STAFF REPORT
SUBJECT:
Agreement for Services with Glen Helen Raceway Park.
BACKGROUND:
Resolution 98-96 was adopted on 4-21-98, which authorized an Agreement for Services,
traffic control at key intersections, with Glen Helen Raceway. The agreement expired on
December 31, 1999. Glen Helen Raceway hosts events, which include the Police and
Fire National Motocross Finals and the National Motocross Championship. At times,
these events draw large crowds of more than 15,000 attendees. To facilitate traffic
movement and minimize the impact to community residents,the Police Department
provides personnel, working on an overtime basis, for traffic control at essential
intersections. Glen Helen Raceway reimburses the full costs of these services to the City.
Glen Helen Raceway and the Police Department have worked together under Agreements
For Services. The use of personnel, on an overtime basis, eliminates the drain on police
resources.
FINANCIAL IMPACT:
None. Glen Helen Raceway reimburses the City for costs incurred. Reimbursement
received for 1999 event, $1,095.
RECOMMENDATION:
Adopt resolution.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
5 SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed
7
to execute on behalf of said City an Agreement for Services with Glen Helen Raceway Park
8
relating to traffic control services within City jurisdiction, a copy of which is attached hereto
9
marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length.
10
SECTION 2. The Authorization to execute the above referenced agreement is rescinded
11
if the parties to the agreement fail to execute it within sixty days of the passage of this resolution.

1 AGREEMENT FOR SERVICES
2 Glen Helen Raceway Park
3 This Agreement, made and entered into this First day of May , 2000, by
4 and between the City of San Bernardino, acting by and through the San Bernardino Police
5 Department, hereinafter called"CITY" and Glen Helen Raceway Park, hereinafter called
6 "GHRP".
7 WITNESSETH: By and in consideration of the covenants and the conditions herein contained,
8 the GHRP and CITY do hereby agree as follows.
9 1. CITY agrees to provide one Police Officer and six Community Services
10 Representatives (C.S.R.'s) * with vehicles for traffic control during various events
11 occurring at Glen Helen Raceway Park. Traffic control services will be provided, as
12 needed, at the following locations:
13 a) I-215 Northbound off ramp at Palm Avenue
14 b) Palm Avenue and Kendall Drive
15 c) Palm Avenue/Institution Road and Cajon Boulevard
16 1 The S.B.P.D. coordinator shall be an Area Detective, as assigned, for Area B,
17 telephone number(909) 384-5785. The GHRP coordinator shall be Mr. Milford
is Harrison, telephone number(909) 384-9342.
19 I The term of the agreement shall be May 1, 2000 through December 31, 2001.
20 4. In consideration for the above services and upon receipt of an itemized invoice,
21 GHRP agrees to pay the CITY in accordance with the following rates, which may be
22 amended from time to time with written notice given to GHRP:
23 Police Detective (On call—Not used) $45.11 per hour
24 Police Officer $40.56 per hour
25 CSR II $23.38 per hour

1 CSR I $21.70 per hour
2 Vehicle/Equipment Usage $100.25 per event
3 *Events with expected attendance of more than 15,000 will require one additional
4 CSR I or CSR II. The CITY shall, at its discretion, assign CSR I or CRS II
5 positions.
6 5. This agreement may be amended by written mutual Consent of both parties hereto.
7 6. In case of disaster or unforeseen emergency, CITY shall be excused from providing
8 scheduled traffic control services without prior notice to the other.
9 7. The rates indicated in this agreement are for estimate purposes only. In case of a
10 wage increase, GHRP agrees to pay the increased rates.
11 8. GHRP agrees that reasonable additional expended charges may be assessed for
12 S.B.P.D. supplies expended (flares), additional equipment utilized, damage to
13 uniforms or property repaired or replaced at CITY expense, etc., which are directly
14 related to the services referenced herein.
15 9. GHRP agrees that any cancellation of this request for service later than 4:00 p.m. on
16 the day preceding the requested service may result in a charge of four hours for each
17 of the personnel assigned.
is 10. No additional gifts, donations, or gratuities may be accepted by S.B.P.D. personnel in
19 their behalf or in the behalf of the Department.
20 11. GHRP shall indemnify, defend and hold CITY, its officers, employees, and agents,
21 free and harmless from any claim, demand, liability, suit,judgement, or expense
22 (including, without limitation, reasonable costs of defense which shall include
23 attorney fees and services provided by the City Attorney's Office) arising out of or
24 related to CITY's performance of services under this agreement, except that such

1 duty to indemnify, defend, and hold harmless shall not apply where injury to person
2 or property is caused by CITY's willful misconduct or sole negligence.
3 IN WITNESS WHEREOF, the parties hereto have executed this Agreement on the day
4 and date first above shown.
