RE: An Ordinance Of The City of San Bernardino Adding
Section 2 . 56 . 105 To The San Bernardino Municipal Code
Relating To The Power Of The City Clerk To Contract
With Civic and Service Organizations To Provide
Individuals To Serve On Precinct Boards In Elections
DATE: January 7 , 1993
Elections Code Section 22805 provides that "The governing body of
the city shall appoint one inspector, one judge and two clerks as
election officers for each precinct for each municipal election,
who shall have charge of the election in and for the regular or
consolidated precinct for which they have been appointed. . . . "
In past years the City Clerk' s Office has generally drawn its
precinct board workers from the County' s pool of workers . This
year we will have 99 polling places and we have successfully
filled each of the posts for all of the precinct boards .
However, experience has shown that invariably some workers drop
out at the last minute and we are faced with having to replace
precinct board workers .
In the 1991 election, we gave city employees an opportunity to
work as poll workers provided they took time off to do so and
provided they had prior approval from their respective department
heads . Approximately 10 city employees served on the boards in
1991 .
This year I would like to propose that the City Clerk' s Office be
permitted to recruit a pool of precinct board workers from the
various service/civic organizations in the City and give them an
opportunity to be properly trained and ready to fill in, if
needed, on precinct boards . Wages due to board workers drawn
from the service/civic organizations would be paid to their
respective organizations . Inspectors are paid $70; Judges and
Clerks receive $50 each.
Attached is an Ordinance which will permit the City Clerk to
contract with civic and service organizations to provide
individuals to serve on precinct boards in elections .

The League of Women Voters and a couple of other organizations I
have spoken with support this ordinance as a way of not only
recruiting a stable pool of precinct board workers , but also as a
way of raising funds for their respective organizations .
I recommend approval of the attached Ordinance.

2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING SECTION
2. 56. 105 TO THE SAN BERNARDINO MUNICIPAL CODE RELATING TO THE
3 POWER OF THE CITY CLERK TO CONTRACT WITH CIVIC AND SERVICE
ORGANIZATIONS TO PROVIDE INDIVIDUALS TO SERVE ON PRECINCT BOARDS
4 IN ELECTIONS.
5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
6 SECTION 1. Section 2. 56.105 is hereby added to the San
7 Bernardino Municipal Code to read as follows:
$ "2. 56. 105 Contracts with Civic and Service

Organizations for Precinct Boards.
10 Prior to any election the City Clerk
11 may contract with any Civic or Service
12 Organization located within the City of San
13 Bernardino to provide necessary Precinct
14 Boards for such election. Such contracts
15 may cover both primary and general
16 elections. The compensation to be paid
17 such precinct workers pursuant to the
18 contract shall be established by the. Mayor
19 and Council from time to time by resolution
20 and may be paid to the precinct workers or
21 directly to the organization as determined
22 in the contract. Any such Precinct Boards
23 provided by Civic or Service organizations
24 shall be subject to the same
� qualifications
25 and training requirements as other Precinct
26 Boards as required by the Elections Code.
27 Any such contract shall require that the

contracting organization not discriminate

in its membership or services on the basis

of race, color, creed, religion, national

origin, sex, or physical handicap. "

I HEREBY CERTIFY that the foregoing ordinance was duly
7
adopted by the Mayor and Common Council of the City of San
8
Bernardino at a meeting thereof, held on the
9
day of 1993, by the following vote, to wit:
