Resolution of the City of San Bernardino Confirming the 2014/2015 Assessment Roll for
Assessment District No. 1064 Landscape Maintenance District, Located in the Cajon Boulevard
and Glen Helen Parkway Area. (#3181)

Financial Impact:
The total assessment of$1,893,635.39 pays the City's maintenance, operation and incidental
costs for the various districts. If the assessments are not approved,the City will not be
reimbursed for the costs. The general benefit amount of$22,754.44 from various districts as
shown on the attached report,will not be reimbursed from the Assessment Districts for FY
2014/2015, as these amounts are determined to be general benefit and therefore not assessable,
and will be paid for from the General Fund. Assessment deficits for nine Districts, as set forth
below,total$80,056.22.
Motion: Adopt the Resolution.

RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE
3 2014/2015 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 1064
LANDSCAPE MAINTENANCE DISTRICT, LOCATED IN THE CAJON
4 BOULEVARD AND GLEN HELEN PARKWAY AREA.
5 WHEREAS, by Resolution No. 2008-179, the Mayor and Common Council found
6 that the public interest, convenience, and necessity required the formation of a landscaping
7
maintenance district; and
9 WHEREAS, by said Resolution No. 2008-179, the Mayor and Common Council "5
10 formed an assessment district known as Assessment District No. 1064 for the purpose of

providing landscaping maintenance in the Cajon Boulevard and Glen Helen Parkway area,
12
pursuant to the provisions of Chapter 12.90 of the San Bernardino Municipal Code; and
13
WHEREAS, by Resolution No. 2008-90, the Mayor and Common Council declared
14
that all the land included within the boundaries of said district receive a special benefit by the
15
16 maintenance of said landscaping except for those portions, if any, set forth as a General Benefit
1.7 in the Engineer's Report approved by said Resolution No. 2008-179, on file in the Office of the '0'-0

18 City Clerk and the City Engineer of said City; and
19
WHEREAS, said Resolution No, 2008-90 declared that an annual assessment shall be
20 E
21 levied on all land within the district to provide funding for said landscaping maintenance and
22 the administration thereof, and
23 WHEREAS, by Resolution No. 2008-178, the Mayor and Common Council approved
24 a Landscape Maintenance Agreement with the property owner to allow the property within the
25 District to be maintained by a Property Owner's Association and only bear the cost of
26 inspection and incidental administrative costs so long as the property is maintained pursuant to
27
28 the conditions set forth in said Agreement; and

1 WHEREAS, an Assessment Roll has been prepared totaling $6,216.51, which sets
2 forth the individual assessments to be levied on each of the parcels of land within Assessment
3 District No. 1064 for the fiscal year 2014/2015; and

S WHEREAS, the Assessment District was created pursuant to the provisions of Article
6 XIII D of the California Constitution, which provides for the levying of annual assessments
7 without the necessity of following the assessment ballot procedures as long as said assessments
8 do not exceed any prior approved assessment or the methodology of applying assessments is
9 0
not changed or rates are not increased.
10 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE N

12 SECTION 1. That the Mayor and Common Council. do hereby find and determine that o

7 the assessments as set forth on said Assessment Roll No. 1064 comply with the procedural ,r

15 requirements of Article XIII.D of the California Constitution without the necessity of following d

1 the assessment ballot procedures as set forth therein. 00

17 SECTION 2. That the Mayor and Common Council do hereby find and determine that CTO-

18 the proportionate costs to be levied against the parcels of land within Assessment District No. 00

1064 are correctly set forth on Assessment Roll No. 1064, for the fiscal year 2014/201.5, on file

in the office of the City Clerk of the City of San Bernardino, and do hereby confirm said
21 a
22 assessments.
23 SECTION 3. That the City Clerk is directed to cause a copy of this Resolution to be
24 transmitted to the Office of the Auditor-Controller for the County of San Bernardino with the
25 request that the individual assessments be placed on the subject 2014/2015 property tax bills for
26
collection together with all other property taxes.
