Synopsis of Previous Council Action:
June 21, 1999 -- the Mayor and Common Council approved a resolution implementing a
Memorandum of Understanding (MOU) between the City of San Bernardino and
employees in the Fire Safety Employees' bargaining unit represented by the San
Bernardino City Professional Firefighters Association.

SUBJECT
A resolution of the City of San Bernardino approving a side letter to a Memorandum of Understanding
(MOU) between the City of San Bernardino and emploN ^ the fire safety employees' bargaining
unit represented by the San Bernardino City Profession, 'gBCPF).
BACKGROUND

The adoption of this resolution will approve the attac amends the Memorandum
of Understanding between the City of San Berna Bernardino City Professional
Firefighters.
The Mayor and Common Council previously appr .ion of the 3% @ 55 retirement
benefit, effective 7/1/01 as a means of attracting ana fire personnel. In exchange for
this benefit the SBCPF agreed to defer from implementing the .,. 50 retirement benefit until 7/1/05
and agreed to extend the term of the current MOU to 12/31/03. A PERS contract amendment
implementing the 3% @ 55 benefit will be presented to the Mayor and Common Council in the near
future.
Additionally the City and SBCPF had previously negotiated the adoption of the PERS EPMC program
that allowed the City to convert the 9% City paid member contributions to earnings and to report this
as compensation earnable under the PERS guidelines. The language for these provisions was
forwarded to PERS for approval. Upon examination by PERS it was requested that that the City
make some revisions to the language. The City requested and was granted an extension to correct
the language when the MOU's were reopened. The negotiations for the 3% @ 55 benefit provided
the opportunity to revise the language and the Mayor and Council previously approved this correction.
The side letter formally adopts the aforementioned changes and incorporates them into the MOU.
FINANCIAL IMPACT
Estimated first year dollar costs for 3% @ 55 retirement benefit for all safety employees was
$1,716,660 at the time that PERS initially cost the benefit. The actual cost for FY 2001 — 02 and
future recurring cost will be will determine upon completion of a valuation by PERS.
RECOMMENDATION
Adopt Resolution.

7 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
8 OF SAN BERNARDINO AS FOLLOWS:
9 SECTION 1: The Mayor and Director of Human Resources are hereby
10 authorized and directed to execute on behalf of said City a Side Letter to Resolution No.
11 99-154, amending Article III, Compensation, Section 6, Retirement Plan and Article VII,

13 General Provisions, Section 4, Term of Memorandum of Understanding, a copy of which
14 amendments are attached hereto and incorporated herein marked Exhibit A.

SIDE LETTER TO RESOLUTION NO. 99-154
FOR FIRE SAFETY EMPLOYEES
This exhibit sets forth the Side Letter to Resolution No. 99-154 for full-time regular, active Fire
Safety employees.
Article III, Compensation, Section 6-- Retirement Plan
A. The City shall continue to participate in an employees' retirement plan for Public Safety
Officers, by contract with the California Public Employees' Retirement System (PERS)
under the current "2% at age 50" formula. Effective July 1, 2001, the City will
implement the "3% at 55" formula. The Union agrees that it will defer any
implementation of the 3% @ 50 benefit until July 1, 2005. Agreement of discussion
of implementation does not imply that such benefit has been agreed to or awarded.
Implementation is subject to future negotiations of such benefit and approval of
such benefit by the Mayor and Common Council. This agreement does not bar the
Union from negotiating for this benefit in 2003.
H. The City shall adopt a resolution with an implementation date of January 1, 2000,
for paying and reporting the value of the Employer Paid Member Contribution
(EPMC) under the guidelines of Government Code Section 20636(c)(4) pursuant to
Section 20691. The City will report the 9% Employee Contribution as Special
Compensation under the current PERS laws.
For purposes of determining overtime compensation and other salary payments, including
but not limited to, payoffs of sick leave, vacation accruals, holiday accruals and comp
time balances, the aforementioned nine percent (9%) salary increase shall not be
considered.
Article VII, General Provisions Section 2 --Term
With the exception of specific time frames and effective dates for individual Articles, this MOU
shall be effective from January 1, 1999 to December 31,2003.
