A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BER- NARDINO ORDERING THE VACATION OF A PORTION OF MILL STREET IN THE CITY OF SAN BERNARDINO AND REPEALING RESOLUTION NO. 4302. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO: SECTION 1. That the Mayor and Common Council of the City of San Bernardino, having heard the evidence offered in relation to the proposed vacation of a portion of Mill Street between a point 527.45 feet West of Bordwell Street and Lytle Creek Channel Right of Way, more particularly described in Resolution of Intention, Resolution No. 5024, hereby finds from all of the evidence submitted that the portion of Mill Street between a point 527.45 feet West of Bordwell Street and Lytle Creek Channel Right of Way proposed to be vacated by said resolution is unnecessary for present or prospective public street purposes. SECTION 2. That the Mayor and Common Council of said City do hereby order the vacation of that portion of Mill Street between a point 527.45 feet West of Bordwell Street and Lytle Creek Channel Right of Way described in said Resolution No. 5024 . SECTION 3. Nothing in this resolution shall in any way affect or disturb any existing easements for public utility purposes belonging either to the City of San Bernardino or to any public utility and there is hereby reserved for future general public utility purposes and for this city an easement reasonably necessary to locate public utility facilities over, in, under., or across a portion of the premises men- tioned herein before and to use, maintain, repair, replace or renew such facilities. SECTION 4. That the City Clerk of the City of San Bernardino shall cause a certified copy of this resolution to be recorded in the office of the County Recorder of the County of San Bernardino. SECTION 5. That Resolution Ordering Vacation, Resolution No. 4802 approved by the Mayor and Common Council of the City of San Bernardino on the 19th day of May, 1958, is hereby repealed. SECTION 6. That the City Clerk shall certify to the adoption of this resolution and thence forth and hereafter the same shall be in full force and effect.
