STAFF REPORT
REQUEST
To amend San Bernardino Municipal Code 8.27.010A to include lots with vacant and/or boarded
up structures that have been declared a public nuisance by the Board of Building Commissioners.
BACKGROUND
Currently the Code Compliance Division takes the following steps to secure and abate open and
vacant structures.
1. Complaint received by staff;
2. Inspection by Code Officer to verify complaint;
3. Immediate action taken if necessary;
4. If immediate action not needed, property owner mailed a notice to clean within
10 days;
5. In cases of non-compliance, case is prepared for presentation at Board of Building
Commissioners meeting to incur costs and adopt a recommendation to obtain an
inspection warrant to abate as needed.
Regrowth of weeds is handled on a complaint basis, and in order to take a more pro-active
approach to eradicating blight, staff recommends that these locations be surveyed on a quarterly
basis by the Public Services Department's Weed Abatement Coordinator, who will take the lead
in follow-up abatement through authorization of the amended Municipal Code 8.27.010 and
obtain inspection warrants to abate as needed.
RECOMMENDATION
That Mayor and Common Council amend Municipal Code 8.27.010 "Public nuisance defined -
Removal deemed necessary" as follows, with changes in bold italics:
A. The existence of weeds, dry vegetation of any type, dead or diseased trees, dead
or dry palm fronds, fences in disrepair or broken, rubbish, refuse, and dirt upon
streets, road sides, sidewalks, parkways between sidewalks and curbs, along
fences, vacant lots, easements, lots with vacant and/or boarded up structures that
have been declared a public nuisance by the Board of Building Commissioners,
and the periodic removal thereof is necessary to protect the health and safety of
the inhabitants of the City.
