1 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO, CALIFORNIA, APPROVING THE SITE IDENTIFICATION AND
2 DESCRIPTION FOR THE MID-VALLEY/FONTANA SANITARY LANDFILL FACILITY
FACILITY IDENTIFICATION # 36-AA-0055
3 WHEREAS, the facility under consideration is an existing, San
4 Bernardino County (SBCo) refuse disposal facility operating under
5 permit since 1978 ; and
6 WHEREAS, the operating Solid Waste Facilities Permit (SWFP) ,
7 originally issued on October 11 , 1978 is currently outdated; and
8 WHEREAS, the SBCo Solid Waste Management Department (SWMD) ,
9 acting as the Lead Agency, with concurrence from the Planning
10 Department as the SBCo Board of Supervisor's designated
11 Environmental Lead Agency, will duly complete a Solid Waste
12 Facilities Permit (SWFP) application; and
13 WHEREAS, said SWFP is only issued for the revision and the
14 updating of the facility's operations, including all current
15 Regulatory Agencies' requirements; and
16 WHEREAS, the SBCo SWMD has also completed the Site
17 Identification and Description of the project for submission to the
18 City of San Bernardino, a copy of which is attached and marked
19 Exhibit "A" ; and
20 WHEREAS, this facility can continue to provide the SBCo SWMD a
21 method of disposing of municipal solid wastes, inert wastes, and
22 non-hazardous solid wastes; and
23 WHEREAS, Public Resources Code S50000 requires that the "Site
24 Identification and Description" of a new or expanded solid waste
25 facility which has not been identified or described in a County
26 Solid Waste Management Plan (COSWMP) must be approved or disapproved

by the County Board of Supervisors, and by a majority of the
1 Cities/Towns within the County having a majority of the incorporated
2 population; and
3 WHEREAS, the Mayor and Common Council of the City of San
4 Bernardino may not disapprove the proposed Site Identification and
5 Description unless it determines, based upon substantial evidence in
6 the record, that there will be one or more significant adverse
7 impacts within the City's boundaries from the proposed project: and
8 WHEREAS, pursuant to the California Environmental Quality Act
9 (CEQA) , a Mitigated Negative Declaration was adopted by the SBCo
10 SWMD/Planning Department(s) and a Notice of Determination was filed
11 with the San Bernardino County Clerk of the Board on June 23 , 1992,
12 also subsequently filed at the Governor's office of Planning &
13 Research on June 26, 1992 ; and
14 WHEREAS, the County Department of Environmental Health
15 Services/Local Enforcement Agency (LEA) Program, pursuant to CEQA,
16 is the Regulatory Responsible Agency for the project entrusted to
17 issue the SWF Permit with concurrence provided from the California
18 Integrated Waste Management Board (CIWMB) ; and
19 WHEREAS, provided that the conditions of the permit are
20 complied with, there is no substantial evidence in the record that
21 there will be one or more significant adverse impacts within the
22 City of San Bernardino boundaries from the proposed project;
23 NOW, THEREFORE, BE IT RESOLVED that the Mayor and Common
24 Council of the City of San Bernardino, in the County of San
25 Bernardino, hereby approves the Site Identification and Description
26 for the Mid-Valley/Fontana Sanitary Landfill Facility.
