STAFF REPORT
The State-Local Transportation Partnership Program was
approved by the State Legislature to reimburse local agencies for
a portion of the costs they incur for eligible street improvement
projects .
In general , if an agency uses its own funds (no State or
Federal funds) , it may submit an application for cost sharing
with the State. At the time a project is submitted, it is
reviewed to determine if it meets the criteria for the program
and is eligible for participation. The percentage of funds con-
tributed by the State is determined after all submitted projects
are reviewed by Caltrans.
The improvement of Tippecanoe Avenue, from Route I-10 to
Hardt Street, was originally planned as a County project. How-
ever, the area was annexed into the City and the submittal for
the partnership program was carried over. The project was found
eligible for this program.
A program supplement is needed to obligate the funding for
the program and allow the State to contribute funds.
The construction is complete (a condition of obtaining
funds) and we are ready to request reimbursement. Total payment
by the State is estimated to be $87, 506. 00 , which represents a
participation of 30. 02% of the construction costs.
We recommend that the program supplement be approved.

2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF PROGRAM
3 SUPPLEMENT NO. 1 OF STATE-LOCAL TRANSPORTATION PARTNERSHIP
PROGRAM AGREEMENT NO. SLTPP-5033 , BETWEEN SAID CITY AND THE
4 STATE OF CALIFORNIA, ACTING BY AND THROUGH ITS DEPARTMENT OF
TRANSPORTATION, RELATING TO THE IMPROVEMENT OF TIPPECANOE
5 AVENUE, FROM ROUTE I-10 TO HARDT STREET.
6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION ONE: The Mayor of the City of San Bernardino

9 is hereby authorized to execute, in behalf of said City,
10 Program Supplement No. 1 of State-Local Transportation
11 Partnership Program Agreement No. SLTPP-5033 , between said City
12 and the State of California, acting by and through its
13 Department of Transportation, relating to the improvement of
14 Tippecanoe Avenue, from Route I-10 to Hardt Street, a copy of
15 which is attached hereto marked Exhibit "A" and incorporated
herein by reference as fully as though set forth at length
16 herein.

18 SECTION TWO: The agreement shall not take effect until
19 fully signed and executed by all parties. The City shall not be
20 obligated hereunder unless and until the agreement is fully
21 executed and no oral agreement relating thereto shall be
implied or authorized.

SECTION THREE: The authorization to execute the above-
24 referenced agreement is rescinded if the parties to the
25 agreement fail to execute it within sixty (60) days of the
passage of this resolution.

PARTNERSHIP PROGRAM AGREEMENT NO. SLTPP-5033
This Program Supplement is hereby incorporated into the State-Local Trans-
portation Partnership Program Agreement for State Share Funds which was
entered into between the Local Entity and the State on / / and is
subject to all the terms and conditions thereof. This Program Supplement
is adopted in accordance with Paragraph 3 of Article I of the aforemen-
tioned Master Agreement under authority of Resolution No. ,
approved by the Local Entity on (See copy attached) .
The Local Entity further stipulates that as a condition to payment of funds
obligated to this project, it accepts and will comply with any covenants or
remarks setforth on the following pages.

SPECIAL COVENANTS OR REMARKS
1. It is mutually understood between the parties that this
contract may have been written before ascertaining the
availability of legislative appropriation of funds, for
the mutual benefit of both parties, in order to avoid
program and fiscal delays that would occur if the
agreement were executed after that determination was
made.
The total amount of State-Local Transportation
Partnership funds payable by the State shall not exceed
$87506 to be encumbered and reimbursed as follows:
FY 91-92 $ 87506
FY 92-93 0
FY 93-94 0
Any increase in State Partnership funds will require a
revised program supplement.
Any decrease in State Partnership funds will require a
revised finance letter.
2 . The State Funds Share is calculated based on the lower
of the approved eligible application amount or the
eligible award amount.
3 . The Reimbursement Ratio for this Cycle 2 (91/92) project is
30. 02%.
