STAFF REPORT
Council Meeting Date: October 6, 1997
TO: Mayor and Common Council
FROM: City Attorney's Office
DATE: September 25, 1997
AGENDA: October 6, 1997
At the Mayor and Common Council meeting of September 2, 1997,the City Attorney's office
was directed to prepare an agreement in conjunction with the San Bernardino County Jobs and
Employment Services Department, Gain Division, for the funding of school crossing guards. That
was accomplished and the matter appeared on the Council Agenda as Item#S-1.
At the Mayor and Common Council meeting of September 15, 1997,the Mayor directed the
City Administrator to begin immediately to contact the City's former crossing guards for
re-employment, the initial funding to be taken out of salary savings in the Police Department with
possible backfill from South Coast Air Quality Management District funds. Additionally, in the
form of a motion following the Mayor's directive, the legal office of the City was asked to work with
Gain for the purpose of some kind of interaction between the City and the County Gain Program for
next year's budget relative to school crossing guards. Pursuant to that directive, the subject
Memorandum of Understanding is presented for action by the Mayor and Common Council with the
following observations:
California Welfare & Institutions Code Section 11324.6 states in relevant part as follows:
§11324.6. Employment or training program positions; impact
Any employment or training program position created pursuant to this article, other than a
reemployment preparation position, may not be created as a result of, or may not result in,
any of the following:
(d) The filling of a position created by termination, layoff, or reduction in *** work force,
caused by the employer's intent to fill the position with a subsidized position pursuant to this
article.
Earlier this year, the City took action to terminate the individuals who had previously been
employed as school crossing guards. At that time, the City had no knowledge of the potential of the
HTC/ea[CrGd.SRPI 1
County Gain Program being available to serve this purpose. However, at the present time that lack
of knowledge is no longer in existence. As such, the City could not legally terminate the school
crossing guards next June for budgetary reasons and replace them with County Gain applicants
because it would violate Welfare& Institutions Code Section 11324.6(d) due to the knowledge of
the City equating with the employer's intent to fill the positions with County Gain applicants.
As such, it appears that the only way County Gain applicants can be utilized in the school
crossing guard program is to initially create a substitute pool of qualified County Gain applicants
who would be available should the regular school crossing guards be sick or absent from their
assigned tasks. Further, should any of the regular school crossing guards retire or leave their
position permanently, a replacement could be obtained from this qualified pool of County Gain
applicants who have been working as substitute school crossing guards. To that end, Section 309
of the Memorandum of Understanding was written in conjunction with County input.
There are some downsides to the substitute school crossing guard program, namely, an up-
front investment by the City of time and personnel in doing background checks, finger printing and
training for individuals who will not be called upon on a regular basis and who have as their main
task the challenge of finding regular permanent jobs. In other words, there could be considerable
turnover in the pool of County Gain applicants which constitute the substitute crossing guards, which
would require the up-front costs to be incurred on every replacement occasion. It is contemplated
that the number of substitutes in the pool would be determined by the Police Department.
Given the law in this area, it appears that a substitute school crossing guard program is the
only mechanism by which qualified County Gain applicants could be brought in as school crossing
guards. This is not something which could be initiated next June when school is out because there
is a time factor required to create a qualified pool of County Gain applicants. As such, the
Memorandum of Understanding and the related Resolution are before the Mayor and Common
Council so it may be determined whether or not, upon review, given all the facts and information
now known, the County Gain Program is a viable option for use in the school crossing guard
program.
