(#3205) Current Business Registration Certificate: Not Applicable Financial Impact: None Motion: Adopt the Resolution. Synopsis of Previous Council Action: 11/05/2012 : Resolution No. 2012-260 was adopted, approving an agreement with CALMAT for pipeline construction along a portion of Cajon Blvd., fee credit and reimbursement. Background: CALMAT Co. (CALMAT) recently completed construction of a City Master Storm Drain along a portion of Cajon Blvd. In support of storm drain development in that area. The City needs to obtain the easements to allow for future maintenance of the storm drain. To allow the construction of a portion of the line across San Bernardino County Flood Control District (SBCFCD) property, which is adjacent to property owned by CALMAT, the SBCFCD granted CALMAT two easement areas, with the understanding that the easements would be Quitclaimed to the City upon completion of the line. The line has been completed and the City can accept the improvements subject to the conveyance of CALMAT'S easements to the City. The attached resolution authorizes and directs the City Clerk to accept the Quitclaim Deed on behalf of the City, a copy of which is attached as Attachment "1" which will need to be filed with the San Bernardino County Recorder's office. The easements granted to CALMAT by the SBCFCD are subject to certain conditions. The City's acceptance of the easements by Quitclaim Deed is subject to the same conditions. A copy of CALMAT's easements, and conditions therein are attached to the Quitclaim Deed as Exhibit"I" and Exhibit "2". It is subject to the Grantor's paramount right to use the Property, and the Grantor reserves to itself and its successors and assigns a continuing right to use and make improvements to the Property; provided however, that Grantor's improvements do not interfere with Grantee's use. 2. Grantee shall submit in advance, all plans for installation, construction or L reconstruction of Grantee's facilities to Grantor for review and approval, and o Grantee shall obtain a permit from the Grantor prior to the commencement of any o such improvements. 3. Grantee shall at all times, and at its sole cost and expense, maintain the _ Property and all improvements constructed by Grantee thereon by Grantee in good condition and repair. Grantee shall be responsible for any damage caused by r its use of the Property, as well as the use of the Property by Grantee's Q respective employees, agents, contractors and invitees, and Grantee shall promptly repair all such damage at its expense. In the event that it will be necessary for Grantee's facilities to be relocated or protected as a consequence of the Grantor's use of the Property, Grantee shall bear all _ related costs. L 9.
