Recommended Motion:
That the Director of Development Services and the City Clerk be authorized to proceed under
SBMC 12.90, with the establishment of a Landscape Maintenance Assessment District in the
Waterman Avenue and Washington Street Area, within Tentative Tract Nos. 15826 & 15991,
to be known as Assessment District No. 1027.

Staff Report
SUBJECT:
Authorization to Proceed --- Formation of a Landscape Maintenance Assessment District in the
Waterman Avenue and Washington Street Area, Tentative Tract Nos. 15826 & 15991.
BACKGROUND:
The Planning Commission approved Tentative Tract No. 15826 on February 16, 1999, and
Tentative Tract No. 15991 on June 22, 1999. Part of the conditions for approval require the
formation of a Landscape Maintenance Assessment District.
On October 8, 1999, this office received a petition from the developer of Tentative Tract No.
15826, consisting of 78 lots and No. 15991, consisting of 73 lots, for the formation of an
assessment district. The formation of this district would provide funding for maintenance of the
landscaping along portions of Waterman Avenue, Washington Street, Wier Road, Heritage Lane,
Foxcroft Way, Commercial Road, and Beverly Drive.
A portion of the landscaping to be maintained, as set forth in the conditions of approval, is within
the City of Colton right-of-way. Specifically, the area between the perimeter wall and the
sidewalk along the north side of Washington Street. The City of Colton has granted an easement
to the City of San Bernardino for landscape maintenance purposes and has consented to a portion
of the district being within their city limits. No properties in the City of Colton will be assessed.
The formation proceedings include the preparation of an Engineer's Report, which would have
details regarding the improvements, and method of determining benefit and assessment amounts.
In compliance with Proposition 218, the proceedings would also require that ballots be mailed to
the property owners relative to the proposed assessment.
FINANCIAL IMPACT:
The applicant has paid the total amount of$4,000 for the Landscape Maintenance Assessment
District formation fees. If any of the proposed maintenance is determined to be of general
benefit, that portion could not be assessed, and would therefore have to be paid from the City's
General Fund.
RECOMMENDATION:
Staff recommends that authorization be given to proceed with the formation of the assessment
district.
