HomeMy WebLinkAbout2014-346 RESOLUTION NO. 2014-346 1 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AND THE MAYOR AND COMMON COUNCIL ACTING AS 3 THE SUCCESSOR AGENCY TO THE REDEVELOPMENT AGENCY OF SAN 4 BERNARDINO AUTHORIZING THE EXECUTION OF AMENDMENT NUMBER ONE TO VENDOR SERVICE AGREEMENT BETWEEN THE CITY OF SAN 5 BERNARDINO AND PLATINUM SECURITY, INC., FOR SECURITY GUARD SERVICES AT SEVERAL CITY LOCATIONS. 6 WHEREAS, Platinum Security, Inc., is the preferred provider of security guard 7 8 services at the City's Library and Metrolink Station for the Police Department. 9 NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 10 COUNCIL OF THE CITY OF SAN BERNARDINO AND THE MAYOR AND 11 COMMON COUNCIL ACTING AS THE SUCCESSOR AGENCY TO THE REDEVELOPMENT AGENCY OF SAN BERNARDINO AS FOLLOWS: 12 13 SECTION 1. The City Manager of the City of San Bernardino is hereby authorized 14 to execute, on behalf of said City and the Successor Agency, Amendment Number One to the 15 Agreement for Services between the City of San Bernardino and Platinum Security, Inc„ a 16 17 copy of which is attached hereto, marked Exhibit "A," and incorporated herein by this 18 reference as fully as though set forth at length 19 SECTION 2. The City Manager of the City of San Bernardino is hereby authorized to 20 execute on behalf of said City a Memorandum of Understanding with the Successor Agency 21 for management of security guard service at the Carousel Mall and Successor Agency sites. 22 23 SECTION 3. Saenz, City Attorney 27 28 By: 2014-346 EXHIBIT A AMENDMENT NUMBER ONE TO VENDOR SERVICE AGREEMENT BETWEEN THE CITY OF SAN BERNARDINO AND PLATINUM SECURITY INC. FOR SECURITY GUARD SERVICES AT SEVERAL CITY LOCATIONS THIS AMENDMENT NUMBER ONE TO AGREEMENT FOR SECURITY GUARD SERVICES (the "Amendment Number One") is made as of the 15thday of sprtamhPr 2014, by and between the City of San Bernardino, a municipal corporation ("City"), the Successor Agency to the Redevelopment Agency of the City of San Bernardino, a public body corporate and politic ("Successor Agency"), and Platinum Security, Inc., a California corporation ("Vendor"). Collectively, City, Successor Agency and Vendor are referred to herein as the "Parties" and individually as a "Party". WITNESSETH THAT: WHEREAS, City and Vendor previously entered into an original Agreement for Security Guard Services dated December 17, 2013 (the "Agreement"); and WHEREAS, the Agreement's scope of services included security guard services at the Feldheym Library and the San Bernardino Metrolink Station, as more particularly described in the Agreement; and WHEREAS, Successor Agency controls and manages certain real properties for which security guard services are required, as such real properties ("Successor Agency Properties") are more particularly described in the Scope of Services, Attachment 1 to this Amendment Number One; and WHEREAS, Successor Agency desires that Vendor provide additional security guard services with respect to the Successor Agency Properties consistent with the Scope of Services, Attachment 1 to this Amendment Number One; and WHEREAS, Successor Agency has become a Party to the Agreement pursuant to this Amendment Number One for the purpose of engaging Vendor to provide additional security guard services with respect to the Successor Agency Properties; and WHEREAS, Vendor is willing to provide additional security guard services with respect to the Successor Agency Properties consistent with this Amendment Number One; and WHEREAS, it now becomes necessary to amend said Agreement and the Parties are desirous of such amendment. NOW, THEREFORE, in consideration of the mutual undertakings herein, the Parties amend the Agreement as follows: 1. The Scope of Services is amended in its entirety to add additional security 2014-346 EXHIBIT A guard services with respect to the Successor Agency Properties, as more particularly described in Attachment "1", attached hereto and incorporated herein by this reference. 2. The Schedule of Compensation and Expenses is amended in its entirety to add funding for additional security guard services with respect to the Successor Agency Properties, as more particularly described in Attachment "2", attached hereto and incorporated herein by this reference. 3. Schedule of Performance is extended through June 30, 2017. 