Description) Finance: Council Notes: Agenda Item No. -q//7 a000 CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report SUBJECT: Resolution of the City of San Bernardino confirming cost of abatements and imposing liens on certain parcels of real property located within the City of San Bernardino for the cost of the abatement of public nuisances(building abatements). BACKGROUND: Chapters 8.30.110 and 8.30.130 of the San Bernardino Municipal Code authorize the city to recover costs against certain properties for the abatement of nuisances. The City's Code Compliance Division has deemed the properties listed on Exhibit "A" (attached) to be a nuisance. Due notice was given to the person or persons having an interest in said properties. A hearing was held by the 1 Tearing Officer to hear protests and to assess the costs of abatements. The Hearing Officer entered an order determining the cost to be reasonable and proper, and imposing a lien upon the property involved. Notice of the right to appeal to the Board of Building Commissioners has beer_issued to all affected property holders. This action is to confirm the ime itior of liens. The Cite Clerk shall administratively remove any properties from EXhibiL "A" which cave been paid within five days following the mailing of notice. RECOMMENDATION: Adopt resolution. 1 ;strict c�op� 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING COST OF ABATEMENTS AND IMPOSING LIENS ON CERTAIN PARCELS OF REAL 3 PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR THE 4 COSTS OF THE ABATEMENT OF PUBLIC NUISANCES. (Building Abatements) BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 5 SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. The City f San Bernardino,, pursuant to its authority under San 7 8 Bernardino Municipal Code Chapter 15.28 and other laws, did lawfully cause public nuisance 9 abatements on the real property described in Exhibit "A", attached hereto and incorporated 10 herein by reference as though fully set forth. The last known owners of record as to each such 11 parcel are also specified in Exhibit "A". 12 Due notice was given to the person or persons having an interest in said property and a 13 hearing was held by the Hearing Officer to hear protest and to assess the cost of said 14 abatement on said property. The Hearing Officer has entered its order determining the cost to 15 16 be reasonable and proper and imposing a lien upon the property involved. Notice of the right 17 to appeal to the Board of Building Commissioners has been issued to all affected property 18 holders. 19 SECTION 2. The matter having now come before the Mayor and Common 20 Council for confirmation of the imposition of the liens imposed, the following costs are found 21 to have been duly incurred by the City pursuant to the proceedings under said provisions of 22 the San Bernardino Municipal Code and the final statements of costs on file with the Code 23 24 Compliance Division are hereby confirmed and adopted as special assessments against the 25 properties listed in Exhibit "A"hereto. 26 H 27 28 t RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING COST OF 1 ABATEMENTS AND IMPOSING LIENS ON CERAIN PARCELS OF REAL 2 PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR THE COSTS OF THE ABATEMENT OF PUBLIC NUISANCES. (Building Abatements) 3 4 SECTION 3. If said sum is not fully paid to the Code Compliance Division, City 5 Hall, San Bernardino within five (5) days after mailing a notice to the person or persons 6 having an interest in said property informing said person or persons of the adoption of this 7 resolution as to any such individual parcel, then said sum shall be and become a lien on said 8 9 property pursuant to said Municipal Code provisions and applicable laws and shall be 10 collected as a special assessment thereon. 11 SECTION 4. In the event said sum is not paid as hereinabove provided, the 12 Code Compliance Division is hereby directed to file a certified copy of this resolution with 13 the Auditor of the County of San Bernardino, State of California, directing that sum to be 14 entered as lien charges against said property as it appears on the current assessment rolls, to 15 16 be collected as the same and in the same manner, subject to the same penalties and interest 17 upon delinquencies, as the general taxes for the City of San Bernardino are collected.
