In response to that request, Agency staff has been working with representatives of Los Padrinos to coordinate its request in conjunction with identified neighborhood improvement needs. As a result of that effort, the proposal previously approved by the Commission attempts to provide assistance to directly meet community needs. Specifically, the assistance will occur in the following areas: *Graffiti Removal This effort will be directed to eliminate graffiti along major arterials throughout the City of San Bernardino and along travel routes surrounding Agency-sponsored housing developments. The goal of this program is to eliminate the "bad image" that graffiti creates along our major thoroughfares and in conjunction with newly constructed housing projects. The Coalition will work directly with the City of San Bernardino Department of Public Services. *Neighborhood Clean-up Program This effort will be directed to provide comprehensive clean-up activities within selected focus neighborhoods (Arden/Guthrie and State Street focused neighborhoods). The total budget approved for this program is $185,000. This proposal will provide assistance in the previously stated areas for the period of February 1, 1993 through July 31, 1993. Please note that this request represents approximately forty-one percent (41%) of Los Padrinos' total anticipated budget for directly in that time period. On January 20, 1993, the Community Development Commission directed Agency staff to prepare a Professional Services Agreement for Los Padrinos Community Coalition and to re-submit this agenda item for Commission consideration on February 1, 1993. REND RSON, Executive Director Development Dep rtment ------------------------------------------------------------------------------- KJH:DRE:paw:0186c COMMISSION MEETING AGENDA Meeting Date: 02/01/1993 Agenda Item Number: 6- AGREEMENT FOR PROFESSIONAL SERVICES Agreement No. THIS AGREEMENT made and entered into this 1st day of February, 1993, by and between the COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO, on behalf of the REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO, a public agency, ("Agency"), and LOS P.ADRINOS OF SOUTHERN CALIFORNIA, INC., ("Participant"): RECITAL 1. Purpose The purpose of this Agreement is to implement a Graffiti Removal Program and Neighborhood Clean-Up Program for the San Bernardino Economic Development Agency (SBEDA) as follows: Graffiti Removal This effort will be directed to eliminate graffiti along major arterials throughout the City of San Bernardino, and along travel routes surrounding housing developments. The goal of this program is to eliminate the "bad image" that graffiti creates along our major thoroughfares and in conjuction with newly constructed housing projects. Neighborhood Clean-up Program This effort will be directed to provide comprehensive clean-up activities within selected focus neighborhoods (Arden/Guthrie and State Streets focused neighborhoods). TERMS AND CONDITIONS 2. Mission Agency hereby retains Participant in the capacity as Participant for provision of services described in Attachment I. Participant hereby accepts such responsibility as described herein. 3. Terms This Agreement shall commence as of the day and year first above shown and shall remain in full force and effect for a period of February 1, 1993 to _July 31, 1993 unless sooner terminated as provided herein. The Executive Director of Agency or designee is authorized to extend this Agreement for up to thirty (30) days and approve line item adjustments to the Agreement's program budget as long as either of such amendments are upon the same terms and conditions as specified herein. 4. Participant Responsibilities Upon the request of Agency's Executive Director or designee, Participant shall complete the work program described in Attachment I. Participant commits the principal personnel listed below to the project for its duration: Participant: Mr. Max L. Alonso, Executive Director. Three (3) Working Supervisors. Two (2) Regular Supervisors. Eighteen (18) or more Workers (as needed) 5. Replacement of Named Personnel It has been determined that the individual(s) named in this Agreement is (are) necessary for the successful performance of this Agreement. No dramatic diversion or replacement of this (these) individual(s) shall be made by Participant without Agency approval, provided that Agency may ratify, in writing, within ten (10) days of diversion or replacement and such ratification shall constitute the consent of Agency, provided that Agency may ratify, in writing, within ten (10) days of diversion or replacement and such ratification shall constitute the consent of Agency required by this clause. If Agency fails to respond to Participant within ten (10) days of notification by Participant, said personnel diversion or replacement shall be deemed approved. 6. Release of News Information No news release, including photographs, public announcements or confirmation of same, of any part of the subject matter of this Agreement or any phase of any program hereunder shall be made without prior written approval of Agency's Executive Director or designee. 7. Confidentiality of Reports Participant shall keep confidential all reports, information and data received, prepared or assembled pursuant to performance hereunder and that Agency designates as confidential. Such information shall not be made available to any person, firm, corporation or entity without the prior written consent of Agency. 