STAFF REPORT
SUBJECT
Resolution of the City of San Bernardino authorizing the Purchasing Manager to execute a Services
Agreement and issue a Purchase Order to Law Enforcement Medical Services, Inc. for the collection of
forensic evidence for the City of San Bernardino Police Department in accordance with Bid Specification
#F-01-46.
BACKGROUND
Commencing with Resolution #90-441, adopted on 11-5-90, the Police Department began contracting
with private vendors for the collection of forensic evidence from suspects. Resolution#92-29, adopted on
2-6-92, expanded this service to include the collection of forensic evidence from rape victims. The
Department currently uses Loma Linda University Medical Center for these services as authorized by
Resolution#96-141, adopted on 5/23/96. The Services Agreement will expire at midnight on 12/31/00.
These services are vital to avoid further traumatization of rape victims, ensure the collection of evidence,
enhance the prosecution of suspects, and reduce the "down time" for field police officers.
NOTICE INVITING BIDS
The Police and Purchasing Departments developed updated bid specifications for medical evidence
collection services detailed under Bid Specification #F-01-46. Bid packages were sent to fourteen (14)
vendors and the San Bernardino area Chamber of Commerce as well as being advertised in the San
Bernardino County Sun Newspaper and on the City's web page.
The current vendor declined to bid due to staffing constraints and a commitment to maintain high levels
of service. The sole respondent was Law Enforcement Medical Services, Inc. of Fontana, California. A
review of their bid revealed that they meet all of the minimum specifications contained in the bid
specifications. I therefore recommend ratification of the attached Services Agreement between the City of
San Bernardino and Law Enforcement Medical Services, Inc. for the collection of forensic evidence for
the City of San Bernardino Police Department. Upon approval, the Police Department will be obligated to
pay the following amounts for the indicated services:
$ 25 per blood draw ($7 increase)
$ 10 per dry run-blood draw($S decrease)
$400 per victim sexual exam ($100 increase)
$ 50 per dry run—victim sexual exam ($SO increase)
$ 80 per suspect sexual assault exam (no change)
$ 25 per DNA collection kit (new service)
At these rates and historical usage, the Police Department estimates an expense of $29,285 for the
remainder of FY 00/01. The annual expense is estimated at $58,570.

FINANCIAL IMPACT
The police department's FY 00/01 adopted budget includes $50,000 for the collection of forensic
evidence in Account #001-220-5505 (Professional/Contractual Services). By 12/31/00, we project
expending $18,000 to the current vendor, Loma Linda University Medical Center, for these services,
leaving sufficient remaining budget dollars to cover the increase for the second half of the fiscal year.

6 SECTION 1: That Law Enforcement Medical Services (LEMS) of Fontana, California

8 is the lowest and best responsible bidder for the collection of forensic evidence for the City of
9 San Bernardino in accordance with bid specification#F-01-46.

11 SECTION 2: Pursuant to this determination, the Purchasing Manager is hereby
12 authorized and directed to execute a Services Agreement with LEMS and issue a Purchase
13 order in the amount not to exceed $29,285 for the remainder of FY 2000/01, and an estimated
14 annual amount of$58,570. There may be three one-year extensions (option year renewals), at
15
16 the discretion of the San Bernardino Police Department.

18 SECTION 3: The authorization to execute the above referenced Services Agreement is
19 rescinded if it is not issued within sixty (60) days of the passage of this resolution.

THIS AGREEMENT is entered into this 1st day of January, 2006, between

SAN BERNARDINO ("CITY)".
WI'TNESSETH:
A. WHEREAS, CITY has need for Medical Evidence Collection Services - SART
Exams and,
B. WHEREAS, CONTRACTOR is competent, experienced and able to perform
said services: and,
C. WHEREAS, CONTRACTOR has provided the most advantageous and best
responsible proposal for the providing of such services;
NOW THEREFORE, the parties hereto agree as follows:
1. CONTRACTOR shall furnish Medical Evidence Collection Services - SART Exams in
accordance with Proposal Specification F-01-46.
2. Over the term of this Agreement, CONTRACTOR shall be paid for such services an amount
in accordance with Proposal Specification F-01-46 and Offeror's Proposal and Statement.
3. CONTRACTOR shall provide San Bernardino Police Department with a monthly invoice in
arrears and shall be provided payment within thirty (30) days therefrom. CITY retains the
right to challenge all or any part of an invoice.
4. The initial term of this Agreement shall be one (1) year from the date first shown above and
is subject to termination by either party upon thirty (30) days written notice to the other.
Upon Mayor and City Council approval of the initial Agreement, there may be three one-year
extensions(option year renewals), at the discretion of the San Bernardino Police Department.
No partial termination of terms and conditions will be allowed.
5. CONTRACTOR shall indemnify, defend and hold CITY, its officers, employees and agents
harmless from any claim, demand, liability, suit, judgment or expense (including, without
limitation, reasonable costs of defense) arising out of or related to CONTRACTOR's
performance of this agreement, except that such duty to indemnify, defend and hold harmless
shall not apply where injury to person or property is caused by CITY's willful misconduct or
sole negligence. The costs, salary and expenses of the City Attorney and members of his
office in enforcing this Agreement on behalf of the City shall be considered as "attorney's
fees" for the purposes of this paragraph.
6. While not restricting 'or limiting the foregoing, during the term of this Agreement,
CONTRACTOR shall maintain in effect policies of comprehensive public, general, and
automobile liability insurance, in the amount of $1,000,000 combined single limit, and
statutory worker's compensation coverage, and shall file copies of said policies with the
CITY's Risk Manager prior to undertaking any work under this Agreement. The policies
shall name the CITY as an additional insured and shall provide for ten (10) day notification
to the CITY if said policies are terminated or materially altered.
7. CONTRACTOR shall perform work tasks as directed by San Bernardino Police Department,
but for all intents and purposes, CONTRACTOR shall be an independent contractor and not
an agent or employee of the CITY.
8. In the performance of this Agreement and in the hiring and recruitment of employees,
CONTRACTOR shall not discriminate on the basis of race, creed, color, religion, sex,
physical handicap, ethnic background or country of origin.
9. Any notice to be given pursuant to this Agreement shall be deposited with the United States
Postal Service, postage prepaid and addressed as follows:
