No.) (Arrt Description) -r Finance: Council Notes: Agenda Item No. ,5) 1 �aono t CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT Subject: General Plan Amendment No. 99-03 Mayor and Common Council Meeting Of May 1, 2000 OWNER: APPLICANT: Various City Of San Bernardino 300 North "D" Street San Bernardino, CA 92418 BACKGROUND The City proposes approval of a General Plan Amendment to change the land use designation of approximately 1.2 acres from CR-2, Commercial Regional-Downtown to RM, Residential Medium. The change in land use designation would allow for the reuse of existing multi- family residential properties. Specifically, the GPA would make existing multi-family residential permitted uses instead of non-conforming uses. The project is located on the south side of Victoria Street between "F" Street and "E" Street. The following nine (9) parcels would be affected by this change of designation: 134-023-01 through 07; and 134-023-20 & 21. At its meeting of March 14, 2000, the Planning Commission recommended that the Mayor and Common Council approve General Plan Amendment 99-03. Commissioners Adams, Coute, Duff, Enciso, Lockett, O'Connor, Ramirez, Thrasher and Welch voted in favor of the motion. Refer to the Planning Commission staff report for a complete discussion. FINANCIAL IMPACT None. The Mayor and Common Council initiated this general plan amendment. RECOMMENDATION Staff recommends that the Mayor and Common Council approve General Plan Amendment 99-03 based on the Findings of Fact in the Planning Commission Staff Report. Exhibits: 1. The change in land use designation would allow for the reuse of existing multi-family residential properties. Specifically, the GPA would make existing multi-family residential permitted uses instead of non-conforming uses. The project is located on the south side of Victoria Street between "F" Street and "E" Street. The following nine (9) parcels would be affected by this change of designation: 134- 023-01 through 07; and 134-023-20 & 21. SETTING/SITE CHARACTERISTICS The 1.2-acre site is within a neighborhood consisting of a mixture of commercial and residential uses and some vacant parcels. The subject parcels are developed as follows: APN # Use Code Existing Use 134-023-01 510 Single Family 134-023-02 381 Parking Lot 134-023-03 524 4 SFR's 134-023-04 523 3 SFR's 134-023-05 510 Single Family 134-023-06 0 Vacant 134-023-07 510 Single Family 134-023-20 0 Vacant 134-023-21 510 ISingle Family BACKGROUND These nine parcels were changed from RM, Residential Medium to CR-2, Commercial Regional- Downtown as part of GPA 96-08 which was initiated by the Mayor and Council on June 3, 1996. At the time, there was the expectation that the Arts Colony project would be developed soon and some property owners in the area felt that the CR-2 district would be most appropriate to complement that use. To date the Arts Colony project has not materialized. FINDINGS AND ANALYSIS 1. Is the proposed amendment internally consistent with the General Plan? Yes. General Plan Goal 2B is to "Conserve and improve the condition of the existing affordable housing stock." The change to RM will re-establish several properties as permitted multi-family uses and encourage the maintenance and rehab of the residential units. 2. Is the proposed amendment detrimental to the public interest, health, safety, convenience, or welfare of the City? No. The proposal will permit the rehabilitation of existing, deteriorated units thus eliminating potential health and safety concerns. General Plan Amendment 99-03 Meeting Date:March 14, 2000 Page 3 3. Does the proposed amendment maintain the appropriate balance of land uses within the City? Yes. The properties in the area were, up until 1997, in the RM land use district. Since that time, no commercial construction has occurred consistent with the CR-2 designation. The change in land use district to RM reaffirms the viability of the existing residential units. 4. Are the subject parcels physically suitable (including, but not limited to, access, provision of utilities, compatibility with adjoining land uses, and absence of physical constraints) for the requested land use designation and anticipated land use development? Yes. All infrastructure is in place to accommodate residential uses on Victoria Street. Although each parcel was legally established prior to the adoption of the Development Code, the Code makes provisions for the development of existing lots of record allowing development at a reduced density. Since 7 of the 9 parcels are already developed with residential uses, there is little concern of incompatibility with surrounding uses. All future development that would be permitted on these parcels would be required to conform to all Development Code standards. CONCLUSION The proposal meets all the necessary Findings of Fact for approval of General Plan Amendment 99-03. RECOMMENDATION Staff recommends the Planning Commission recommend that the Mayor and Common Council: 1. RESOLUTION OF THE CITY OF SAN BERNARDINO ADOPTING GENERAL 2 PLAN AMENDMENT NO. 99-03 TO THE GENERAL PLAN OF THE CITY OF SAN 3 BERNARDINO, TO AMEND THE GENERAL PLAN LAND USE DESIGNATION FROM CR-2, COMMERCIAL REGIONAL-DOWNTOWN TO RM, RESIDENTIAL 4 MEDIUM, FOR 1.2 ACRES LOCATED ON THE SOUTH SIDE OF VICTORIA 5 STREET BETWEEN "E" AND "F" STREETS. 