4. All remaining provisions of the Agreement shall remain the same. SCOPE OF SERVICES CITY SITES Metrolink Train Station: The City requires an unarmed security guard in uniform - 2 shifts — from 4:00 a.m. until 10:30 p.m. (18.5 hours per day), Monday through Saturday (10:30 p.m. or until the last train arrives at the station and the public safely clears the parking area, whichever comes first), and 7:00 a.m. until 6:30 p.m., Sunday (11.5 hours per day). Feldheym Central Library: The City requires an unarmed security guard in uniform from 9:00 a.m. until 6:00 p.m., Monday through Thursday (9- hours per day), and 12:00 p.m. until 6:00 p.m., Saturday (6-hours per day). The Norman F. Feldheym Central Library is closed on Fridays and Sundays. SUCCESSOR AGENCY SITES Carousel Mall: The Successor Agency requires one (1) unarmed guard in uniform — 2 shifts except Sunday — from 6:30 a.m. until 8:00 p.m., Monday through Friday (13.5 hours per day), 9:00 a.m. until 8:00 p.m., Saturday (11 hours per day), and 10:00 a.m. until 7:00 p.m., Sunday (9 hours per day). Night Time Patrol of Successor Agency Sites: The Successor Agency requires two (2) armed security guards in uniform in a clearly marked security vehicle from 10:00 p.m. until 6:00 a.m. Monday through Sunday (8 hours per day) for the following sites: Vacant Buildings 396 N. E Street (old Woolworth building) 385 N. E Street (vacant restaurant) 301 N. E Street (Convention Center) 144 Carousel Mall (old Wards furniture storage) 1350 S. E Street (former Parks & Recreation building) -1- 2014-346 Occupied Buildings 780 N. E Street (Sturges Theatre) 746 W. 5th Street (Salvation Army) 450 N. REQUIREMENTS All Locations: 1) The security guards provided shall be properly licensed through the State of California 2) The security guards provided will have the necessary training, ability, and Supervisor oversight to perform all of the proposed duties, and shall always maintain a neat and professional appearance. 3) The security guards will always conduct themselves with a professional respectful attitude and demeanor in any interaction with the public or City staff. 4) The security guard on duty shall always have the means on their person to contact all emergency services as required, fire, police, or ambulance either through radio or cell phone. 3. UNIFORM All Locations: The security guard will wear a clean and pressed police style uniform acceptable to the City for each shift. -2- 2014-346 4. DUTIES Metrolink Train Station: 1) Provide surveillance of the property and secure the Metrolink platform and site from incidents. Ensure the Metrolink gate to the platform is closed, as safety to the public requires. 2) Monitor and observe all vehicles within the parking areas to include the parking structure. Provide foot patrols of the property and parking areas on an irregular basis, but at least a minimum of three (3) times per hour. Immediately notify the San Bernardino Police Department of irregularities or criminal activity. 3) Document on a daily basis a log of activities, incidents, and interactions, either with public, Supervisor, City personnel, or emergency services on a report format acceptable to the City of San Bernardino. Feldheym Central Library: 1) Provide surveillance of the property and secure the Library from incidents. 2) Provide foot patrol of the Library building on an irregular basis as directed by the Police Department, and immediately notify the San Bernardino Police Department of irregularities or criminal activity. 3) Document on a daily basis a log of activities, incidents, and interactions, either with public, Supervisor, City personnel, or emergency services on a report format acceptable to the City of San Bernardino. Carousel Mall: 1) Lock and unlock public entrances, delivery doors and trash rooms. 2) Provide surveillance of the property and secure the Mall from incidents. 3) Provide foot patrol of the Mall on an irregular basis as directed by the Police Department. Immediately notify the San Bernardino Police Department of irregularities or criminal activity. 4) Maintain a Detex-type tour verification system for eleven (11) public entry points and provide Guard check-in at two jewelry stores. -3- 2014-346 5) Other duties identified in the Carousel Mall Security Guard Duties document attached hereto as Exhibit A. 6) Document on a daily basis a log of activities, incidents, and interactions, either with public, Supervisor, City personnel, or emergency services on a report format acceptable to the City/Successor Agency. Night Time Patrol of Successor Agency Sites: 1) Provide surveillance of Successor Agency property exteriors and secure from incidents, with respect to all Successor Agency Properties. 2) Conduct vehicle patrols (GPS equipped) at Successor Agency properties as outlined in Section 1, above, with respect to all Successor Agency Properties. 3) Conduct vehicle and foot patrols with respect to all Successor Agency Properties. Immediately notify the San Bernardino Police Department of irregularities or criminal activity. 4) Document on a daily basis a log of activities, incidents, and interactions, either with public, Supervisor, City/Successor Agency personnel, or emergency services on a report format acceptable to the City/Successor Agency. 5. SECURITY GUARD COMPANY SHALL: All Locations: 1) Provide the necessary training and supervision for each security guard proposed for each location. 2) Ensure the security guards assigned to each location are neat and professional in appearance, and conducts themself with a professional, respectful attitude and demeanor in any interaction with the public or City staff. 