdictional change would affect the service 18 area or service responsibility of one or more special districts, the Board 19 of Supervisors of the County of San Bernardino shall, on behalf of the 20 district or districts, negotiate any exchange of property tax revenues. 21 C. The Mayor and Common Council of the City of San Bernardino and 22 the Board of Supervisors of the County of San Bernardino have determined the 23 amount of property tax revenues to be exchanged as a result of 24 jurisdictional change described by LAFCO 2758. SECTION 2. Implementation. 25 26 A. The negotiated exchange of property tax revenues between the 27 City of San Bernardino and the County of San Bernardino attached hereto as 28 Exhibit "A" and incorporated herein by reference, resulting from the above 08-19-93 1 RESOLUTION DETERMINING PROPERTY TAX REVENUE EXCHANGE BETWEEN THE CITY AND COUNTY OF SAN P--NARDINO RESULTING FROM JURISDIC -ONAL CHANGE DESCRIBED BY LAFCO 2758. 1 described jurisdictional change, is hereby approved and accepted. The column 2 entitled "Estimated Current Tax Revenue" shall represent the amount of 3 property tax revenues for the current year to be paid to the County of San 4 Bernardino and its affected agencies. 5 B. The annual tax increment generated in the area subject to the 6 jurisdictional change and attributable to the Local Agencies whose service 7 area or service responsibilities will be altered by the proposed , 8 jurisdictional change shall be allocated in the future years pursuant to the 9 provisions of Section 98 of the Revenue and Taxation Code. 10 SECTION 3.
