Clark, CIVIC Subject: Resolution amending Resolution 98-333 Dept: City Clerk reflecting changes to the City's Conflict of Interest Date: December 4, 2000 Code Council Meeting: 12/18/00 Synopsis of Previous Council Action: 3/1/82 Mayor and Council adopted Resolution No. 82-99 that amended the Conflict of Interest Code to incorporate the Fair Political Practices Commission's Standard Model Conflict of Interest Code for the City of San Bernardino. The resolution has subsequently been amended by Resolution Nos. 82- 402, 83-462, 84-17, 84-428, 85-97, 86-105, 88-420, 89-16, 91-12, 92-466, 94-31, 94-362, 96-381, 97-23, and 98-333 to change filing requirements of various positions and commissions in the City. Clark, CMC, City Clerk DATE: December 4, 2000 SUBJECT: Request for Council Action - Meeting of December 18, 2000 - Resolution of the City of San Bernardino amending Resolution No. 98- 333 entitled in part, "Resolution . . . amending Conflict of Interst Code . by amending Appendix A to add, delete, and change the titles of various positions within departments of the City which must file Conflict of Interest Statements. BACKGROUND INFORMATION: The Political Reform Act requires every local government agency to review its Conflict of Interest Code biennially to determine if it is accurate and up-to-date; or alternatively, whether the code must be amended. Once the determination has been made, a notice must be submitted to the code reviewing body no later than October 1 of even numbered years. Written notice was sent to the Mayor and Common Council that our current City Code would need to be amended. Subsequently, the City Clerk's Office notified the Mayor, the Economic Development Agency, and each department/division of the need to amend our list of designated employees. Department heads submitted their proposed changes reflecting titles changes and positions that have been deleted or need to be added. My staff and I have reviewed the proposed changes and have worked with Senior Assistant City Attorney Huston Carlyle to prepare the necessary amendments as reflected in Appendix A of the attached resolution. The attached resolution amending Resolution No. 98-333 reflects changes to the City's Conflict of Interest Code relating to the requirement for filing of Statement of Economic Interests forms. We have placed a similar item on the Community Development Commission agenda for approval of the amendments to the Economic Development Agency's Conflict of Interest Code. It is recommended that the Mayor and members of the City Council adopt the form motion. (R2ach QeG. Such written determination shall include a description of the consultant's duties and, based upon that description, a statement of the extent of disclosure requirements. Disclosure Category 2: Investments, Income/Loans, Real Property and (Schedule A-2) Assets of Business Entities/Trusts (ownership interest is 10 percent or greater). Disclosure Category 3: Interests in real property located within the (Schedule B) jurisdiction of the City of San Bernardino in which you, your spouse, or your dependent children had a direct, indirect, or beneficial interest aggregating $1000 or more during the reporting period; rental income and loans. Disclosure Category 4: Gross income and your community property (Schedule C) interest in your spouse's gross income aggregating $250 or more received from any source located in or doing business within the jurisdiction of the City of San Bernardino; and, job title or business position you held with a business entity (director, officer, partner, trustee, employee, or any management position) during the reporting period. Disclosure Category 5: Loans received or outstanding during the (Schedule D) reporting period which aggregate $250 or more from a single source located in or doing business within the jurisdiction of the City of San Bernardino.