8. Compensation During the term of this Agreement, Agency shall pay Participant, a total amount not to exceed, budget described in Attachment II, the program budget. Said compensation shall be considered full and complete reimbursement for all of Participant's costs associated with the program(s) services provided hereunder. The maximum compensation for services, including all Participant's costs, under the terms of this Agreement, shall not exceed Participant shall be paid in accordance with Agency's standard accounts payable system. Invoices shall be approved by Agency's Executive Director or designee. -2- DRE:ELF:2489B 9. Right to Audit Agency or any of its duly authorized representatives shall have access to any books, documents, papers and records of Participant and/or its subcontractors which are pertinent to the specific programs hereunder for the purpose of implementing the programs. All books, records and supporting detail shall be retained for a period of five (5) years after the expiration of the term of this Agreement, or any extension thereof, or for any longer period of time as required by law. 10. Audit Exceptions Participant agrees that in the event the program established hereunder is subjected to audit exceptions by appropriate audit agencies, it shall be responsible for complying with such exceptions and paying Agency the full amount of liability resulting from such audit exceptions. 11. Agency Support Agency shall provide Participant with maps of major arterials throughout the City, and on a case by case basis, maps of travel routes surrounding new housing developments, and information pertaining to selected focus neighborhoods in order to provide comprehensive clean-up activities, or other data or information pertinent to the services to be provided hereunder which are reasonably available to Agency. 12. Independent Contractor Participant shall perform the services as contained herein as an independent contractor and shall not be considered an employee of Agency or under Agency supervision or control. This Agreement is by and between Participant and Agency, and is not intended, and shall not be construed, to create the relationship of agent, servant, employee, partnership, joint venture, or association, between Agency and Participant. 13. Conflict of Interest Participant agrees for the term of this agreement not to enter into any agreement that will inure to the detriment of the City of San Bernardino or its Economic Development Agency. 14. Successor and Assignment The services as contained herein are to be rendered by Participant whose name is as appears first above written and said Participant shall not assign nor transfer any interest in this Agreement without the prior written consent of Agency. -3- DRE:ELF:2489B 15. Indemnification Participant agrees to indemnify, defend (upon request by Agency) and save harmless Agency, its agents, officers and employees from and against any and all liability, expense, including defense costs and legal fees, and claims for damages of any nature whatsoever, including, but not limited to, bodily injury, death, personal injury or property damage arising from or connected with Participant's operations, or its services hereunder, including any workers' compensation suit, liability or expense, arising from or connected with the services performed by or on behalf of Participant by any person pursuant to this Agreement. 16. Insurance Without limiting Participant's indemnification of Agency, Participant shall provide and maintain at its own expense during the term of this Agreement the following program(s) of insurance covering its operation hereunder. Such insurance shall be provided by insurer(s) satisfactory to Agency and evidence of such programs satisfactory to Agency shall be delivered to the Executive Director of Agency or designee within ten (10) days of the effective date of this Agreement. General Liability: A program including, but not limited to, comprehensive general liability with a combined single limit of not less than $1,000,000 per occurrence. Such insurance shall be primary to and not contributing with any other insurance maintained by Agency, and shall name Agency as an additional insured. Motor Vehicle Insurance: Insurance including, but not limited to, comprehensive general liability with a combined single limit of not less than 1300.000 per occurance. Such insurance shall be primary to and not contributing with any other insurance maintained by Agency. 17. Compliance with Laws The parties agree to be bound by applicable federal, state and local laws, regulations and directives as they pertain to the performance of this Agreement. 18. No Discrimination In the fulfillment of the program established under this Agreement, either as to employment, upgrading, demotion, transfer, recruitment or recruitment advertising, layoff or termination, rates of pay or other terms of compensation, selection for training, including apprenticeship or participation in the program or the receiving of any benefits under the program, Participant agrees not to discriminate nor to allow any subcontractor to discriminate on the basis of race, color, creed, religion, natural origin, ancestry, sex, marital status or physical handicap. -4- DRE:ELF:2489B 19. Severability In the event that any provision herein contained is held to be invalid, void or illegal by any court of competent Jurisdiction, the same shall be deemed severable from the remainder of this Agreement and shall in no way affect, impair or invalidate any other provision contained herein. If any such provision shall be deemed invalid due to its scope or breadth, such provision shall be deemed valid to the extent of the scope or breadth permitted by law. 20. Interpretation No provision of this Agreement is to be interpreted for or against either party because that party or that party's legal representative drafted such provision, but this Agreement is to be construed as if it were drafted by both parties hereto. 