(#3170) Current Business Registration Certificate: Not Applicable Financial Impact: The total assessment of$1,893,635.39 pays the City's maintenance, operation and incidental costs for the various districts. If the assessments are not approved,the City will not be reimbursed for the costs. The general benefit amount of$22,754.44 from various districts as shown on the attached report, will not be reimbursed from the Assessment Districts for FY 2014/2015, as these amounts are determined to be general benefit and therefore not assessable, and will be paid for from the General Fund. Assessment deficits for nine Districts, as set forth below,total $80,056.22. Motion: Adopt the Resolution. Larry Walker PUBLIC WORKS DIVISION 11593A Auditor-Controller/Recorder sl¢r�a County of San Bernardino NORTHPARKBOULEVARDAND VICINITY MAP NORTHSTAR AVENUE LANDSCAPE I SHOTS BY: Deputy Recorder MAINTENANCE ASSESSMENT DISTRICT Peoket Pg.857 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNAR-DINO CONFIRMING THE 3 2014/2015 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 1041, LANDSCAPING MAINTENANCE DISTRICT, MAGNOLIA AVENUE AND OHIO 4 AVENUE AREA. 5 WHEREAS, by Resolution No, 2006-396, the Mayor and Common Council found 6 that the public interest, convenience, and necessity required the formation of a landscaping 7 maintenance district; and 8 WHEREAS, by said Resolution No. 2006-396, the Mayor and Common Council 6 9 formed an assessment district known as Assessment District No. 1041 for the p 10 urpose of E 11 providing landscaping maintenance in the Magnolia Avenue and Ohio Avenue area, pursuant to 12 the provisions of Chapter 12.90 of the San Bernardino Municipal Code-, and 13 CD N WHEREAS, by Resolution No. 2006-331, the Mayor and Common Council declared 14 15 that all the land included within the boundaries of said district receive a special benefit by the C> 16 maintenance of said landscaping except for those portions, if any, set forth as a General Benefit M. 17 in the Engineer's Report approved by said Resolution No. 2006-396, on file in the Office of the 12 0 18 City Clerk and the City Engineer of said City; and (n 19 WHEREAS, said Resolution No. 2006-331 declared that an annual assessment shall 20 E be levied on all land within the district to provide funding for said landscaping maintenance 21 22 and the administration thereof; and 23 WHEREAS, an Assessment Roll has been prepared totaling $9,900.12, which sets 24 forth the individual assessments to be levied on each of the parcels of land within Assessment 25 District No. 1041 for the fiscal year 2014/2015; and 26 27 WHEREAS, the Assessment District was created pursuant to the provisions of Article 28 X111 D of the California Constitution, which provides for the levying of annual assessments 06/04/14 1 Packet Pg. 852 I without the necessity of following the assessment ballot procedures as long as said assessments 2 do not exceed any prior approved assessment or the methodology of applying assessments is 3 not changed or rates are not increased. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF TIME 5 CITY OF SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. That the Mayor and Common Council do hereby find and determine that 7 the assessments as set forth on said Assessment Roll No. 1.041 comply with the procedural 9 requirements of Article X111 D of the California Constitution without the necessity of following ° w 10 the assessment ballot procedures as set forth therein. That the Mayor and Common Council do hereby find and determine that n N 12 a the proportionate costs to be levied against the parcels of land within Assessment :District No. 13 N 1041 are correctly set forth on Assessment Roll No. 1041, for the fiscal year 2014/2015, on file 14 15 in the office of the City Cleric of the City of San Bernardino, and do hereby confirm said a 16 assessments. ° r M 17 SECTION 3. That the City Clerk is directed to cause a. copy of this Resolution to be T 18 transmitted to the Office of the Auditor-Controller for the County of San Bernardino with the 19 request that the individual assessments be placed on the subject 2014/2015 property tax bills for 20 E collection together with all other property taxes.
