(#3166) Current Business Registration Certificate: Not Applicable Financial Impact: The total assessment of$1,893,635.39 pays the City's maintenance, operation and incidental costs for the various districts. If the assessments are not approved,the City will not be reimbursed for the costs. The general benefit amount of$22,754.44 from various districts as shown on the attached report, will not be reimbursed from the Assessment Districts for FY 2014/2015, as these amounts are determined to be general benefit and therefore not assessable, and will be paid for from the General Fund. Assessment deficits for nine Districts, as set forth below,total $80,056.22. Motion: Adopt the Resolution. Larry Walker PUBLIC WORKS DIVISION 11217A Auditor-Controller/Recorder 1 County of San Bernardino—ET 10< BELMONT AVENUE AND MAGNOLIA AVENUE I s�cErs BY: VICINITY MAP AREA LANDSCAPE MAINTENANCE Deputy Recorder ASSESSMENT DISTRICT Packet Pg.831 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 3 2014/2025 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 1037, LANDSCAPING MAINTENANCE DISTRICT, BELMONT AVENUE AND 4 MAGNOLIA AVENUE AREA. 5 WHEREAS, by Resolution No. 2005-42, the Mayor and Common Council found that 6 the public interest, convenience, and necessity required the formation of a landscaping 7 maintenance district; and 8 9 WHEREAS, by said Resolution No. 2005-42, the Mayor and Common Council 10 formed an assessment district known as Assessment District No. 1037 for the purpose of 11 providing landscaping maintenance in the Belmont Avenue and Magnolia Avenue area, N a 12 pursuant to the provisions of Chapter 12.90 of the San Bernardino Municipal Code; and 0 13 N WHEREAS, by Resolution No. 2004-389, the Mayor and Common Council declared M 14 ° 15 that all the land included within the boundaries of said district receive a special benefit by the Q 16 maintenance of said landscaping except for those portions, if any, set forth as a General Benefit M 17 in the Engineer's Report approved by said Resolution No. 2005-42, on file in the Office of the o Cl) 18 City Clerk and the City Engineer of said City; and L 19 WHEREAS, said Resolution No. 2004-389, declared that an annual assessment shall 20 E be levied on all land within the district to provide funding for said landscaping maintenance 21 a 22 and the administration thereof; and 23 WHEREAS, an Assessment Roll has been prepared totaling $5,418.27, which sets 24 forth the individual assessments to be levied on each of the parcels of land within Assessment 25 District No. 1037 for the fiscal year 2014/2015; and 26 WHEREAS, the Assessment District was created pursuant to the provisions of Article 27 P 28 X111 D of the California Constitution, which provides for the levying of annual assessments 06/04/14 1 Packet Pg. 832 d I without the necessity of following the assessment ballot procedures as long as said assessments 2 do not exceed any prior approved assessment or the methodology of applying assessments is 3 not changed or rates are not increased. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 5 CITY OF SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. That the Mayor and Common Council do hereby find and determine that 7 the assessments as set forth on said Assessment Roll No. 1037 comply with the procedural 8 requirements of Article XIII D of the California Constitution without the necessity of following 0 .� 10 the assessment ballot procedures as set forth therein. cn N 11 SECTION 2.