21. Entire Agreement This Agreement supersedes any and all other agreements, either oral or in writing, between the parties hereto with respect to the retention of Participant by Agency and contains all the covenants and agreements between the parties with respect to such retention. 22. Waiver No breach of any provision hereof can be waived unless in writing. Waiver of any one breach of any provision shall not be deemed to be a waiver of any other breach of the same or any other provision hereof. 23. Contract Evaluation and Reviev The ongoing assessment and monitoring of this Agreement is the R responsibility of Agency's Executive Director or designee. 24. Termination This Agreement may be terminated by either party by giving written notice at least fourteen (14) days prior to the effective termination date in the written notice. 25. GRAFFITI REMOVAL PROGRAM o Removal along "Major Arterials" Issue : The presence of extensive graffiti along major arterials within San Bernardino is creating a bad " Image" to people traveling both through and within the community. Program: On a pro-active basis to identify potent- ial travel routes utilized to new devel opments , and aggressively remove 'graffiti along these routes .' o Removal in conjunction with new development projects . Issue : As people travel •through San Bernardino to newly constructed development projects , the presence of graffiti creates both a "Bad Image" and impressions that directly re- flects on the quality of the new develop- ment. Program: On a pro-active basis to identify po- tential travel routes utilized 'to new developments , and aggressively remove graf- fiti along these routes. Potential Development Projects : * Arrow Vista * Concordia Homes * Parkside Medical * Mira Monte ( apartments ) * S u n 1 a c B. NEIGHBORHOOD CLEAN-UP PROGRAM Issue : There is a need to provide comprehensive clean-up activities within selected focus neighborhoods on an ongoing basis . Program: On a pro-active basis , this group will provide comprehensive neighborhood clean-up services on a weekly basis including : Trash pick-up/clean-up * Abandoned vehicle removal * Unit clean-up * Unit board-up S 1440mr, 11W These services will be initially provided within the Arden- Gutherie and State Street Focus Neighborhoods. II . ALLOCATION The City has allocated $150 ,000 .00 to this effort, $75 ,000 . 00 to Graffiti Removal and $75 ,000 . 00 to Neighbor- hood Clean-up . III. PERFORMANCE A. Los Padrinos will provide three teams of Gang Youth to cover this two phase project. The details of this effort are as follows : B. Quantifiable objectives ( number of community clean-up and graffiti -projects to be accomplished during the contractual period ) will be established inconjuncti*on with City of San Bernardino official Mr. David R. Edgars , Housing Division Manager, a 21 days evaluation period. During this time period , quantifiable objectives will be established to determine the overall length of pro- gram, and number of activities to be accomplished and development of production time line. C. Establish a "Work Ethic" Gang Workers/Members .through example of "Work Leader" ( former gang members) . Emulate the "Leader ' s" example through the following : o Adhering to work schedule o Follow direction of supervisior o Harmonious working relationship with public and . fel- low workers . o Realization that after work time (negative activi- ties ) reflects on employee and will effect their employment status . D. The Major Focus of this program will provide a "Transition" from "Gang Members" to trainee to attainment of individual positive goals i . e . employment, high school graduation , G. E . D. - Career development . E. In order for the Gang Member to "Transition" to their individual positive goals , The Los Padrinos Community Coalition will provide Inkind Services . Crisis counsel- ing , Veadership training , family/individual counsel ling , parenting skills , Drug/Alcohol detoxifica- tion/education , self-esteem and empowerment classes , and employment preparation for 40 Gang Members. Total value of inkind Services $263,300 for 6 ( six ) months. F. Gang Members performance will be established through 5 individual performance agreements and daily progress and attenandce reports. G. Each team will consist of six workers plus one working team leader. There will be two roving supervisors bringing the man power total in this project to 23 . H. Teams will work 20 hour months , bringing the totalemanehoursrforpthisdpro f six ,sect allowance of $ 150 ,000. 00 at $11 . 54 per hour. I . It is also understood by Los Padrinos that the City of San Bernardino will set all work locations based on need . J. Los Padrinos will supply all man power and insure that they are at the Job sites each day. Los Padrinos will also handle all administrative functions for this labor pool and bill the City on a monthly basis for this and workers payroll . BACKGROUND From the middle 80 ' s to the present , Gang/Drug violence has escalated to a daily activity as noted in a recent enclosed . article , Sun Telegram , November 30 , 1992 01992 Shapes up as Deadliest Year in the Books for San Bernardino:' Citizens of San Bernardino live in constant fear of an unsafe Neighborhood , Community, and City. Faced with this unsafe environment , the City of San Bernardino and the Coalition of 11 organizations ( letters of commitment enclosed ) , Our Lady