May 5, 2014 (FY2013-2014) Balance after approval of this item: Grant Award$30,000; Aquatics General Fund$292,427 With the acceptance of this grant award, $30,000 in funds for this program will be appropriated into grant fund revenue Account No. 123-380-0000-4695 as a Contribution Sponsorship (non- Federal or State Grant) and an expenditure appropriation of$30,000 in Account No. 001-0979- ' 0069-XXXX-2003 per the attached FY 2013-14 and FY 2014-15 budgets. There is no City cash match requirement, though the funds may only be used per the grantor to subsidize the program and not replace full expenses. The Administrative Services Director is authorized to incorporate the changes into the FY 2013-14 and FY 2014-15 budgets. FY 2013-14: $10,850 into line item 5014 (Salaries Temp/Part-time); $3,720 into line item 5111(Materials and Supplies) and$2,160 into line item 5174 (Printing Charges). FY 2014-15: $13,270 into line item 5014 (Salaries Temp/Part-time) Please note this balance does not indicate available funding. Synopsis of Previous Council Action: April 29, 2014 Grant Committee to approve the acceptance of a contribution sponsorship from Kaiser Permanente Operation Splash Regional Community Benefit Grant Program for funding in the amount of $30,000 for the 2014 Summer Aquatics Season. May 6, 2013 Mayor and Common Council accepted a grant award from Kaiser Permanente Operation Splash Regional Community Benefit Grant Program for funding in the Updated:4/28/2014 by Georgeann"Gigi"Hanna A I Packet Pg. 136 5.1 3096 amount of$30,000 and ratified the submittal of an on-line grant application upon invite to Kaiser Permanente Fontana and Ontario Medical Centers Community Benefit Grant Program for funding in the amount of$25,000 to provide for the Parks, Recreation and Community Services Department for the 2013 Summer Aquatics Season. March 19,2012 Mayor and Common Council ratified the submittal of an on-line grant application to Kaiser Permanente Regional Operation Splash Community Benefit Grant Program in the amount of $30,000 for funding of aquatics programs in 2012 Season. December 20,2010 Mayor and Council ratified submittal of a grant application to Kaiser Permanente Operation Splash Regional Community Benefit Grants Program in the amount of $20,000 to provide the Parks, Recreation and Community Services Department Aquatics Program for the 2011 Summer Season. December 21,2009 Mayor and Council ratified the submittal of a Letter of Interest to Kaiser Permanente Fontana Medical Center Community Benefit Grants Program for funding in the amount of $25,000 to provide the Parks, Recreation and Community Services Department Swim Program at Nunez Pool for the 2010 Summer Season. August 3,2009 Mayor and Council ratified the submittal of a grant application to Kaiser Permanente Operation Splash Regional Community Benefit Grants Program for funding in the amount of $20,000 to augment the Parks, Recreation and Community Services Department Swim Program for the 2009 Summer Season. Backl4round: Due to financial shortfalls and budget reductions,the Parks Department has pursued grant opportunities to Ld supplement aquatics programming and access to community pools. The Department has been awarded two grants from Kaiser Permanente Community Benefit Grants Programs in the past six fiscal years; one from the local Fontana & Ontario Medical Center and the second from the Kaiser Southern California Regional Headquarters. Within the past five fiscal years, grant awards amounts have ranged from $20,000-$45,000. Because of grant funding, swimming pools at Ruben Campos/Nunez, Meadowbrook/Hernandez and Mill Parks were able to remain open throughout the traditional summer seasons. The grants also provided limited free swimming lessons for low-income youth at Ruben Campos/Nunez and Hernandez pools and continuation of a Junior Lifeguard Program at the Jerry Lewis Family Swim Center. Kaiser is once again awarding grants for the upcoming summer season. The awarding of a Community Benefit Grant (from Regional Kaiser Permanente Operation Splash Program) in the amount of$30,000, will allow the Department to offer low-income youth (ages 6-17 years) the opportunity to learn how to swim or to advance their swimming skills at no cost at the Hernandez Pool. The City's Grants Committee included the Community Benefit Grant as an agenda item for approval, scheduled for April 29, 2014. Kaiier grant funding will also allow the Department to continue the Junior Lifeguard Program for a third season at minimal cost for under-privileged San Bernardino youth. Furthermore, the Department will be able to provide greater access for low-income patrons by offering pool passes for those who cannot afford the regular fees at Hernandez Pool and Mill Pool. Approximately $5,000 of the grant award will be appropriated for ReThink Your Drink campaign. ReThink Your Drink was designed to encourage youth and adults (swim patrons) to consume healthier beverages in their daily routine through nutrition education. This season, staff