6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 7 OF SAN BERNARDINO AS FOLLOWS: 8 SECTION 1. Recitals 9 (a) WHEREAS, the General Plan for the City of San Bernardino was adopted by the 10 Mayor and Common Council by Resolution No. 89-159 on June 2, 1989. 11 12 (b) WHEREAS, General Plan Amendment No. 99-03 to the General Plan of the City of 13 San Bernardino was considered by the Planning Commission on March 14, 2000, after a 14 noticed public hearing, and the Planning Commission's recommendation of approval has been 15 considered by the Mayor and Common Council. 16 (c) WHEREAS, General Plan Amendment No. 99-03 is covered by the general rule 17 18 that CEQA applies only to projects which have the potential for causing a significant effect on 19 the environment and it can be seen with certainty General Plan Amendment No. 99-03 would 20 not have a significant effect on the environment and therefore, recommend that a Notice of 21 Exemption be adopted. 22 (d) WHEREAS, the general rule exemption was reviewed by the Environmental 23 24 Review Committee, the Planning Commission and the Mayor and Common Council in 25 compliance with the California Environmental Quality Act (CEQA) and local regulations. 26 (e) WHEREAS, the Planning Commission conducted a noticed public hearing on 27 March 14, 2000 in order to receive public testimony and written and oral comments on 28 1 1 General Plan Amendment No. 99-03 (a proposal to change the General Plan Land Use 2 3 Designation from CR-2, Commercial Regional-Downtown to RM, Residential Medium for 1.2 4 acres on the south side of Victoria Street between_ "E" and "F" Streets) and fully reviewed 5 and considered the Planning Division staff report and the recommendation of the 6 Environmental Review Committee. 7 (e) WHEREAS, the Mayor and Common Council held a noticed public hearing and 8 9 fully reviewed and considered proposed General Plan Amendment No. 99-03 and the Planning 10 Commission and Environmental Review Committee recommendations and Planning Division 11 Staff Report on May 1, 2000. 12 (fl WHEREAS, the adoption of General Plan Amendment No. 99-03 is deemed in the 13 14 interest of the orderly development of the City and is consistent with the goals, objectives and 15 policies of the existing General Plan. 16 SECTION 2. Statutory Exemption 17 NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the 18 Mayor and Common Council that it can been seen with certainty that there is no possibility 19 that the proposed amendment to the General Plan of the City of San Bernardino will have a 20 21 significant effect on the environment, and the Statutory Exemption is hereby ratified, affirmed 22 and adopted. 23 SECTION 3. Findings 24 BE IT FURTHER RESOLVED by the Mayor and Common Council of the City of San 25 Bernardino that: 26 27 A. The proposed amendment is internally consistent with the General Plan in that it meets 28 Goal 2B which encourages the City to conserve and improve the condition of the 2 1 existing affordable housing stock in that the change to RM will re-establish several 2 properties as permitted uses and encourage maintenance and rehab of those units. 3 4 B. The proposed amendment would not be detrimental to the public interest, health, 5 safety, convenience, or welfare of the City in that it will permit the rehabilitation of 6 existing, deteriorated units thus eliminating potential health and safety concerns. 7 C. The proposed amendment would not impact the balance of land uses within the City in 8 9 that the affected properties were, up until 1997 in the RM land use district and no new 10 construction has occurred consistent with the CR-2 designation. 11 D. In the case of an amendment to the General Plan Land Use Map, the subject parcel(s) 12 is physically suitable (including, but not limited to access, provision of utilities, 13 compatibility with adjoining land uses, and absence of physical constraints) for the 14 15 requested land use designation(s) and the anticipated land use development(s) in that all 16 affected parcels are flat and have existing infrastructure in place to accommodate 17 residential uses. 18 SECTION 4. Amendment 19 BE IT FURTHER RESOLVED by the Mayor and Common Council that: 20 21 A. The Land Use Plan of the General Plan of the City of San Bernardino is amended by 22 changing the land use designation from CR-2, Commercial Regional-Downtown to 23 RM, Residential Medium for 1.2 acres located on the south side of Victoria Street 24 between "E" and "F" Streets. This amendment is designated as General Plan 25 26 Amendment No. 99-03 and its location is outlined on the map entitled Attachment A, 27 and further described in Attachment B, copies of which are attached and incorporated 28 herein for reference. 3 1 B. General Plan Amendment No. 99-03 shall become effective immediately upon adoption 2 of this resolution. 3 4 SECTION 5. Map Notation 5 This resolution and the amendment affected by it shall be noted on such appropriate 6 General Plan maps as having been previously adopted and approved by the Mayor and 7 Common Council and which are on file in the office of the City Clerk. 8 SECTION 6. Notice of Exemption 9 10 The Planning Division is hereby directed to file a Notice of Exemption with the 11 County Clerk of the County of San Bernardino certifying the City's compliance with 12 California Environmental Quality Act in preparing the Notice of Exemption. 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 4 1 RESOLUTION. . .
