Both Councilman Oberhelman and Councilman Devlin have requested
that a resolution supporting the Local Control and Fiscal
Responsibility Act be placed on the Council agenda. Mayor Minor
has also expressed support for this initiative.
In 1992-93 and 1993-94, the state transferred approximately $3. 5
billion in property tax revenue from cities, counties, and special
districts to the Educational Revenue Augmentation Fund (ERAF) .
These shifted funds were used to raise the level funding for local
schools and community colleges. However, the loss of these funds
has had a devastating impact on all local governments, including
the City of San Bernardino.
The Local Control and Fiscal Responsibility Act seeks to restore
some of the funds lost by local governments. According to the
Attorney General, the Act would continue tax rates of 10% and 11%
on residents with taxable income over $100, 000 and $200, 000,
respectively; and residents who are heads of households with
taxable income over $136, 115 and $272, 230, respectively.
Of these additional funds raised, up to 60% would be allocated to
schools. The remainder would be apportioned to counties, who would
in turn allocate these funds to cities in proportion to each city's
ERAF transfer. In addition, the initiative would prohibit any
future reduction of each local jurisdiction's share of property tax
revenue.
According to the San Bernardino Public Employee's Association, the
City could expect to receive up to $455, 600 in additional revenue
if the Local Control and Fiscal Responsibility Act is passed.
Currently, supporters are gathering signatures to place the
initiative on the November ballot.
It is recommended that:
1) The Mayor and Council approve the attached resolution
supporting the Local Control and Fiscal Responsibility Act,
and that said resolution be presented to the San Bernardino
Public Employee's Association (SBPEA) .
RESOLUTION OF THE MAYOR & COMMON COUNCIL
IN SUPPORT OF
LOCAL CONTROL AND FISCAL RESPONSIBILITY ACT
WHEREAS, the citizens of the City of San Bernardino have the right to expect their property
taxes to be controlled locally and spent for local services they need; and
WHEREAS, the citizens of the City of San Bernardino have seen that right eroded by the
property tax shift from local government to state government over the last several years; and
WHEREAS, the loss of local property tax revenue has severely hampered the ability of the City
of San Bernardino to provide public safety, recreation, library, emergency and other services to meet the
needs of its citizens; and
WHEREAS, the Local Control and Fiscal Responsibility Act will reform the income tax law to
prevent an unnecessary windfall to a small minority of taxpayers and restore a major portion of property
tax losses experienced in the past; and
WHEREAS, the Local Control and Fiscal Responsibility Act will provide an estimated $450,000
in additional revenue to assist the City of San Bernardino in its efforts to provide necessary services to
its citizens; and
WHEREAS, the Local Control and Fiscal Responsibility Act will restore local control and
responsibility to local elected officials and will improve the economic conditions in the City of San
Bernardino through the establishment and maintenance of desirable public services.
NOW, THEREFORE, be it resolved that the City of San Bernardino hereby endorses and
supports qualifications and passage of the "Local Control and Fiscal Responsibility Act."

Dear Ms. Clark:
For the last several years, the City of San Bernardino, like most other local public agencies, has
been victimized by the state's annual budget deliberations. Increasing demands for services
coupled with diminishing revenue sources have made your work, and the work of your
employees, more difficult than ever. As you know, property tax shifts in 1992-93 and 1993-94
cost local government $3.6 billion in local revenue and represent an ongoing loss of$1.2 billion
every year. Local government, the service providers closest to the taxpayers, should not have to
provide the funds for state government priorities.
We now have a chance to do something about it. The San Bernardino Public Employees
Association, in conjunction with the California Tax Reform Association, is sponsoring a ballot
initiative called the "Local Control and Fiscal Responsibility Act", which is designed to recover
a significant portion of the property tax loss in the City of San Bernardino. Estimates from the
Legislative Analyst indicate that the City of San Bernardino could realize a net increase in
General Fund revenue of $455,600 if the Local Control and Fiscal Responsibility Act were
enacted in November.
However, the time to aet this measure qualified is fast running out. The purpose of this letter is
to request time before your City Council to seek support for this proposal and help advertise the
efforts to qualify the measure. Please review the enclosed information and contact me as soon as
possible if you can agendize this matter, or if you have any questions.

provisions:
It provides relief for the fiscal distress faced bylcities and counties, in
proportion to the revenue lost when the state took away property taxes from
local government in order to balance its own budget,
It cancels the tax break which the richest 1.2%:o
f taxpayers' are due to
receive in 1996, in order to pay for local relief.
The result: approximately $800 million more per year will be available t4 l:und
police, fire, parks, 'libraries, child protection and other vital services,
Background: In 1992-93 and 1993-94, the state balanced its budget by taking away
$3.6 billion in property taxes revenues from cities, counties, and special districts. While
some of the loss was offset by a sales tax increase (Prop 172), the on-going loss to
local government is over $2 billion every year.
Instead of reversing this tax rip-off, the state then permitted the top brackets on the
wealthiest taxpayers, passed in 1991, to expire after five years. The top 1.2% of
taxpayers, earning over $225,000 (joint return), will receive about $800 million in yearly
tax reductions while ordinary taxpayers see increases to pay for local services.
The Local Control and Fiscal Responsibility Act would reverse these actions:
For LOCAL CONTROL: Reverses the local property tax take-away in proportion to the
amount lost by each local jurisdiction - the amount of property tax lost minus the
amount of revenues from Prop 172 (if any).
For FISCAL RESPONSIBILITY: Cancels the tax reduction for the wealthy and applies
$800 million in revenue to local fiscal relief, insuring that local relief does not come at
the expense of any other programs.

Week is enclosed. A similar resolution will be brought before the Board of Supervisors on April 2, 1996
for adoption by the County.
Please forward this sample resolution to your City Clerk for preparation of a City Council resolution or
proclamation. Also, we ask that you notify us of the date of your Council meeting to adopt your City's
resolution or proclamation so that we can answer questions from the public or the press. Please send us

proclamations to our Congressional Representatives.
