Development Agreement No. 91-02 .
07-19-93 - Resolution No. 5372 adopted awarding a contract to Bear
Valley Paving for low bid price of $552 , 832 .
Recommended motion:
That the expenditure of $20 , 000 from Account No. 126-000-3405 ,
"Undesianated Reserve, " to finance one-half of the cost for
installation of sidewalk on Highland Avenue (north side) , f_rnm
Piedmont Drive to Boulder Avenue, be approved.

STAFF REPORT
Development Agreement No. 91-02 provided that the City
would install the necessary street improvements along the north
side of Highland Avenue, adjacent to the Wal-Mart Complex.
An amount of $800 , 000 was allocated from Tax Allocation
Bond Proceeds to finance the cost of these street improvements .
A contract was awarded to Bear Valley Paving to install the
improvements pursuant to terms of the Development Agreement.
An agreement was subsequently reached with the Wal-Mart
Developer for the City to bear one-half of the cost for under-
grounding existing utilities along Highland Avenue. Construction
of sidewalk was deleted from the contract with Bear Valley
Paving , since the underground utility facilities were to be
installed within the Highland Avenue parkway and would be in
conflict with the newly installed sidewalk.
Installation of the underground utility facilities has
been completed, and the sidewalk can now be installed.
The original allocation of $800 , 000 has been expended.
It is proposed that the $40 , 000 estimated cost for installation
of the sidewalk be borne equally by the EDA and City.
Therefore, we recommend that the expenditure of $20 , 000
from the "Undesignated Balance" of the Gas Tax Fund, to finance
one-half of the cost for installing this sidewalk on Highland
Avenue, be approved.
