Synopsis of Previous Commission/Council/Committee Action(s):
February 3, 1997,the Commission approved the acquisition of 19 HUD properties in the Arden-Guthrie area.
April 7, 1997, the Commission approved the acquisition of two additional HUD properties, for a total of 21
structures.
Recommended Motion(s):
(Mayor and Common Council)
That the Mayor and Common Council approve a waiver in the amount of$26,120 for tax assessment liens on
the 21 HUD properties to be acquired by the Agency;and authorize the Code Enforcement Staff to administer
and submit the necessary documents for these releases.

STAFF REPORT
Arden-Guthrie - Four-plex Acqusition/Rehabilitation
Previously, the Commission approved the acquisition of twenty 4-plex buildings and one severely
damaged structure in the Arden-Guthrie area owned by the U.S. Department of Housing and Urban
Development (HUD).
Said properties have code enforcement liens in the amount of $26,120. After tabulating all the
various outstanding liens, the escrow company submitted a financial demand to HUD. In turn, HUD
has determined that they will not pay the City liens and are exercising a tax exempt status in this
regard. They are, however, proceeding with payment of all other back taxes and monetary
delinquencies.
The current code enforcement process does not provide any administrative mechanism for release of
city assessment liens. It has been determined that the only venue for release of these liens is to obtain
an approved waiver by the Mayor and Common Council. Upon approval, staff will proceed with
obtaining title to these HUD properties.
Staff recommends adoption of the form motion.
