On November 17, 1997, the Mayor and Common Council adopted a revised
wastewater ordinance. The revisions were necessary to revise industrial limits for
discharge, require compliance with Federal and State wastewater standards, revise
penalties for violation of discharge standards and to make various technical
corrections .
These changes were made necessary, in large part, because the California
Regional Water Quality Control Board makes most of the revisions a condition of
issuance of the National Pollutant Discharge Elimination System (NPDES) permit .
The proposed revisions to the wastewater ordinance were submitted to the
Regional Water Quality Control Board in advance of the action taken by the Board
of Water Commissioners to refer the matter to Mayor and Common Council and the
first reading before Mayor and Common Council . However, the Regional Water Quality
Control Board did not provide its comments until after the first reading.
The Regional Water Quality Control Board has requested a revision to Section
13 . 32 . 275, regarding the annual public notice of significant noncompliance . The
change consists of the addition of one clause requiring that publication will occur
not later than the month that the annual pretreatment report is filed with the
Regional Board. The Regional Board felt that without the fixed deadline, the task
of publication tends to be overlooked or untimely.

2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER 13.32,
SECTION 13.32.275 OF THE SAN BERNARDINO MUNICIPAL CODE, RELATING TO
3 ANNUAL PUBLIC NOTICE OF SIGNIFICANT NONCOMPLIANCE
4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO do
5 hereby ordain as follows:
6 Chapter 13.32, Section 13.32.275 of the San Bernardino Municipal Code is hereby
7 amended to read as follows:
8 "13.32.275 Annual Public Notice of Significant Noncompliance. The Director shall
9 publish annually and not later than the month that the Annual Pretreatment report is filed with
10 the Regional Board, in the largest daily newspaper published in the Service Area, a list of all
I I Industrial Users determined to have been in Significant Noncompliance with applicable
12 Pretreatment Standards or Requirements during the previous twelve months."