will provide healthy drink educational material to all pool visitors, including ReThink Your Drink lapel pins and refrigerator magnets. Q c This Agreement sets forth the understanding of the parties hereto as to the terms and conditions under which the Foundation at the recommendation of KFH shall donate funds in the amount of$30,000.00 payable over a one year funding period beginning April 1,2014 0 through April 1,2015 for 2014 Operation Splash: City of San Bernardino. Such terms and conditions are as follows: W An 1. Tax Exemption Status: Grantee represents that at all times relevant herein, a charter city Y organized in the State of California and not subject to federal or state income tax. o� 0 2. PMose of Grant. Grantee shall use entire Grant to support the specific goals, objectives, v activities,and outcomes as stated in the Grantee's funding application and,for Grants greater o than$25,000, as submitted in the Work Plan. CD Cn 3. Expenditure of Funds. This Grant(together with any income earned upon investment of grant funds)is made for the purpose outlined in the Grantee's Work Plan and may not be rr expended for any other purpose without KFH's prior written approval. a 4. Prohibited Uses. In no event shall Grantee use any of the funds from this Grant to(a) N support a political campaign, (b) support or attempt to influence any government legislation, except making available the results of non-partisan analysis, study or research, or(c) grant an a award to another party or for any purpose other than one specified in Section 170(c)(2)(b) of the = Internal Revenue Code of 1986 as amended. 5. Return of Funds. The Foundation reserves the right to discontinue,modify or withhold 0 payments to be made under this Agreement or to require a total or partial return of any funds, including any unexpended funds under the following conditions: L (a) If KFH, in its sole discretion, determines that the Grantee has not performed in 2 accordance with this Agreement or has failed to comply with any term or condition Y of this Agreement. (b) If Grantee loses its status as an eligible Grantee under Paragraph 1 above. E (c) Any portion of the funds is not used for the approved purpose (d) Such action is necessary to comply with the requirements of any law or regulation Q applicable to Grantee or to KFH or to this Grant. KFH is authorized to conduct audits,including on-site audits, at any time during the term of this Grant and within four years after completion of the Grant. Grantee shall allow KFH and its representatives,at its request,to have reasonable access during regular business hours to Grantee's files,records, accounts,personnel and client or other beneficiaries for the purpose of making such audits, verifications or program evaluations as KFH deems necessary or appropriate concerning this Grant. Grantee shall maintain accounting records sufficient to identify the Grant and to whom and for what purpose such funds are expended for at least four(4)years after the Grant has been expended. Cr 7. No Assignment or Delegation. Grantee may not assign, or otherwise transfer,any rights a or delegates any of Grantee's obligations under this Agreement without prior written approval from KFH. 8. Records and Reports. Grantee shall submit written progress report(s)to KFH in o accordance with the due dates stated on the Grant Summary(Attachment). a Grantee shall be primarily responsible for the content of the evaluation report. If KFH n determines IRB approval is necessary, as part of the evaluation process,Grantee shall follow Y KFH IRB approval processes and procedures. am 0 9. Required Notification. Grantee is required to provide KFH with immediate written notification of any change in Grantee's tax exempt status or when Grantee is unable to expend o the grant funds for the approved purposes described in the Work Plan. 10. Identification of KFH. Grantee shall identify KFH as a supporting organization in all published material relating to the subject matter of this Grant. Whenever possible and a appropriate, Grantee shall publicly acknowledge KFH for this Grant. a T 11. Equal Employment Opportunity. Grantee shall comply during the term of this Agreement Y with the provisions of the Immigration Reform and Control Act of 1986 and any regulations promulgated thereunder. Grantee hereby certifies that it has obtained a properly completed Employment Eligibility Certificate(INS Form I-9)for each worker performing services related to the program described in the Work Plan. Grantee agrees to maintain,in full force and effect,all required governmental or professional licenses and credentials for itself,its facilities and for its employees and all other persons engaged in work in conjunction with this Grant. 14. Payment of Grant. Payment may be made from the Kaiser Permanente Southern California Fund for Charitable Contributions,a component fund of the Foundation. (a) First payment by the Foundation will be contingent upon a signed Agreement between y the Foundation, KFH and Grantee.
