Resolution of the City of San Bernardino Confirming the 2014/2015 Assessment Roll for
Assessment District No. 1005, Landscaping Maintenance District, Cajon Boulevard and Pepper
Linden Avenue (Campus Parkway) Area. (#3145)

Financial Impact:
The total assessment of$1,893,635.39 pays the City's maintenance, operation and incidental
costs for the various districts. If the assessments are not approved,the City will not be
reimbursed for the costs. The general benefit amount of$22,754.44 from various districts as
shown on the attached report,will not be reimbursed from the Assessment Districts for FY
2014/2015, as these amounts are determined to be general benefit and therefore not assessable,
and will be paid for from the General Fund. Assessment deficits for nine Districts, as set forth
below,total $80,056.22.
Motion: Adopt the Resolution.

3 2014/2015 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 1005
LANDSCAPING MAINTENANCE DISTRICT, CAJON BOULEVARD AND PEPPEI
4 LINDEN AVENUE (CAMPUS PARKWAY)AREA.
5 WHEREAS, by Resolution No. 91-466, the Mayor and Common Council found tha
6 the public interest, convenience, and necessity required the formation of a landscaping
7
8 maintenance district; and
9
WHEREAS, by said Resolution No. 91-466, the Mayor and Common Council formed
10 an assessment district known as Assessment District No. 1005 for the purpose of providing N

11 landscaping maintenance in the Cajon Boulevard and Pepper Linden Avenue (Campus a
12
Parkway) area, pursuant to the provisions of Chapter 12.90 of the San Bernardino Municipal N
13 ,
Code; and o

15 WHEREAS, by Resolution No. 91-434, the Mayor and Common Council declared Q

16 that all the land included within the boundaries of said district receive a special benefit by the

17 maintenance of said landscaping; and

WHEREAS, said Resolution No. 91-434 declared that an annual assessment shall be
19
levied on all land within the district to provide funding for said landscaping maintenance and s
20
the administration thereof; and
21 a
22 WHEREAS, an Assessment Roll has been prepared totaling $20_,294.94, which sets
23 forth the individual assessments to be levied on each of the parcels of land within Assessment
24 District No. 1005 for the fiscal year 2014/2015; and
25 WHEREAS, Article XIII D of the California Constitution requires that any and all
26
27 Assessment Districts existing on the effective date of said Article XIII D shall comply with the
28 procedural and approval process as set forth in Section 4 of said Article XIII D, except as set

1 forth in Section 5 therein.
2 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THI
3 CITY OF SAN BERNARDINO AS FOLLOWS:
4 SECTION 1. That the Mayor and Common Council do hereby find and determine tha
5 the assessments as set forth on said Assessment Roll No. 1005 are hereby exempt from the
6 procedural and approval requirements of Article XIII D of the California Constitution, a:
7
provided for under Section 5(b) of said Article XIIl D, and that the assessment amounts as sei
8
forth on said Assessment Roll are equal to or less than any prior approved assessments.
9
10 SECTION 2. That the Mayor and Common Council do hereby find and determine that E

11 the proportionate costs to be levied against the parcels of land within Assessment District No. N
12
1005 are correctly set forth on Assessment Roll No. 1005, for the fiscal year 2014/2015, on file N
13 '
in the office of the City Clerk of the City of San Bernardino, and do hereby confirm said o
14
assessments.

16 SECTION 3. That the City Clerk is directed to cause a copy of this Resolution to be M

17 transmitted to the Office of the Auditor-Controller for the County of San Bernardino with the

1.8 request that the individual assessments be placed on the subject 2014/2015 property tax bills for a

collection together with all other property taxes. E