of Guadalupe Church , Neighborhood Housing Services , Holy Name Society, Public Health, Victory Outreach , City Parks and Recreation Department, Casa De San Bernardino , Inc . , Mary' s Table Mercy House , Somos Hermanas Unidas , Home of Neighborly Service , Gents Organization , and Los Padrinos initiated a Coalition of Gang Intervention and Communit'y- Pride . The City of San Bernardino ' s Economic Development Agency in contract with Los Padrinos Community Coalition (LPCC ) embarked upon an aggressive campaign to take back our streets and elimi- nate the senseless youth/gang violence. Over the past three months , a dramatic documented decrease in gang and youth violence has occurred . During the past five months with regularly scheduled weekly meetings , the Los Padrinos Community Coalition met with the City of San Bernardino' s SMASH Unit (Police Department) . Jointly , the Coalition and the Police Department, worked at intervening and preventing gang violence. tremendous strides of progress with peace and harmony between three rival gangs have been accomplished in the past 90 days. With a total membership of over 500 gang members and peers , the 7th . Street Locos , Westside Verdugo , and Flats Gangs are targeted under the Los Padrinos Community Coalition program. 1W looms, Los Padrinos Community Coalition has dramatically eliminated violent conflicts between the three sponsored gangs . During the last 90 days of the gang eradication. project, one of the spon- sored gang members was killed in a drive-by shooting by a non- sponsored .gang member. Because of the intervention by the=C No RetaTiation Action" was taken by the sponsored ang ( in this rare instance the ugly retaliatory cycle was broken, Due to the limited financial resources , Los Padrinos is unable to expand it ' s service to the remaining non-sponsored Hispanic gangs . IN-DIRECT- BENEFIT (SAVINGS) The ripple effects of savings to taxpayers are astonish- ing . Consider the potential medical and hospital expenses cou- pled with the cost associated with the police department (multi - hours of investigation ) the public defender, prosecutor, ,judge and incarceration ( an annual cost of $45 ,000 per person) . Pre- venting gang members from re-entering the system translates into literally hundreds of thousands of dollars in savings to the taxpayers . With our present system of combating crime ( i . e.. Police department) , the price for a "Safe Community" is stagger- ing . The police department recognizes the need for a comprehen- sive approach to a complex city wide crime problem . We are losing the battle to regain control of our community from vio- lence . DEMONSTRATED COST EFFECTIVENESS The Los Padrinos Community Coalition t ion program is working . The focus is working with the local gang member to instill pride for self, family, neighborhood and community. All fifty-one participants are finding positive identity and worth byhelpingng their neighbors . Through prepping and painting homes in their own community, the project has created self-esteem and personal dignity for the Gang Member. Prior to entering our LPCC Gang Intervention Program, only 16% of the gang participants attended High School and only two graduated . Eighty-nine percent (89X) of these participant ame have been arrested and/or on probation/parole Young adults p p ( / arole sheet enclosed) . These data Young adults are the cream of "troubled life" . Our public systems , schools , law enforcement and institu- tions have not had Positive change or impact on their lives . Through the efforts of our Gang Coalition resources specifically our counseling component has accomplished the following : o Fifty-one gang members were employed and trained. 0 80% of the gang members did not violate their terms of probation. o Re-enrolled over 90% of the eligible youth back into public schools . 0 94% of the participants completed the vocational train ing program and are currently attending group/individual counseling . 0 94% of the gang members gained vocational skills in preparing and painting thirty-one homes. A INKIND SERVICE LPCC attributes our success to the commitment of member agencies from a wide array of valuable resources ( licensed and training professional in their respective field . ) It is estimat- ed that over 5 ,000 hours of inkind service have been provided over the past four months . The following is a current listing of services that will be provided by the Los Padrinos Community Coalition. PARENTING SKILLS: Forty gang members to participate in a total of ours of parenting skills . The Catholic Church specifi- cally , Our Lady of Guadalupe Church , San Bernardino County Mental Health, Los Padrinos and Somos Hermanas provide the curriculum nidas , Inc . will ulum and instruction for the a parenting , Program value equates g ' at es to q $25 ,000 . 00 . - _ COUNSELING ( Family, Individual , Group) Forty gang members to participate in a total of 3 ,800 hours of family , individual and group counseling . The Catholic Church , specifically Our Lady of Guadalupe , San Bernardino County Mental Health, Los Padrinos , Victory Outreach , Casa De San Bernardino and Gents Organization Will provide the expertise ( LCSW) and an average of over 15 years of experience counseling gang oriented youth. Program counseling component value equates to $95 ,000 . LEADERSHIP TRAINING: Ten to twenty gang members to participate in a tots o ours of leadership training . the San Bernar- dino County Mental Health , Our Lady of Guadalupe and Los Padrinos will provide the format and expertise for the leadership training program. Program valued at $7 ,500 . 00 .
