STAFF REPORT
Bids for this project were opened at 2 : 00 p.m. , on
Tuesday, 7-6-93 .
A total of 5 bids were received, ranging from $593 , 383 . 50
to $759 , 374 . 00 . The low bid of $593 , 383 . 50 is 3 . 8% under the
Engineer' s Estimate of $616 , 504 . 00 .
Federal-Aid Surface Transportation Program Funds have been
programmed to finance the prescribed portion of the total project
cost. At least 10% of the aggregate total of our annual Federal-
Aid Highway Funds must be expended on Disadvantaged Business
Enterprises (DBE) . A goal of 20% was established in the contract
documents for DBE participation on this project in order to
balance out our traffic signal projects, which typically_ have no
DBE participation.
The low bidder submitted documentation showing 12% DBE
participation, and requesting that a finding be made that they
had made a "good faith" effort, to achieve the established goal
of 20% . Caltrans reviewed their documentation, but did not
concur that the low bidder had made a "good faith" effort.
Documentation submitted by the second low bidder indicated
that the 20% goal would be met. Therefore, Caltrans has
concurred in awarding the contract to the second low bidder. The
second low bid of $626 ,413. 00 is 1 . 6% over the Engineer' s Esti-
mate of $616, 504 . 00.
Below is the total estimated project cost, based upon the
actual second low bid price.

Design Consultant' s Fee 40, 000. 00
Construction Engineer (W.O. #1965) 45 , 000. 00
Sub-Total $ 711 ,413. 00
Contingencies (15%) ± 106 ,587 . 00

All costs incurred for this project will be charged to
Account No. 242-362-57895, "Rehabilitation of Pavement on
Arrowhead Avenue, from Mill Street to Third Street. Federal-Aid
Surface Transportation Funds have been approved by SANBAG to
finance about 86% ($703 , 500) of the total estimated project cost.
The 14% local agency share will be financed from the City' s
Measure "I" Local 1/24� Sales Tax funds.
We recommend that a contract be awarded for the second low
bid price.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO THE MATICH CORPORATION FOR PAVEMENT REHABILITATION ON
3 ARROWHEAD AVENUE, FROM MILL STREET TO THIRD STREET.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1 . The Matich Corporation is the lowest
6
responsible bidder for: Pavement Rehabilitation on Arrowhead
7
Avenue, from Mill Street to Third Street, per Plan No. 8774 . A
8
contract is awarded accordingly to said bidder for the total
9
amount of $626 , 413 . 00 , but such award shall be effective only
10
upon the contract being fully executed by both parties. All
11
other bids, therefore, are hereby rejected. The Mayor is hereby
12
authorized and directed to execute said contract on behalf of the
13
City; a copy of the contract is on file in the office of the City
14
Clerk and incorporated herein by reference as fully as though set
15
forth at length.

SECTION 2 . This contract and any amendment or modifica-
17
tions thereto shall not take effect or become operative until
18
fully signed and executed by the parties and no party shall be
19
obligated hereunder until the time of such full execution. No
20
oral agreements, amendments , modifications or waivers are
21
intended or authorized and shall not be implied from any act or
22
course of conduct of any party.
23
SECTION 3 . This resolution is rescinded if the parties
24
to the contract fail to execute it within sixty (60) days of the
25
passage of this resolution.

Section 56653 of the Government Code requires the submission of a Plan for Services with every proposal
initiated by a resolution of a legislative body. The Commission has adopted standards for the prepara-
