8/21/00 City Engineer was authorized to proceed with the design of a raised median at

Staff Report
Subject:
Resolution awarding contract to Avila Construction, Inc. for the construction of a raised
median, handicap ramps, and striping at 21" Street and San Gabriel Street.
Background:
On July 24, 2000, the Mayor and Common Council reviewed the complaint regarding
pedestrian safety at the intersection of 21" Street and San Gabriel Street. This complaint was
referred to the Traffic Safety Committee for evaluation and recommendation.
On August 21, 2000, the Mayor and Common Council approved the recommendation from the
Traffic Safety Committee and authorized the City Engineer to proceed with the design of a
raised median, handicap ramps, and striping at this location.
Plans and specifications for this project are complete and it is ready to be awarded.
The estimated project costs are as follows:
Construction Estimate $25,525.00
Contingencies $5,000.00
Design, Inspection and Contract Administration $3,975.00
Total $34,500.00
This project was advertised locally; the following companies responded (low bidder is in bold
type):

Financial Impact:
Although this specific project was not identified in the current Capital Improvement Plan
(CIP), adequate funding is available in Account No. 129-367-5504-7156 (Street/Safety
Improvements), and the Mayor and Common Council prioritized this project as such and at the
August 21, 2000 Council meeting directed the City Engineer to proceed with the design.
The purpose of this particular CIP account is to provide funding to address unforeseen safety-
related issues that may arise during the course of the fiscal year.
Recommendation:
That the Mayor and Common Council adopt the Resolution awarding a contract to Avila
Construction, Inc. for the construction of a raised median, handicap ramps, and striping at 21'
Street and San Gabriel Street.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AWARDING A CONTRACT TO AVILA CONSTRUCTION, INC. FOR
3 THE CONSTRUCTION OF A RAISED MEDIAN, HANDICAP RAMPS, AND
4 STRIPING AT 21sr STREET AND SAN GABRIEL STREET.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
6 SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. Avila Construction, Inc. is the lowest responsible bidder for construction
8 of a raised median, handicap ramps, and striping at 2151 Street and San Gabriel Street. A
9 contract is awarded accordingly to said bidder in a total amount of $25,525.00 with the
10
11 contingency amount of $5,000.00, but such award shall be effective only upon being fully
12 executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is hereby
13 authorized and directed to execute said contract on behalf of the City; a copy of the contract is
14 on file in the office of the City Clerk and incorporated herein by reference as fully as though
15 set forth at length.

17 SECTION 2. This contract and any amendment or modifications thereto shall not take
18 effect or become operative until fully signed and executed by the parties and no party shall be
19 obligated hereunder until the time of such full execution. No oral agreements, amendments,
20 modifications or waivers are intended or authorized and shall not be implied from any act or
21 course of conduct of an party.

23 SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
24 Within sixty (60) days of the passage of the resolution.

4. City hereby promises and agrees with the said Contractor to employ, and does
hereby employ the said Contractor to provide the materials and to do the work according to the
terms and conditions herein contained and referred to, for the prices aforesaid, and hereby
contracts to pay the same at the time, in the manner, and upon the conditions above set forth;
and the same parties for themselves, their heirs, executors, administrators, and assigns, do
hereby agree to the full performance of the covenants herein contained.
5. It is further expressly agreed by and between the parties hereto that should there
be any conflict between the terms of this instrument and the bid of said Contractor, then this
instrument shall control and nothing herein shall be considered as an acceptance of said terms of
said bid conflicting herewith.
IN WITNESS WHEREOF, the parties of these present have hereunto set their
