Synopsis of Previous Council Action:

Recommended Motion:
1. Adopt Resolution; and
2. Authorize the Director of Finance to amend the FY 99/00 budget and transfer $30,000
from 126-369-5504-7119 (Repair box culverts) to 126-369-5504-7149 (Disabled access
ramps—Citywide) --

Staff Report
Subject:
Resolution awarding contract to J. Cardenas Construction for construction of sidewalks and
disabled access ramps at various locations, per Plan No. 10020 and authorization for the
Director of Finance to amend the FY 99/00 budget and transfer funds.
Background:
Installation of disabled access ramps along city streets has been programmed for the last
several years. The correct amount for this project was originally budgeted; however,
additional costs were incurred due to the ongoing survey of disabled access ramps being
conducted throughout the city. Therefore, a budget transfer of an additional $30,000 is
necessary. The proposed ramps follow the adopted policy for installation in that they cover
public facilities, schools, retail areas, and places of public accommodation in a set order.
Plans and specifications for this project are complete and it is ready to be awarded. The project
consists of installing access ramps, sidewalks, and six-inch wide retaining curbs.
The estimated project costs are as follows.
Construction Estimate $37,710.05
Contingencies $ 6,689.95
Design, Inspection and Contract Administration $ 5,600.00
TOTAL $50,000.00
This project was advertised locally; the following companies responded (successful bidder is in
bold type).

Financial Impact:
Funding in the amount of $50,000 for this project was approved in the FY 1999/00 CIP Gas
Tax fund and all costs incurred will be charged to Account No. 126-369-5504-7149 (Disabled
access ramps—citywide).
The requested budget adjustment of $30,000 is necessary due to the cost incurred to date and
projected through June 30, 2000 related to an ongoing survey of disabled access ramps being
conducted throughout the city. Repair of box culverts is budgeted both in the Gas Tax Fund
(126) and in the Storm Drain Fund (248); therefore, Project 7119 (Repair box culverts) is
being reduced as enough funds for this purpose are budgeted in the Storm Drain Fund.
Recommendation:
That the Mayor and Common Council adopt the Resolution awarding a contract to J. Cardenas
Construction for construction of sidewalks and disabled access ramps at various locations, per
Plan No. 10020; and, authorize the Director of Finance to amend the FY 99/00 budget and
transfer $30,000 from 126-369-5504-7119 (Repair box culverts) to 126-369-5504-7149
(Disabled access ramps).

5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

7 SECTION 1. J. Cardenas Construction is the lowest responsible bidder for repair of
8 failed box culverts at various locations per Plan No. 10020. A contract is awarded
9 accordingly to said bidder in a total amount of $37,710.05, with a contingency amount of
10 $6,689.95, but such award shall be effective only upon being fully executed by both parties.

12 All other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed
13 to execute said contract on behalf of the City; a copy of the contract is on file in the office of
14 the City Clerk and incorporated herein by reference as fully as though set forth at length.
15 SECTION 2. This contract and any amendment or modifications thereto shall not take
16 effect or become operative until fully signed and executed by the parties and no party shall be
17
18 obligated hereunder until the time of such full execution. No oral agreements, amendments,
19 modifications or waivers are intended or authorized and shall not be implied from any act or
20 course of conduct of any party.
21 SECTION 3. This resolution is rescinded if the parties to the contract fail to execute
22 it within sixty (60) days of the passage of the resolution.