3) Provide sufficient unscheduled Supervisor visits to the site to monitor and ensure the duties are being properly executed. 4) Review the daily security guard log/report and submit copies of each to the San Bernardino Police Department on a biweekly basis. 5) Maintain in effect policies of comprehensive public, general and automobile liability insurance, in the amount of $1,000,000.00 combined single limit, and statutory worker's compensation coverage, and shall file copies of said policies with the City's Risk Manager prior to undertaking any work. 6) The City shall be set forth as an additional named insured in each policy of insurance provided. The Certificate of -4- 2014-346 Insurance furnished to the City shall require that insurer to notify the City at least 30-days prior to any change in or termination of the policy 6. CONTRACT LENGTH The length of this contract shall be extended through June 30, 2017. 7. LICENSES The Vendor represents that it has all licenses including a State license from the Bureau of Security & Investigative Services, permits, qualifications and approvals of whatever nature that are legally required to provide security guard services, including a City Business License, and that such licenses and approvals shall be maintained throughout the term of this Contract. 8. CONTRACTOR NON-COMPLIANCE 1) If the Chief of Police for the San Bernardino Police Department, or his designee, determines that there are deficiencies in the performance of this Agreement, the Chief of Police, or his designee, will provide a written notice to the Vendor stating the deficiencies and specifying a time frame to correct the specified deficiencies. Projected Successor Agency Expenditure for Police Sergeant A San Bernardino Police Department sergeant will supervise and manage security guard services on behalf of the Successor Agency. This sergeant, at Step 5, earns $82.7518 per hour (salary/certificate pay/benefits). It is estimated that the police sergeant will dedicate 1/2 hour or 30 minutes each workday on this program. The police sergeant works four days per week. Immediately notify the San Bernardino Police Department of irregularities or criminal activity. 4) Document on a daily basis a log of activities, incidents, and interactions, either with public, Supervisor, City/Successor Agency personnel, or emergency services on a report format acceptable to the City/Successor Agency. 5. SECURITY GUARD COMPANY SHALL: All Locations: 1) Provide the necessary training and supervision for each security guard proposed for each location. 2) Ensure the security guards assigned to each location are neat and professional in appearance, and conducts themself with a professional, respectful attitude and demeanor in any interaction with the public or City staff. 3) Provide sufficient unscheduled Supervisor visits to the site to monitor and ensure the duties are being properly executed. 4) Review the daily security guard log/report and submit copies of each to the San Bernardino Police Department on a biweekly basis. 5) Maintain in effect policies of comprehensive public, general and automobile liability insurance, in the amount of $1,000,000.00 combined single limit, and statutory worker's compensation coverage, and shall file copies of said policies with the City's Risk Manager prior to undertaking any work. 6) The City shall be set forth as an additional named insured in each policy of insurance provided. The Certificate of -4- 2014-346 Insurance furnished to the City shall require that insurer to notify the City at least 30-days prior to any change in or termination of the policy 6. CONTRACT LENGTH The length of this contract shall be extended through June 30, 2017. 7. LICENSES The Vendor represents that it has all licenses including a State license from the Bureau of Security & Investigative Services, permits, qualifications and approvals of whatever nature that are legally required to provide security guard services, including a City Business License, and that such licenses and approvals shall be maintained throughout the term of this Contract. 8. CONTRACTOR NON-COMPLIANCE 1) If the Chief of Police for the San Bernardino Police Department, or his designee, determines that there are deficiencies in the performance of this Agreement, the Chief of Police, or his designee, will provide a written notice to the Vendor stating the deficiencies and specifying a time frame to correct the specified deficiencies. Projected Successor Agency Expenditure for Police Sergeant A San Bernardino Police Department sergeant will supervise and manage security guard services on behalf of the Successor Agency. This sergeant, at Step 5, earns $82.7518 per hour (salary/certificate pay/benefits). It is estimated that the police sergeant will dedicate Y2 hour or 30 minutes each workday on this program. The police sergeant works four days per week.
