HE INFORMED ME THAT I NEED INFORM YOU OF THE PROBLEMS I AM HAVING WITH THE PUBLIC ACCESS PART OF THE CITY RUN COMMUNITY ACCESS CHANNEL . SOME OF PROBLEMS ARE LISTED BELOW ; ( 1 ) ABOUT 8 MONTHS AGO THE PUBLIC ACCESS EQUIPMENT WAS DESTROYED AND THE PUBLIC WAS LEFT OUT IN COLD . THE PUBLIC WAS REFUSED ANY HELP IN THE INTERIM . ( 2 ) WHY IS THE PUBLIC TREATED LIKE LEPERS WHILE THE CITY GOES ON DOING ITS COMMUNITY ACCESS SHOWS . ( 3 ) THE CABLE COMPANIES SAY THEY PAY THE CITY TO RUN PUBLIC ACCESS THROUGH THE FRANCISE FEES . IF SO HOW MUCH OF THAT MONEY IS ACTUALLY SPENT ON PUBLIC ACCESS . ( 4) IF P . E . G . ( PUBLIC , EDUCATION , GOVERNMENT) IS SUPPOSE TO BE DIVIDED EQUAL HOW COME PUBLIC ACCESS GET ONE HOUR A WEEK . EVEN AT THAT THE PUBLIC CANNOT PRODUCE SHOWS BECAUSE THE CITY DESTROYED THE EDITING EQUIPMENT . ( 5) THE PUBLIC HAS BEEN DENIED IT ' S FIRST AMENDMENT RIGHT'S FOR THE LAST H MONTHS AND THESE ACTION MUST STOP . I AM ASKING THE COUNCIL TO PUT THIS MATTER ON THE AGENDA SO THAT WE CAN BRING THESE MATTERS TO REST AND THE PUBLIC CAN AGAIN HAVE A SAY IN PUBLIC ACCESS TELEVISION . City Administrator t I I am in receipt of a copy of a letter written by John Stevens , dated January 13 , 1993 addressing some concerns regrading public access . And his subsequent request to have these items addressed as an agenda item at the February 1 , 1993 Council meeting. I can only discuss the events that took place after my employment began with the City, October 6 , 1992 . As soon as I became aware of the fire and damaged equipment that took place at the production center, July 31 , 1992 , I began to look into the problem (Attachment A) . At that time I was under the impression that the damage to the VHS editing system was severe enough that it may have to be salvaged and subsequently replaced. As of November 3 , 1992 we had yet to 'hear from the repair facility concerning an estimate (Attachment B) . On November 17 , 1992 we were informed that repair to the damaged VHS editing system would be approximately $800 (Attachment C) . Upon notification, I approved immediate repair of said equipment. In a memo to Tim McCollough, December 2 , 1992 , I found out that repair to the editing system was to be completed around the second week of December 1992 (Attachment D) . Parts that had been ordered to finish the repair were placed on back order extending repair to the end of December. I was informed that the VHS machines had arrived at our facility on or about the last week in December. Tim McCollough was instructed to re-install the VHS editing system. It become operational on Monday, January 4, 1993 . In talking with Mansie Booker , Video Production Coordinator, for the Telecommunications Division I inquired about the number of request to use the recently installed VHS editing system. He informed me that only one individual has used the system since January 4 , 1993 and the writing of this memorandum. Neither Mr. Jeff Wright nor Mr. John Stevens has placed a request at this time. I find it difficult to understand the relationship between the amount of complaints levied against the division for not having had the availability of access editing equipment, ie. , hundreds • of hours of raw programming to edit , and their subsequent non-use of the equipment after it has been made available. I will agree that six months , not eight as stated, to make the necessary repairs to the access editing equipment took along time . But , I feel I had the problem solved within three months once I became aware of such. I do take offense to the term "destroyed" , this indicates irreparable damage and this was not the case. Due to budget constraints , lack of capital budget within the division, it has been impossible to expand the amount of public access equipment available for use. It is the policy of the Division not to allow public access users the 3/4" field equipment . While Mr. Stevens and Mr. Wright would like to have access to this it would be prudent to set the precedent of allowing their use of 3/4" equipment and denying this same use to other public access users . When a settlement is reached between the City and Chambers Cable I am planning to ear-mark an as yet unspecified amount of money to upgrade the quality of and increase the amount of access equipment available for use. Mr. Stevens alleges that "the public is treated like lepers while the City goes on doing its community access shows . " I am not sure of the meaning of the term "lepers" in this statement. I feel that the behavior and professionalism expressed by Mr. Wright and Mr. Stevens in a request and use of City property and treatment of City employees is less than acceptable (Attachments E & F) . The Telecommunications Division has waived policy concerning playback deadline requests on numerous occasions to accommodate Mr. Stevens . (Attachment G) As you may be aware I am in the process of re-writing the P.E.G. policies and procedures from three separate documents down to one document that can be administered equally and fairly across the three channels . Within this revised document I have made adjustments to sections I feel have restricted the amount of access playback time available to public users . It is my hope that earlier policies can be further amended under my direction to facilitate and foster a better relationship and understanding concerning that above mentioned individuals and other access users . The cable franchise fees go into the general fund and any budgeted monies used to operate the CATV side of the Telecommunications Division are approved by the Common Council . Capital equipment budgets are separate from the general operating budget . Staff salaries and supply items , tape, replacement lamps , equipment repair , etc . , support directly or indirectly the activities of public access and the administration of the cable franchise agreements . It would be an impossible task to identify what portion of the total Division budget is dedicated to access . TO: Frank Keller FROM: Tim McCullough DATE: 10/23/92 SUBJ: Public Access equipment replacement. On 10/21/92 I spoke with Tom Cain of Risk Management to get a progress report. Tom informed me that little has been done on the project, and he recommended that I prepare a memo with all available information, including repair costs . To accomplish this, I will be identifing a local authorized repair vendor, and sending the equipment in for a repair estimate. I should have the equipment in the shop by the beginning of next week. Ns you may be aware, I prepared a recommended replacement purchase list for Fred Wilson in late September, I have not heard anything further on this aspect of the replacement. 0 TO: Frank Keller, CATV Manager FROM: Tim McCullough, Telecom. Repair Cost: $50 . 00 CLEANUP According to Mansie Booker, all clean-up has been stopped. The Building Manager stated that the stop order was given by EDA. No Reason was given. EQUIPMENT I am awaiting a repair estimate on the VHS 1/2 recorders , when received, I will generate the final Risk Management report. As of this date, we have identified the following studio items that will require replacement: (4) Brown "Executive" Chairs, used for several productions. Replacement cost estimated at $699 . 00 each. (2) Set pieces used for the "Auntie Mimi Show" . Repair cost: $50 . 00 As we have discussed, two VIIS recorders were also sprayed with a fire extinguisher agent, I have sent these recorders in for repair, (estimate $800 . 00) and I will contact you regarding there final disposition. One other area of concern is related to the cleanup of the damage area. According to Mansie Booker, Video Production Coordinator, all clean-up has been stopped. The building manager stated that the stop order was given by Economic Development Agency. No reason for the stop order was given. I have no information related to the cost of this cleanup. (See Attached. ) In fact, our records show that it was first aired that same day, at 4 : 00 p.m. Additionally, a second request and airing of "Ward Valley" occurred on November 1.7 , 1992 at 9 : 00 p.m. My findings on this issue do not indicate that any problem existed related to this or any other programs submitted by John Stevens. I can further research this matter if provided with specifics. I would like to emphasize, that our staff follows strict guidelines when processing submissions to assure timely and equitable treatment to all public access users.
